Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This final permit includes following major changes from the draft permit sent to you on October 13, 2004: • Due to the objections from EPA, the compliance schedule for TRC and TP has been removed from the permit. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Marl Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required bythe Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that maybe required. (Summer) . = April 1- October 31 (Winter) = November 1 - March 31 There shall be no discharge of floating solids or visible foam in other than trace amounts. Permit NC0006033 SUPPLEMENT TO EFFLUENT LBUTATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS A. (2.) CHRONIC TOXICITY PERAUT LDHT (QRTRLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 4.7%. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of March, June, September, and December. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions.The ' chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR 1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and TBP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the following address: Attention: Environmental Sciences Section North Carolina Division of Water Quality 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. Permit NC0006033 A. (3.) COLOR PERMITTING REQUIREMENTS FOR TIER 2 FACILITY This facility has been classified as a Tier 2 color discharger. The permittee will conduct color monitoring of instream stations (upstream, downstream) on a monthly basis during summer season (April -October). The permittee will record whether a color plume was observed around the outfall pipe during the monthly instream sampling events, and include that information on the monthly discharge monitoring report. Effluent samples will be collected monthly for color on a year-round basis. Color samples will be analyzed for ADDM color at natural pH. Effluent samples will consist of 24-hour composites, while instream samples will be collected as grabs. Samples will be analyzed by a state certified laboratory. If data show that water quality standards for color are being violated by the discharge permitted by the terms of this permit, then the Director may reopen this permit for the purpose of imposing additional requirements pursuant to 15A NCAC 2H.0114. Alternatively, if future conditions change and color is no longer a component of the influent wastestream, then the permittee may request a permit modification to remove color permit requirements. A. (4.) TOTAL NITROGEN CALCULATIONS The Permittee shall calculate and report the annual mass loadinof total nitrogen ('M as the sum of monthly loadings, according to the following equations: (I) Monthly Mass Loading (pounds/month) = TN x Q x 8.34 where: TN = The average total nitrogen concentration (mg/L) of the weekly composite samples collected during the month Q = The total wastewater flow discharged during the month (MG/month) 8.34 = Conversion factor, from (mg/L x MG) to pounds (2) Annual Mass Loading (pounds/year) = Sum of Monthly Mass Loadings for the calendar year The Permittee shall report the total nitrogen concentrations for each sample and the monthly mass loading in the appropriate monthly self -monitoring report, and the annual mass loading of total nitrogen in the December self - monitoring report for the year. EFFLUENT POLLUTANT SCAN The Permittee shall perform an annual Effluent Pollutant Scan for all parameters listed in the attached table (using a sufficiently sensitive detection level in accordance with 40 CFR Part 136). Samples shall represent seasonal variations. Unless otherwise indicated, metals shall be analyzed as "total." Dear Ms. Bryant: We would like to submit comments on the above proposed NPDES permit renewal, which would continue the discharge of treated wastewater into the South Fork Catawba River. We understand that the Town of Cramerton accepts wastewater from Mastercraft, a textile industry. According to DHEC monitoring data, the Lake Wylie is impaired by copper levels above the Mill Creek arm at the end of road S-46-557. South Carolina's standard for copper is 2.9 ug/I. In addition, Lake Wylie (Crowders Creek arm at SC highways 49 and 274) and the Catawba River (at South Carolina Highway 21) are impaired by fecal coliform bacteria. South Carolina's standards for fecal coliform in the Catawba River are "not to exceed a geometric mean of 200/100ml based on five day consecutive samples during any 30 day period; nor shall more than 10% of the total samples examined during any 30 day period exceed 400/100ml." City has a separate sewer collection system. The facility has permitted flow of 4.0 MGD discharging into the South Fork Catawba River. For the past 2 years annual average flow varied within the range of 1.03-3.58 MGD. REASONABLE POTENTIAL ANALYSIS Reasonable potential analysis was conducted for: As, Cr, Cu, Pb, Hg, Mo, Ni, Phenols, and Zn. TOXICITY TESTING: Type of Toxicity Test: Chronic P/F (Ceriodaphnia dubia) Existing Limit: 001: Chronic P/F @ 4.7% Recommended Limit: 001: Chronic P/F @ 4.7% Monitoring Schedule: March, June, September, and December The facility has been consistently passing its WET tests with two exceptions. Toxicity tests conducted after failures passed. COMPLIANCE SUMMARY: DMRs have been reviewed for the period January 2001 through September 2004. Facility has a good compliance record. During the review period, the following NOVs (notices of violation) have been issued: 09/08/03 — BOD, 04/09/02 - sulfides, 02/25/02 — WET failure, 11/26/01 — WET failure. Page 1 Version: September 24, 2004 A compliance biomonitoring inspection conducted on February 25, 2004 found that the operation and maintenance of the facility are commendable. INSTREAM MONITORING: Instream monitoring is required for temperature, dissolved oxygen, color, and conductivity. An analysis of DO, temperature and conductivity data showed that the facility has no noticeable effect on the receiving stream. PROPOSED CHANGES: • Monitoring Frequencies: No changes are proposed. • Limits: A weekly average limit for ammonia nitrogen has been added to the permit. • Priority pollutant monitoring on an annual basis has been added to fulfill the permit application requirement in the future. • Permittee has conducted a color reduction study to meet a requirement of the special condition A. (3.). Therefore, this requirement is deleted from the draft permit. However, color monitoring remains since the facility receives waste from textile manufacturer.
