This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983. The following changes made in the DRAFT permit have been incorporated into this FINAL permit: • Influent sampling for BOD and TSS was deleted. • Monitoring frequency for pH was changed from 2/month to weekly. • Addition of quarterly monitoring for total nitrogen and total phosphorus, based on the need to gather additional nutrient data prior to the development of a nutrient management strategy for High Rock Lake. • Stream classification was updated from C to WS-IV. • The permit expiration date was changed from April 30, 1999 to December 31, 2003. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such a demand is made, this permit shall be final and binding. Please take notice that this permit is not transferable. Part II, EA. addresses the requirements to be followed in case of change in ownership or control of this discharge. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act, or any other Federal or Local governmental permits may be required. RESPONSE: This agency has reviewed the draft permit and determined that the proposed discharge will not be sufficiently close to any existing or know proposed public water supply intake so as to create an adverse effect on water quality. We concur with the issuance of this permit provided the facility is operated and maintained properly, the stated effluent limits are met prior to discharge, and the discharge does not contravene the designated water quality standards. Outfall was relocated to main stem of Forbush Creek in 1990 to gain more assimilative capacity. Effluent flow currently averages 0.006-0.008 MGD for 1996-1997 period. DMR Data. In calendar year 1997, facility generally met permit limits. Violations notice or BOD (1 Monthly Avg, 2 Daily Max); and Fecal Coliform (3 Daily Max). There is no NH3 limit, and concentrations generally ranged from 1-10 mg/l. There were no violations for TRC; however, permittee should report nondetects as less than detection limit, rather than "0". Instantaneous flow data ranged from 0.007-0.008 MGD, with no flow during school closure period. Page 1 Version: October20, 1998 WLA/Receiving Stream Data. The last WLA conducted January 1990 for 0.015 MGD ischarge recommended secondary limits (30 mg/1) for BOD/TSS; with no limit for NH3 or DO. Updated toxicant analysis confirms no need for NH3 limit. There is no instream data collection requirement for this facility. Forbush Creek is not listed in the 1998 303(d) list. Forbush Creek, a trib to Yadkin River, was assigned a Good -Fair bioclassification using macroinvertebrate data (May 1998 Yadkin-PeeDeeBasin Plan); overall use support for monitored segment is Support Threatened due to sediment from nonpoint sources. There are no impaired waters in the 030702 subbasin. Staff Report. Last staff report in file was prepared January 1990. Miscellaneous. NPDES Policy is to add requirement for continuous flow monitoring for effluent flow >10,000 gpd. Permitted flow is 15,000 gpd; however, actual flow is 7,000-8,000 gpd with little variability. Therefore, recommend holding off on continuous flow requirement with reevaluation during next permit round. The enclosed application has been completed. A check is enclosed for both facilities. Our facilities are pumped yearly by Lentz Septic Tank Service NCS#00147. This includes any unwanted septage as well as sludge generated by our facilities. I would like to request that influent sampling be waived.
