Please let me know if DWR has any further comments, either for clarification or that would warrant updates to the
mitigation plan.
Andrea has indicated that her comments send by email yesterday were for clarification purposes only, and that she is
not requesting any further updates.
We are trying to plan for construction ramp up - if you could provide me an idea on what to anticipate as far as 401
permit timeline, that would be most appreciated.

We understand these. Would you like us to rewrite the text in the mitigation plan to clarify 2a, or just respond to
formally acknowledge (if we did that, maybe we would add this email with an acknowledgment of your response to the
front suite of letters and approvals). As for 3, we do not intend to update the mitigation plan for additional potential
wetland areas. I am verifying with Matthew that he can access it and post it to the portal - the link seems good so
something must be blocking you from accessing.

Hi Jake,
Just to clarify a few points in your response:
Regarding 2a: During our conversation we discussed that we do not require that the wetland hydrology data
demonstrate saturation within 12 inches of the soil surface for at least 8.5% of the growing season for the first year of
monitoring but data should indicate that the site is trending toward meeting the performance standard and subsequent
monitoring should demonstrate that the site is meeting the performance standard in order to close out the site with the
proposed mitigation credits.
Regarding # 3: Areas that have the potential to generate mitigation credits should be identified (and justification
provided) in the mitigation plan in order to provide the IRT the opportunity to review /comment. Also, we do not
recommend postponing data collection because areas proposed to generate wetland mitigation credits based on
hydrologic restoration /enhancement require 7 years of hydrologic monitoring data. If you determine after the first or
second year of monitoring that these areas are not suitable to generate mitigation credits, you can elect to terminate
monitoring.

On September 22, 2015, we received the Pre - Construction Notification (PCN) for a Nationwide Permit #27 involving four
(4) stream reaches and ten (10) wetland areas on the Henry Fork Mitigation Site. The stream reaches are identified as
UT1, UT1A, UT1B, and UT 2 and the wetland areas are identified as Wetlands A,B,C,D,F,G,J,O,R, and S. The proposed site
is located north of the intersection of Harris Farm Road and Mountain View Road, southwest of Hickory, Catawba
County, North Carolina. (35.702.893, - 81.364436) The PCN requests DA permit authorization for impacts to 5,544 linear
feet of stream channel and 0.380 acre of wetlands associated with stream and wetland restoration and enhancement
activities.
The application is incomplete and cannot be processed until the following information is received:
1. Recent information indicates the potential for impacts to the Henry Fork mitigation site associated with replacement
of a natural gas pipeline. We are unable to process your application until this issue has been resolved.
2. The Henry Fork Draft Mitigation Plan was approved contingent upon the provider revising the final mitigation plan to
address IRT concerns. See below for IRT concerns that have not been sufficiently addressed in the revised mitigation
plan.
a. Wetland Hydrology Performance Standards: Wetland areas receiving mitigation credit for hydrologic
restoration /enhancement should demonstrate saturation within 12 inches of the soil surface for at least 8.5% of the
growing season for Catawba County.
b. Invasive Species Management: Please provide details on contingency actions to address invasive species
issues.
c. Stream Gaging on Intermittent Streams: Please note that a sufficient flow regime is typically a minimum 30
consecutive days of flow.
Regarding Section 8.2, contingency plans for additional wetland credits, please note that no additional credits may be
requested for mitigation sites after mitigation plan approval. Regarding recent discussions between NCDMS and the
Corps, areas that have the potential to generate mitigation credits should be identified during mitigation plan
development and included in the mitigation plan with established monitoring protocols and performance standards.
If you are unable to submit the above information within 30 days of receipt of this Notification, we will consider your
application withdrawn. Please call or email me if you have any questions.
