Thank you for allowing Town of Bailey W WTF the opportunity to 'respond to this Notice of
Deficiency issued November 13, 2023; received on November 27, 2023, regarding the late submittal of
the Ground Water monitoring reports for March 2023 monitoring period.
First, we want to mention the following:
• All Required sampling was completed during the corresponding monitoring period.
o 03/09/2023 for the March monitoring period.
a All sampling parameters were compliant with the limits established on the permit.
• The results were received on 03/22/2023.
Unfortunately, due to, a clerical error, the report was completed on time but inadvertently not
submitted to DEQ. Upon immediate awareness, the GW59 report was submitted to DEQ, however,
submittal was past the required date which triggered the Notice of Deficiency. The personnel responsible
for the submittal process has received additional training to prevent future incidents.
It is our request that the Division take into consideration the actions taken by the permittee when
deciding whether further enforcement actions are warranted.
