Please find a revised PCN and cover letter for the proposed Brightleaf subdivision.
Changes were made to the site plan based on comments from the NC-DWQ and the
USACE in order to reduce or minimize the impacts on site. Also included is a letter
from the engineer that addresses comments made in an on-hold letter from DWQ.
We have also provided justification for the proposed thoroughfare (i.e. it should be
considered a separate project), as per a request from the USACE. In addition, the
main sewer line located along the floodplain of Lick Creek is included in this
application. This line will also serve an adjacent sub-division; however, we do not
believe the impacts should be considered cumulatively between the two projects.
The sewer line is sized to serve 1184 acres and the project area is only 687 acres in
size. We have provided an exhibit showing the capacity of the sewer line to aid in
your decision. Please feel free to call if you have questions or require additional

Please note that the applicant is in the process of finalizing the level spreader
designs. for phase 1. All stormwater outfalls wilt utilize measures to provide diffuse
flow (typicals are provided). This application has been revised to address concerns
noted by Mr. Bob Zarzecki and Mr. Todd Tugwell at a meeting conducted in
August of 2004. Prior to this meeting the applicant received an `on-hold' letter from.
the NC-DWQ, all issues were resolved during the office meeting. In addition, we

On behalf of Rhein Brightleaf, LLC, (property owner), we hereby request authorization
from the US Army Corps of Engineers to use Nationwide Permits 12, 18, & 39 for the
subject project to cover permanent and temporary impacts to stream channels and
wetlands. We also request written concurrence from the NC Division of Water Quality
(NC~DWQ) for Neuse River Buffer Impacts and 401 Certification. APre-construction
Notification Application (PCN) is attached, which includes an agent authorization form.
The proposed project, which consists of residential housing and commercial
development, is located north of Highway 70, approximately 2000 feet northeast of the
intersection of Highway 70 and Sherron Road (SR 1811). Please refer to the USGS
topographic map attached for the location of the project. S&EC conducted a detailed
wetland delineation and Neuse River Basin (NRB) Riparian Buffer evaluation on the
property in April and May of 2003 for the residential section of the property, .and in April
of 2004 for the commercial section of the property. Ms. Debbie Edwards confirmed the
buffer determination on the commercial portion of the site (see attached letter). Mr. Todd

Tugwell and Mr. Steve Mitchell approved the delineation and buffer evaluation,
respectively. Mr. Mike Horan of the NC Division of Water Quality conducted
intermittent/perennial determinations on May 27, 2004 and Mr. Todd Tugwell confirmed
our `importance' determinations on May 11, 2004. Rhein Brightleaf LLC subsequently
designed the proposed residential site plan to avoid jurisdictional waters and riparian
buffers to the maximum extent practicable. In fact, except for one road crossing, all of
the proposed impacts are to `un-important' channels. The applicant will use an
arch culvert at the Lick Creek Crossing in order to further minimize impacts.
Due to DOT constraints and the fact that the right-of--way was previously platted, wetland
and/or stream channel impacts could not be avoided at the Highway 70 entrance into the
subdivision. Moreover, this Entrance is needed to provide safe ingress and egress into
the subdivision. (Impacts A-1 and B-1; see attached letter from the project engineer).
Due to the size of the site, and topographical and road design constraints, impacts to
stream channels, buffers, and wetlands are unavoidable. Current proposed temporary
impacts include 0.364 acres of wetlands, 5621inear feet of stream channel, and 1.856
acres of buffers (Zone 1:0.76 acres and Zone 2: 1.096 acres). Permanent impacts due to
road construction include 0.498 acres of jurisdictional wetlands and waters (0.4290 acres
of wetlands), and 0.045 acres of isolated wetlands. Channel impacts include 804 linear
feet of intermittent stream channel, 165 l.f. of isolated stream channel, and 251 l.f. of
perennial stream channel (51 of which is considered important). Neuse River Riparian
Buffers will also be impacted and include 0.486 acres of isolated buffers and 2.67 acres
of riparian buffer impacts adjacent to jurisdictional stream channels. The engineer has
provided justification for impacts. Please refer to the attached comments dated
August 31, 2004.
The USACE's current policy requires applicants to avoid and minimize wetland and
stream channel impacts to the maximum extent practicable and compensatory mitigation
to offset unavoidable losses of waters of the US when impacts exceed the requirements
for notification (0.10 acre) or if a discharge to a special aquatic site such as wetlands is
proposed. Because impacts to wetlands exceed 0.1 acres the applicant .proposes
preserving the remaining 9.67 acres of wetlands on-site. If this does not satisfy
mitigation requirements, the applicant proposes payment to the EEP.
NC-DWQ's current policy requires mitigation for stream impacts greater than 150 linear
feet per project and for wetland impacts greater than 1 acre. Because perennial channel
impacts exceed 1501inear feet, the applicant proposes payment to the EEP. Additionally,
a number of the proposed road crossings will also require buffer mitigation (i.e. impacts
>1/3acre or 150 linear feet). A copy of EEP's acceptance for payment is included with
the application.
Because the site will contain less than 24% impervious surface (as per the City of
Durham requirements) we do not believe a stormwater management plan should be

required. The applicant will insure that stormwater enters the buffers at anon-erosive
velocity through the use of appropriate BMP devices.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map

project consists of the construction of a residential subdivision. Heav~quipment associated
with land clearing and construction will be utilized. This subdivision will provide the typical
infrastructure such as sewer roadways electrical etc.

to meet the demand for housing in this area.
IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,

S&EC conducted a detailed wetland delineation and Neuse River Buffer evaluation in April and
May of 2003 Wetland delineation maps were approved by Mr Todd Tugwell of the USACE on
April 12 2004 (AID #200420594) A site visit for stream importance /significance calls was
made on Mail 1 2004 by Todd Tugwell of the USACE and on May 27.2004 by Mike Horan of
the NCDWQ

VI. Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. The applicant must also
provide justification for these impacts in Section VII below. All proposed impacts, permanent
and temporary, must be listed herein, and must be clearly identifiable on an accompanying site
plan. All wetlands and waters, and all streams (intermittent and perennial) must be shown on a
delineation map, whether or not impacts are proposed to these systems. Wetland and stream
evaluation and delineation forms should be included as appropriate. Photographs may be
included at the applicant's discretion. If this proposed impact is strictly for wetland or stream
mitigation, list and describe the impact in Section VIII below. If additional space is needed for
listing or description, please attach a separate sheet.

Provide a written description of the proposed impacts: The proposed permanent impacts
consist of 251 feet of perennial channel (51 of which is considered important by the
USACE) 804 linear feet of intermittent channel, 165 linear feet of isolated intermittent
channel 0.498 acres of jurisdictional wetlands and waters (0.4290 acres of wetlands), and
0.045 acres of isolated wetlands resulting from road construction and lot fill. Permanent
buffer impacts include 0.486 acres of isolated buffers and 2.67 acres of riparian buffer
impacts adjacent to jurisdictional stream channels. The proposed temporary impacts include
562 linear feet of stream channel and 0.364 acres of wetlands due to sewer line installment.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It maybe useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The applicant requested a detailed delineation of wetlands on property in order to avoid

jurisdictional wetlands and waters to the maximum extend practicable. The applicant has
minimized impacts to important/perennial stream channels by using an arch culvert to
bridge Lick Creek,-and has limited important channel impacts to 51 linear feet over the
entire 550 acre site. For additional justification, please refer to the attached letter from the
project engineer. As well as a response to DWO and the USACE request for additional
information In order to access the portions of the property located west of channel 17, a road
crossin ig 's required Crossing, at the location shown for impact 17-2, allows the applicant to
place the imRacts as far upstream as possible It also allows a street pattern that does not require
a permanent road crossing impact to the Neuse Buffer along stream 16. The area around channel
19 is difficult to deal with due to the location of the drainages, the steepness of the topography,
the alignment of the street system and the design criteria for the streets. The alignment of the
Northern Durham Parkwa~is set by NCDOT, the Thoroughfare Plan for Durham, and the
stringent vertical and horizontal design standards mandated for this thoroughfare. The required
separation between intersections along the Northern Durham Parkway further dictates the
placement of the intersection with Golden Belt Parkway just west of impact 19-3. Due to the
controlled access and intersection separation requirements associated with the design of this
thoroughfare shifting this intersection to the north or south would conflict with the ability to
provide a second access to Northern Durham Parkway to the south, or the access to the north
which will serve Tract 10 and the proposed Durham County school site located just north of Lick
Creek Given these constraints, the client has proposed to cross as close to perpendicular as
possible Impact 19-3 is greatly constrained by the conditions outlined above. Without this
proposed crossing the area of approximately 4 acres located west of stream 19 and east of the
Northern Durham Parkway could not be accessed. Crossing impact A-1 is elaborated on in the

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as

incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmgide.html.
Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
Due to the size of the site, along with the constraints of topography and the roadway
design, impacts to channels and wetlands were unavoidable. Because impacts exceed 0.1
acres and > 1501inear feet of DWO perennial channel the applicant proposes preservation of
the remaining, wetlands (approximately 9.5 acres and/or payment to the NC-EEP for channel
impacts.
2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at

In response to the request for more information, and our discussion at the August 2°~
meeting in your office, regarding the application for Brightleaf at the Park we offer
the following
General Comments
1. Specific information pertaining to footprints of homes, location and
alignment of individual driveways and other impervious surfaces is
undetermined at this point in time. As part of the subdivision and zoning
approvals with Durham, we have agreed that the single family sections will be
developed at an impervious surface cover not to exceed 24%. The impervious
surface calculations are part of the preliminary subdivision plans, and
confirmed during the review and approval process for construction drawings,
and record plats. During platting each lot will be assigned a square footage of
allowable impervious surfaces. This is then applied to any building permit
application submitted to the City, which must include the quantity of
impervious surfaces in the application.
The townhouse and multifamily tracts will be developed at impervious
surface coverages in excess of 24% but less than 70%. We agree that any tract
developed for a use other than single family detached residential uses, with
impervious surface coverages above 30% will be subject to stormwater control
measures to provide 85% TSS removal. Plans for these tracts will be
submitted to DWQ for review as they are prepared.

2. We have added additional labeling and lot numbers to the impact maps.
Please understand that the lot numbers are preliminary and subject to change.
We have also added the existing topographic information to the impact maps
to help visualize the constraints of the site.
3. As with item 1 above, we have not yet completed detailed design of all these
road crossings and they will not be completed for some time. We have
however completed the construction drawings for Impacts A-1 and B-1 and
they were included in our original submittal. Since that time we have also
completed the design of Impacts 12-2. Details of this crossing have been
added to the impact maps. We have also noted that all permitted crossings
will be designed and installed in accordance with the conditions of the permit,
which will include placing the culvert invert a minimum of one foot below the
existing channel invert to allow for the passage of aquatic life.
4. We have added the details of these antiseep collars to the impact maps for
Brightleaf. They will also be added to the impact maps for the sewer outfall
being permitted under a separate application.
5. Diffuse flow will be provided at each stormwater outlet from the roadway at
each road crossing of a Neuse Buffer, outside of the buffer. The design at
Impact A-1 was included in the original impact mapping and is typical of the
design and calculations that will be provided to DWQ at a later time as the
detailed design of each crossing is completed.
6. We have included the small area between Impacts 19-3 and 19-4 as being
impacted.
7. Revised plans have been prepared for the sewer outfall, which is a separate
permit application, which eliminate many of these impacts.
S. hese Impacts are for berms and slopes, which are part of the various
tormwater detention devices proposed for the development. This is allowed
m Zone 2. No discharge of untreated stormwater will be allowed within the
buffer.

Minimization
1 a. Unfortunately this portion of sewer cannot be rerouted due to topographic
constraints. We have added the existing topographic data to the plans to make
.this apparent.
lb. These sewer lines cannot be rerouted or combined due to topographic
constraints.
J lc. We have moved this sewer to the north to cross the draw upstream of the
buffer, eliminating the buffer impact associated with Impact 16-1.
1 d. We anticipate that the size of the culverts to be used in the stream crossing of
Lick Creek with the Northern Durham Parkway and the topographic constraints
will preclude shifting Impact 3-6 to be contained within the right of way of the
Northern Durham Parkway.
le. We have revised the sewer alignment in this area to eliminate Impact 3-7.
J lf. Due to topographic constraints these lines cannot be consolidated into only
one crossing. However we can eliminate Impact 3-11 by connecting the line ~
upstream of that crossing to the east to the line that requires Impact 3-10.
lg. We originally put this sewer in the buffer to avoid an impact to the wetlands
area located just north of the proposed sewer. However we have found a way to
route the sewer between the two cul de sacs located to the north such that Impact
3-5 can be eliminated.
lh. We have revised the route of the proposed sewer to eliminate Impact 19-1. l
However, due to topographic constraints we can not eliminate Impact 19-2. +/
1 i. That line is actually a survey tie line to document the location of the isolated
wetlands to the property line. Since the sewer line is to cross just downstream of
the wetlands, no impact was indicated.
lj. Due to the topographic constraints, the 200 foot wide power line easement
and the metal power line tower, we are unable to relocate this sewer line and
cannot eliminate Impact 38A-1.

J lk. We have rerouted this section of sewer to eliminate Impact 12-1.
11. We have rerouted this section of sewer to eliminate Impact 11-1.
2a. These lots are still very much buildable. Holding a 20 foot front yard setback
and a 50 foot deep building envelope requires a lot that is only 70 feet deep from
the road right of way to the wetlands. We have revised the road alignment and
lot layout in this area slightly to make sure that all lots are clearly buildable.
2b. In order to provide the two access points to any section of 60 or more lots
required by Durham to meet public safety and emergency service access issues, a
road in the vicinity of Impact 3-13 is necessary. Shifting the road to the north
crosses a similar wetlands area and does so across much rougher topography.
Shifting this road to the south takes it across a much larger pocket of wetlands.
Therefore we believe that Impact 3-13 as currently proposed minimizes the
negative impact of the construction.
2c. Impact 16-2 was an allowable lot fill impact to Zone 2. While we are no
longer showing this impact, please understand that it can and likely will be made.
2d. We cannot consolidate Impacts 19-3 and 19-4 into one impact due to
intersection separation requirements. As discussed in the following paragraph
copied from our original justification letter we cannot eliminate either of the
crossings.
19-3 This is a very difficult area of the site to deal with. With the location
of the draws, the steepness of the topography, the alignment of the street
system, and the design criteria for the streets, we have very limited options in
this area. The alignment of the Northern Durham Parkway is set by
NCDOT, the Thoroughfare Plan for Durham, and the stringent vertical and
horizontal design standards mandated for this thoroughfare. The required
separation between intersections along the Northern Durham Parkway
further dictates the placement of the intersection with Golden Belt Parkway
just west of impact 19-4. Due to the controlled access and intersection
separation requirements associated with the design of this thoroughfare,
shifting this intersection to the north or south would conflict with the ability
to provide a second access to Northern Durham Parkway to the south, or the
access to the north which will serve Tract 10 and the proposed Durham
County school site located just north of Lick Creek. Given these constraints,
we have proposed to cross as close to perpendicular as possible.

19-4 This impact is greatly constrained by the conditions outlined in 19-3
above. Without this proposed crossing, the area of approximately 4 acres
located west of stream 19 and east of the Northern Durham Parkway could
not be accessed. Again we have tried to cross as close to perpendicular as
possible given the significant topographic and roadway design constraints.
Given the design speeds and traffic volumes anticipated upon completion of the
Northern Durham Parkway, the 300 feet of intersection separation from the
future north bound lanes currently reflected on the plan is the minimum
separation necessary to provide safe movements and adequate stacking along
Golden Belt Parkway between the Northern Durham Parkway and O'Brien
Court, Woodsdale Drive intersections.
However we have been able to revise our plans in order to eliminate Impacts 19-5
and 19-6.
2e. Impact 20-2 is necessary in order to meet the requirements for two access
points as discussed in section 2b above. While we could move this section of
roadway to the north, downsteam of this section of isolated buffer and wetlands,
we felt that due to the topography and proximity to Lick Creek, it would be less
of an overall impact to put the road in the location currently illustrated by Impact
20-2.
2f. Impact 3-1 is to be a road crossing over a natural bottom culvert span,
therefore no channel impact is listed. Due to the constraints of the design,
FEMA approval and construction of this culvert, it is necessary to route the
waterline in this street out of the street section and downstream of the culvert.
This will allow for the construction of the water line and provisions for adequate
fire protection services prior to the final approvals for the construction of the
culvert. We have added Impact 3-13 to the plans to account for. the construction
of this waterline.
2g. As we outlined in item 2d above, we have revised the plans to eliminate
`' Impact 19-6.
2h. Due to topography, the unusual shape of the boundary, the location of the
200 foot wide power line easement, and street access requirements, we`are unable
to eliminate Impact 37-1. However we have revised our plans to eliminate
Impact 37-2.

2j. As stated in the justification letter submitted with the original application we
have no ability to move this section of roadway. The following paragraph is
taken from the justification letter regarding this impact
A-1 In justification of the impacts that will be caused by the construction of
Adams Street across the Wellons property it should be noted that the location
of the intersection of US 70 and Adams Street was set in accordance with a
1946 record plat which dedicated the right of way for Adams Street. The
location is also determined by the need for the relocation of an existing
median break on US 70 which must align with the opposing right of way of
Adams .Street on the other side of US 70, which was also dedicated in the
1946 recording. The design represented in these plans pushes the minimum
horizontal alignment requirements for adequate sight distances, vehicle and.
pedestrian safety in order to minimize the extent of the impacts. These same
safety design criteria and the location of the existing Adams Street right of
way, preclude any alignment which would avoid impact to these streams.
The existing alignment of Sanders Avenue, located approximately 1100 feet
east of our proposed construction of Adams Street is not an appropriate
access to this proposed development of over 2000 homes. The right of way is
dedicated and an existing two lane road extends between existing homes and
businesses along Sanders Avenue. Widening this existing roadway to the
multilane section required of a development of this size would require the
acquisition of additional right of way, causing significant damage to the
existing properties. Our clients do not have the power of condemnation to
force the owners to dedicate the additional right of way, nor would the
property owners fronting Sanders Avenue be pleased with the prospect of
traffic from a 2200 home development being channeled across their front
yards.
In addition there is no currently dedicated right of way west of US 70 for Sanders
Boulevard such that a full intersection and continuation of Sanders to the west
may never occur. Copies of these 1946 record plats are enclosed for your use.
Unexplained items on Site Plan
1. This is an indication of an easement around a proposed stormwater device.
We have removed it from the wetlands area.

2. This is a sewer easement, which we must dedicate to allow a future sewer
connection from the adjoining property owner. Since there is no impact
proposed to be made as part of our construction, only an easement
dedication, we have not indicated this as an impact. In the future, if this
connection is ever made, the adjoining property owner will apply for the
impact.
3. This is also an indication of an easement around a portion of the proposed
storm drainage system. We have removed this from the buffer.
Other Issues Raised During the Meeting
Todd Tugwell requested additional information regarding the status of the
Northern Durham Parkway. The Northern Durham Parkway, formerly
known as Eno Drive, has been on the Transportation Improvement Program
for some time. The section through Brightleaf is a portion of the project
designated by Project ID R-2631. It is to connect to US 70 at Page Road near
the Wake County line, cross the Brighfleaf property, and continue across NC
98 to I-85. According to the information on the Durham-Chapel Hill-
Carrboro Metropolitan Planning Organization website, planning for this road
is currently in progress, design is to be initiated in 2004, right of way
acquisition is to begin in 2006, and construction is to begin in 2008. A copy
of this information is attached for reference.

Department of the Army (DA) nationwide permit authorization Ic>r the proposed construction of
a sewer main needed to serve l3rightlea~I'at the Park Subdivision and Village Creek Subdivision.
Reference is also made to the application received in our office on July 7, 2UU4, which requests
nationwide permit authorization I'or additional activities required for the developrncnt of
Bxightlcaf at the Park_ The two subdivisions are situated on adjoining parcels aI' land north of
Highway 70 and east of Sharon Road, adjacent to Lick Creek in the Neuse River Basin, in
Durham County, North Carolina. Your permit requests are to impact waters oi'the iJnited States
and their adjacent wetlands subject to our regulatory at;thorny pursuant to Section 404 of the
Clean Water Act.
Nationwide Permit General Condition 19 requires that pr~jccts mutit be designed and
constructed to avoid and minimize adverse effects to waters of the United States to the maximum
e:+ctent practicable at the project site (i.c., onsite). Your permit application tier the proposed sewer
main construction lists temporary impacts to 212 linear feet of stream channel and 1.111 acre of
wetland, and i.ncludcs numerous crossings of Water of the tJ,S, several of which show no eff'vrt
to avoid impacts. Based upon a review of the submitted plans, it appears that a.ltcrnativc sewer
ali.~;runents e:ci.st that would significantly reduce or avoid impacts to wetlands and stream
channels. Furthermore, once we concur with your j~LStification for avoidance and irinimi~ation

of your proposed impacts, mitigation wil..l be required for areas where certain functions and
values of the waters of the U S are permanently adversely affected, such as the conversion of a
bottomland hardwood forest to a herbaceous wetland within the permanently maintained utility
line right-of--way. Accordingly, the construction activities proposed in your permit application
do not meet the Nationwide Permit Ciencral Conditions, and will require individual 1713 permit
authorization (application enclosed),
In preparing your individual penn_it application, please note that the DA and the Ll_S.
Environmental Protection Agency (EPA) signed a memorandum of agreement (MOA) on
February 6, 1990, that established procedures to dcterrnine the type and level of mitigation
necessary to comply with the Clean Water Act Sectiott 404(b)(1) Ciuidclines. This MOA
provides for first, avoiding ixnpacts to waters and wetlands through the selection of the least
damaging, practical alternative; second, taking appropriate. and practical steps to minimize
impacts on waters and wetlands; and finally, compensating for any remaining unavoidable
impacts to the extent appropriate and practical. To enable us to process your application in full
compliance with this lVIOA, we request that you provide the following additional information:
a. Permits fir work withi» wetlands or other special aq~iatic sites are available otily if the
proposed work is the least environmentally damaging, practicable alternative. Please htmish
infot~nation regarding any other alternatives, including upland alternatives, to the work for which
you have applied and provide justification that your selected plan is the least damaging to water
or wetland areas. Specifically, we need inform.~,tion regarding ot~ site alternatives, as well as
alternative ozt-site designs that would result in reduced impacts to streams and wellands_
b_ It is necessary for you to have taken all appropriate and practical steps to minimise
wetland losses. Please indicate all that you have done, especially regarding development and
modification of plans and proposed construction techniques, to minimize adverse impacts_ Such
information would include an evaluation of roadway and sewer alignmentti that could reduce or
avoid impacts to streaans and or wetlands. For example, it appears that by designing more
perpendicular crossings ar by moving the sewer corridor slightly uphill you could minimize
impacts. These alternatives should be thoroughly discussed ui your application, and justification
should be provided as to why the proposed alternative was selected.
e. Finally, the MOA requires that appropriate and practical mitigation will be required
For all unavoidable adverse impacts remaining after all appropriate and practical txtiiumization
has been employed. Please indicate your plan to lr,itigate for the projected, unavoidable loss of
waters or wetlands (including temporary impacts resulting from sewer construction) or provide
information as tv the absence of any such appropriate and practical measures. Both applications
submitted for our rev.i.ew propose payment into the North Carolina Ecosystem Enhancemertt
Prolratn, but neither indicates the amount or type of rnitigatian proposed. Additionally,
preservation of the remaining 9.67 aereti of wetland located on the Brightleaf tract may be
utilized to ofFset unavoidable impacts to jurisdictional wetlands; however, preservation alone
will not adequately compensate for the currently proposed impacts to aquatic resources.

Your individual permit application must also include impacts associated with all
proposed activities related to the development. The second permit application, received on July
7, 2004, which requests authorization for remaining constntetion activities required for the
cv-lstruetion of Srightleaf at the Park Subdivision, lists additional impacts to 0.49 acre of
wetland and 1,175 linear feet of stream channel, including 51 feet identified as having important
aquatic fiznction_ These impacts must be included in your individual DA permit application-
Additionally, there are several high ground parcels located in the project area that do not have a
site plan. Please include information regarding the future use of these areas, even if the plans are
only preliminary, to allow us to assess the potential cttmuiative impact t1k~t would result from the
whole development. If deveivpm~ent is not planned in these areas, they should be treated as
upland alternatives to the proposed impacts.
Finally, based vn .information submitted with your applications, it appears that the two
developments may not be separate and complete with independent utility. When the; delineation
was initially z~evicwcd, the two parcels were treated as one property. Similarly, with your
application for Nationwide Permit >`2 authorization f~~r the sewer main construction, you imply
that development o~l'the two properties is i~,terconncctcd. If we determine that the two
developments comprise a single and complete project for the purposes of. DA permit
authorisation, all impacts required for the construction of both subdivisions should he included in
the revised permit application. To assist us in making this determination, please submit
additional information regarding the independent utility of each of the two developments (c.g.,
shared amenities, sewer main service area, constructivrt sequencing, property ownership, road
access, etc).
!f you choose to modify yvur plans and reduce the extent oi' impacts to aquatic resources
that will result from your proposed activities, you may resubmit an application for nationwide
permit authorization. Please note that much of the information discussed above will also be
required for our evaluation ofyour m,odificd nationwide permit application. This would include
izzti~rmation detailing all impacts required for the entire development, on-site avoidance and
minimization, and your plans to mitigate the impacts to aquatic resvurecs.

On July 7, 2004, the Division of Water Quality (DWQ) received your application dated July 7, 2004 to impact
0.49 acres of wetlands, 0.045 acres of isolated wetlands, 1,490 linear feet of streams and 222,405 square
feet (ftz) of riparian buffer to construct the proposed Brightleaf at the Park Subdivision. The DWQ has
determined that your application was incomplete and/or provided inaccurate Information as discussed below.
The DWQ will require additional information in order to process your application to impact protected
wetlands, streams and/or buffers on the subject property. Therefore, unless we receive the additional
information requested below, we will have to move toward denial of your application as required by 15A
NCAC 2M ,0506 and 2B .0233(8) and will place this project on hold as incomplete until we receive this

1. Please provide lot layout including footprints of homes, driveways, and other impervious
features in order to assess the percentage of impervious cover at the site. Despite being
below 30%, DWQ may require starmwater control, because of dense concentrations of
development and the potential reduction in filterting capacity of an already impervious
landscape (Triassic Basin} due to proposed stream and wetland impacts.
2. Please provide the following detail in order to better interpret and refer to features and
impacts in your site plan: street names, labels for stream and wetland features, and lot

3. Please provide 1"=50' drawings and details for all road crossings including rip rap
dissipater pads and culvert dimensions.
4. Please provide anti-seep collar design and confim~ation that these will be used in
all sewer line crossings through wetlands as per Condition 16 of WQC #3374.
5. Please indicate diffuse flow provisions into buffers at all road crossings.
6. Please clearly indicate remaining wetlands and streams on site that will not be impacted
and those to be preserved.
7. There are numerous parallel buffer impacts shown in Zone 1 related to a concurrent
application for a sewer line impacts (DWQ# 04-0954). Please clarify whether these
impacts are intended or are simply mistakes on your plan. Parallel impacts to Zone 1
will not be permitted.
8. There are several instances of stormwater devices in Zone 2 of the buffer (Impact 2-2,
8-3, 7-1, 7-2, 3-13, 2-2, 19-5). Please move these devices out of the buffer,

1, There are numerous instances where this office believes sewer lines could be reconfigured
or consolidated to minimize impacts to streams, wetlands, and buffers. They are as follows:
a. Impact 8-2. Reroute this sewer line to the west around isolated stream and wetlands.
b, Cmpacts 3-3, 7-3, and 3-4. Consolidate these crossings into one single crossing.
c. Impact 16-1. Move this sewer line to cross at Impact #16-3 (Wetlands Road Crossing).
d. Impact 3-6. Realign sewer line to future Northern Durham Pkwy.
e. Impact 3-7. Move sewer line to east to avoid wetland impact.
f. Impacts 3-9, 3-10, 3-11, and 3-12. These sewer lines can be consolidated into one
single crossing.
g. ~Irnpact 3-5, Move sewer line out of buffer.
h. Impacts 19-1 and 19-2. Move this sewer line to the west to avoid wetlands and buffers.
i. Impact to SE of Impact 3-10 (not accounted for in PCN). Move sewer line to the east to
avoid isolated stream.
j. Impact 38A-1. Move sewer line northwest out of wetlands.
k. Impact 12-1. Eliminate this sewer line or explain why it is necessary.
I. Impact 11-? (south of Impact 11.2). Move sewer line out of buffer.
2. Additionally there are several impacts associated with road crossings and lot fill that this
office believes to be unnecessary, Please eliminate or minimize these impacts or provide
a justification for them.

of the intermittent tributary to the west.

i. Parking area on southeastern edge of site boundary. Move parking lat out of Zane 2
of the buffer.
j, Impacts A-1 and B-1. Please realign Adams St, to avoid impacts to wetlands, streams,
and buffers.
Unexplained items on site plan:
1. Please explain the device that crosses the wetlands north of Impact 3-13.
2. Please explain the device in the stream northwest of Impact A-1 (visible on Sheets 4 and 8),
3. Please explain the device in the buffer north of Impact 19-3

office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this
project and we will consider the project as withdrawn.
