Based on the available information, including the "OVERALL PLAN" you submitted for the Starmount Subdivision Phase 3, it appears that neither the proposed access road, nor any of the other proposed impacts for Starmount Phase 3 would impact waters of the United States, including wetlands; therefore no permitting under Section 404 of the Clean Water Act is required for Phase 3. Below is an email from you last November about the same project but NCDENR needs an email from you giving your blessing to the stream determination. | met onsite yesterday morning with [heng Zhang and he flagged the head ofthe stream. Based on his determination we are 30' from the head of the stream so there is no stream disturbance. |am Please let me know if there is anything else you need. VVe pushed our road as far east as possible to avoid a stream crossing but it looks like vvewill still be crossing at the very end.
