I did do a mod letter for the 0.01 acre spring and had it put into the mail yesterday. I did this because the spring being
in the flood plain of Smith Creek would most likely be captured as JD with the new WOUS rules. It was a easy fix to do a
mod letter now so that it would not possibly become an issue later with the WOUS rules.

I think John is claiming jurisdiction over the stream, so we need to permit <0.01 acres of surface water. If he has already
issued the 404 mod, then you might want to go ahead and issue so the 401 and 404 match up.

We've had a change in plans. It would take 600', not 100', to make up the fall required to outlet the spring to the creek
at the proper elevation. We will no longer need the temporary impacts to the bank of Smith Creek. Instead , we will put
a temporary French drain to temporarily remove the water, and then fill the spring site around the spread footing with
concrete.

We need to install a French drain from the spread footing to Smith Creek in order to remove the water from a spring
that popped up during construction. This will result in @10' of temporary impacts to Smith Creek in an area where
we're not permitted to work. This is needed for long term structural stability of the bridge. The area will be stabilized
after the French drain installation. We're actively working on the bridge, and would like to proceed early next week.
The work area will be isolated from the flowing water. Do we need to submit a permit mod, and if so, can we do so after
the fact?
I've drawn a red line on the plans and the structure plans which are attached.

Amy,
On Structure #10 that is currently being constructed there appears to be a spring with a fair amount of water flow
around the bridge pile that was driven on top of the spring. In order for the remaining spread footer construction to be
completed and to alleviate the water flow in this area the Department would like to request permission to allow the
contractor to install a one foot French drain running from the corner of the spread footing to the flowline of Smith Creek
approximately 100 feet downstream(see attachment for location). The French drain would consist of 1 foot of #57
washed stone encapsulated in Geotextile. The outlet end of the French drain would consist of a 6" PVC outlet pipe. The
work will require temporarily digging through the bank of Smith Creek, laying the outlet pipe, backfilling the creek bank,
spreading a native seed mix and covering with Coir Fiber Mat. Disturbance of the stream bank should last no more than
one day in duration. Please contact me if you have any questions.
