Ms. Sullivan and Ms. Foster,
On January 25, 2024, the Division of Water Resources (the Division) received your application requestions a Buffer
Authorization from the Division for the subject property. The Division has determined that your application is
incomplete and cannot be processed. The application is on -hold until all of the following information is
received:
1. The application did not include enough detail or plans to allow the Division to fully evaluate the
project's effects on water quality. Several key items needed for review were missing from the
application, specifically:
a. The Proposed Impacts Inventory of the application is not complete. Please fill out the Buffer
Impacts tables (Section C, Item 1) listing all buffer impacts in both zones including their type,
reason, and total area in square feet. [15A NCAC 02B .0611 (b)(1)(D)]
b. The included map of the proposed map does not include measurements or accurate location
information. Please provide a map that shows the exact dimensions of the cart path, including
length and width, and its actual location on the property, including where it will be located within
each buffer zone. [15A NCAC 02VB .0611 (b)(1)(F)]
c. The application does not include sufficient information or explanation for Avoidance and
Minimization (Section D, Items 1 a and 1 b). Please specifically describe measures taken to avoid or
minimize proposed impacts in designing the project. For this project, since the purpose of the
project is a path leading from the house to the dock, please explain why the site plan included in
the application depicts a circular path through the buffer zone with no apparent connection to the
dock. Please explain why this plan for this activity cannot be practically accomplished, reduced,
relocated, or reconfigured to avoid or better minimize disturbance to the riparian buffer. [15A

Pursuant to Title 15A NCAC 0215A NCAC 02B [Catawba].0611, the applicant shall furnish all of the above
requested information for the proper consideration of the application. Please respond in writing within 30
calendar days of receipt of this letter by sending one (1) copy of all of the above requested information to the 401 &
Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617 OR by submitting all of the above
requested information through this link: https://edocs.deq.nc.gov/Forms/Supplemental-Information-Form (note
the DWR# requested on the link is referenced above).
If all of the requested information is not received within 30 calendar days of receipt of this letter, the Division will
be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate
reapplication to the Division for approval, including a complete application package and the appropriate fee.
Please be aware that you have no authorization under the Section 401 of the Clean Water Act / Buffer Rules for this
activity and any work done within waters of the state may be a violation of North Carolina General Statutes and
Administrative Code.
