Division of Water Resources (DWR) that the activities proposed below may proceed under General Water Quality Certification 3890. DWR #15 -0618 and SAW- 2014 -01762 correspond to the section 401 and 404 approvals previously received for proposed temporary impacts to streams (20 LF) and wetlands (0.01 acre) on the property resulting from the installation of a sewer line. DWR #15 -0618 also approved buffer impacts associated with the sewer line installation (Z1:1,245 ft2, Z2:905 ft2) as well as buffer impacts associated with the discharge of a stormwater BMP device (Z1:650 ft2, Z2:420 ft2) . These impacts have not yet occurred. Within the previously approved site plan, off -site stormwater discharge was determined to threaten the stability of existing adjacent structures (e.g. houses). At the request of the City of Raleigh, the original outfall was moved due to complaints from adjacent landowners. The stability of an adjacent tributary's stream bank was also being compromised as a result of the stormwater discharge. To address these issues the City of Raleigh requested that the stormwater discharge point be revised. A site meeting with Ms. Cherri Smith of DWR; Sean Clark of SEPI; representatives from the City of Raleigh; and representatives of Ashton Raleigh Residential was held on September 18, 2015 to discuss the concerns and evaluate potential solutions. In an effort to minimize future stream bank impacts and threats to adjacent structures the approval of Impacts 3 and 4 as depicted and described in this submittal are requested. The newly proposed Impact 3 (Z1:1,955 ft2; Z2:2,100 ft2) will discharge stormwater away from the existing structures and direct stormwater discharge into Big Branch. The stormwater angle of entry into Big Branch has been reduced from a perpendicular angle to that of approximately 300 in order to protect the stream bank opposite the discharge point. The newly proposed Impact 4 (Z1:20 ft2; Z2:300 ft2) will stabilize and protect the impacted stream bank and revegetate this area. Given Page 1 of 2 the circumstances, all newly proposed buffer impacts are considered "Allowable" within the table of uses as per page 5 of 15A NCAC 02B .0233. We;are respectfully requesting that the existing DWR #15 -0618 be revised to include the.additional Impacts 3 and 4 described. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The site is currently forested and is located inside the beltline of Raleigh which is in central Wake County, North Carolina. The site contains a sewer line easement that runs northeast / southwest and is located in the eastern portion of the property. The elevation of the site ranges from approximately 254 feet above mean sea level (msl) in the southeastern tip of the property to an elevation of approximately 206 msl in the southwestern tip of the property. The project is a proposed townhome site and grading has begun. Although riparian buffer and stream impacts have previously been approved, these impacts have not yet occurred. 3b. The newly proposed buffer impacts result from the need to safely discharge off -site stormwater without impacting existing homes and structures. 3e. The project will include the construction of stormwater devices, roads, and other utilities needed to support such a project. Impact Justification and Mitigation 1. Avoidance and Minimization 1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The applicant requested a detailed delineation of streams and wetlands within the proposed project boundaries prior to preparing the site plan in order to insure the limitation of impacts to the natural environment. Following the delineation the proposed alignment was shifted in places to minimize impacts to jurisdictional features and riparian buffers. Complete avoidance of streams was not practicable because the existing sewer line that the project will tie into is located on the opposite side of the stream from the project thereby requiring a stream crossing. Areas in addition to the riparian buffers were left as open space along the drainage providing additional buffering of the jurisdictional areas. The utility crossing was oriented to provide as close to a perpendicular crossing as possible to further minimize impacts. Several stormwater discharge point options were reviewed to minimize and reduce direct and indirect impacts to buffers and streams. Additionally, the support and permission of adjacent property owners was needed because the applicant did not own the property immediately adjacent to Big Branch. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Stream banks within the temporary impact area of the utility installation will be stabilized immediately after the installation and the buffer areas will be seeded. Road slopes will be seeded and stabilized once construction of the road crossing has occurred. The proposed limits of disturbance will be flagged in the field to avoid and minimize any unnecessary and unintentional impacts to the buffered and jurisdictional areas. 2.
