Dear Sir: The North Carolina Department of Transportation (NCDOT) proposes to conduct repair activities at Bridge No. 380112 on SR 1306 over North Forlc Tar River in Granville County. The Federally Endangered Dwarf Wedgemussel (Alasmidonta heterodon) is listed by the USFWS for Granville County where it is known to occur within the Tar River and tributaries to the Tar River. A known population Dwarf Wedgemussel is located in the North Fork Tar River immediately downstream of this location where the North Fork Tar River crosses US 158. Interior Bent 2 is located near mid-channel and Interior Bent 3 is located along the east streambank. The left end (upstream end) of the timber cap of Interior Bent 2 is decayed and must be replaced by Granville County bridge maintenance personnel. The Department proposes to conduct the following activity: -Personnel will enter the stream channel as necessary by foot. -Four (4) 2 ft x 2 ft sand bag piles will be placed by hand on the streambed along the sides of Interior Bent 2. -Steel plates will then be placed over the sand bags to provide a flat surface. -A crane on the bridge deck will place steel I-beatns on top of the steel plates to lift up the deck. -A tarp will be placed under the bridge deck to capture any wood or debris. -The damaged timber cap will be cut up into pieces and lifted up to the bridge deck. �'s`Nothing Cornpares°=,�. T�NNYS+DN Secretary 7'ransportation anticipated work activity. No mussel survey has been conducted at the site in anticipation of the proposed work activity. The NCDOT proposes a Biological Conclusion for Dwarf WedgemusseL• May Affect; Not Likely To Adversely Affect This biological conclusion is based on the very small anticipated const�uction footprint of approximately 16 squaYe feet of the temporary fill irnpact on the streambed of the Norih FoNk TaY River. The Department proposes to conduct a mussel survey by qualified staff personnel in the anticipated construction footprint within a week of tbe commencement of the repair work. The findings of the mussel survey will be forwarded to your agency within a day. Non-federally protected species will be relocated from the anticipated construction footprint at the time of the survey. The presence of the Dwarf Wedgemussel within the anticipated construction footprint will require the Department to postpone the work and initiate Formal Consultation with your agency. NCDOT believes that the requirements of Section 7(a�2) of the Endan e� red Species Act (ESA� have been satisfied and hereby request your concurrence. Thank you for your assistance with this project. Murray, PWS North CaroIina Department of Transportation 261 Z North Duke Stree� Durham, Narth Caralina 27704 Dear Mr. Murray: This letter is in response to your letter of October 26, 2015 which �ro�ided the U.S. Fish and Wildlife Service (Service) with the bio�ogical concl�sion af the North Carolina Department of Transportation {NCDOT) that ti�e repair activities at Bridge No. 13 2 on SR 1306 o�er Narth Fork Tar River in Granville Caunty may affect, but are not likely ta adversely affect the federaily endangered dwarf wedgemussel {Alasmidonta heterodon). These comments are provided in accordance with Section 7 of the Endangered Species Act (ESA) of 1973, as amended {16 U.S.C. 1531-1543). According ta information provided, the NCDOT will repair tHe timber cap of Interior Bent 2. The only in-water wark required is four 2 feet x 2 feet sandbag piles which will be placed in the river by hand. The temporary conscruction footprint will cover approximately 16 square feet of the channel. NCDOT has agreed to conduct a limited mussel survey within the projec� footprint {i.e. under the bridge). [n the unlikely e�ent that dwarf wedgem�ssels are encoUntered, all work will cease vntil a formal Section 7 consultation can be conducted. Based on the limited amount ofwork in the channel and the commitment to survey for mussels under the bridge, the Service concurs with your conclusion that the praposed project may affect, but is r�ot likely to adversely affect the dwarf wedgemussel. We belie�e that the requirements af Section 7(a)(2) ofthe ESA have been satisfied. We remind you that obligatians under Section 7 consultation Fnust be recansidered if: (1} new information re�eals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered in this review; (2) this action is subsequently modified in a manner that was not considered in this review; or (3) a r�ew species is listed or critical habitat determined that may be affected by this identified action.
