3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application:
The site is undeveloped bottom land abutting the French Broad River on the west and US HWY -64 to the south. Ground cover is a mix of wooded,
shrub and grass. Adjoining properties are wooded and undeveloped except for a fenced outparcel with a PSNC natural gas substation. This outparcel
is bordered on three sides by the subject parcel but is accessed directly from the US -64 right of way.

3d. Explain the purpose of the proposed project:
The purpose is to develop a public boating access to the French Broad River for angling and recreation. The finished site will include a single lane concrete
launch ramp with floating courtesy dock, a full length van accessible parking pad, gravel parking area for 7 -8 vehicles and a gravel access road connecting to
US -64 (Brevard Rd.).
3e. Describe the overall project in detail, including the type of equipment to be used:
Dozer and CAT -315 excavator will be used to clear and grub site. Fill will be placed and roller compacted to build the access road. Stone fill for ramp base will
be placed at base of river bank using excavator. Concrete for the launch ramp will be formed & poured in the dry above the water line. After curing, the slab will
be pushed into position using a dozer. Remaining concrete work will all be poured in the dry. Stone will be placed & compacted for stable parking base.

Impact S1 will involve excavation and fill for the proposed launch ramp and floating dock. Excavation will be required from the top of bank down to the
OWHM. Below the OHWM fill consisting of Class -1 and Class -B riprap will be placed to form a base for the concrete push slab at 14% slope down to
the existing river bed. Side slopes along the ramp will be cut at 2:1 and will be armored with riprap.

SUBJECT: Comments on preliminary design for Etowah Small Boat Access
French Broad River, Henderson County
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) have reviewed
preliminary design information for the Etowah Small Boat Access on the French Broad River.
visited the site on June 1, 2015. Our comments are provided in accordance with certain
provisions of the N.C. Environmental Policy Act (G. S. I I3A -1 through I I3A -10; 1 NCAC 25)
and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.).
The project will involve the construction of an access road, parking area, floating dock, and
reinforced concrete launch. The area cleared will consist of more than one acre, and stormwater
control measures will be designed for construction and post - construction phases of the project.
This project should not affect trout and the activities do not need to be avoided during the trout
spawning moratorium. Although there are no current records of listed or rare aquatic species in
the project vicinity, both Appalachian Elktoe (Alasmidonta raveneliana, US and NC
Endangered) and Creeper (Strophitus undulatus, NC Threatened) are present in the French Broad
River further upstream.
We offer the following recommendations to minimize impacts to aquatic and terrestrial wildlife
resources:
1. Be vigilant with sediment and erosion control during site staging, construction, and cleanup.

the end of each work day; at a minimum, disturbed areas should be stabilized within five
working days or seven calendar days, whichever is shorter.
2. In addition, we request the use of sediment and erosion control practices outlined in the
Design Standards in Sensitive Watersheds (15A NCAC 4B .0124).
3. We recommend planting native shrubs and trees at the site in order to establish a buffer as
wide as possible on the French Broad River and the unnamed tributary that runs along the
northern edge of the site, both where existing riparian vegetation is minimal or where
riparian vegetation will be cleared for the project. A wide forested buffer can ensure greater
bank stability, filter overland pollutants, and provide habitat for birds and other wildlife.
4. We recommend the installation of stormwater management measures such as rain gardens
and vegetated swales in order to treat stormwater from the parking lot and other impervious
areas within the project boundary.
5. Coordinate with Steve Fraley, NCWRC Western Aquatic Wildlife Diversity Coordinator, for
pre - construction mussel surveys at the site.

Dear Mr. Ferguson:
Subject: Proposed Etowah Boating Access on the French Broad River, in Etowah, Henderson
County, North Carolina
On May 22, 2013, we received a copy of the project plans and a letter from you requesting our
review and comments on the subject project. We have reviewed the information presented and
are providing the following information to you in accordance with the provisions of the Fish and
Wildlife Coordination Act, as amended (16 U.S.C. 661- 667e), and section 7 of the Endangered
Species Act of 1973, as amended (16 U.S.C. 1531 -1543) (Act).
According to the information presented, you are working with Henderson County to construct a
small boat access with a floating dock on the French Broad River. The project will also consist
of the construction of a parking area and access drive. The site is currently forested and tree
clearing will be necessary to build the parking lot and access drive. A grassed swale is shown on
the plans to help control storm water from the parking area.
Endangered Species. We believe there is suitable habitat within the project area for the northern
long -eared bat (Myotis septentrionalis) which is currently federally listed as a threatened species.
During the summer, northern long -eared bats typically roost singly or in colonies in a wide - variety of
forested habitats, underneath bark or in cavities /crevices of both live trees and snags. Northern long -
eared bats have also been documented roosting in man -made structures (i.e., buildings, barns, etc.)
during the summer. Northern long -eared bats predominately winter in hibemacula that include caves
and abandoned mine portals. It should be noted that the general habitat types described above may
not be all- inclusive, and additional habitat types may be identified as new information is obtained.
Because there is suitable summer roosting habitat on the site for northern long -eared bats, we
recommend that no tree clearing /cutting occur between May 15 and August 15 to minimize potential
impacts to this species. If you will be implementing the aforementioned tree cutting restrictions, our
concurrence with a "not likely to adversely affect" determination can be assumed from this letter and
further consultation on the northern long -eared bat is not necessary as long as circumstances remain
the same.
We are concerned that storm water runoff and the removal of riparian buffers at the proposed
site. Therefore, we recommend the following measures be implemented into the project plans in
order to avoid potential adverse effects to water quality:
Use low- impact - development techniques,) such as reduced road widths, grassed swales in
place of curb and gutter, rain gardens, and wetland retention areas, for retaining and
treating storm water runoff rather than the more traditional measures, such as large
retention ponds, etc. These designs often cost less to install and significantly reduce
environmental impacts from residential development. Design and construct storm water
outlets from the parking area to drain from the parking lot through a vegetated area prior
to reaching any natural stream or wetland area. Detention structures should be designed
to allow for the slow discharge of storm water, attenuating the potential adverse effects of
storm -water surges; thermal spikes; and sediment, nutrient, and chemical discharges.
Also, because the purpose of storm- water - control measures is to protect streams and
wetlands, no storm- water - control measures or best management practices should be
installed within any stream (perennial or intermittent) or wetland.
2. Consider the use of pervious materials (i.e., pervious concrete, interlocking /open paving
blocks, etc.) for the construction of the road and parking area. Pervious surfaces
minimize changes to the hydrology of the watershed and can be used to facilitate
groundwater recharge. Pervious materials are also less likely to absorb and store heat and
allow the cooler soil below to cool the pavement. Additionally, pervious concrete
requires less maintenance and is less susceptible to freeze /thaw cracking due to large
voids within the concrete.

Dear NC Wildlife Commission:
The Stormwater Phase 2 Post - Construction Run -off Division received a complete Water Supply
Watershed Management Permit Application for the subject project. Staff review of the plans and
specifications has determined that the project, as proposed, will comply with the Water Supply
Watershed Regulations set forth in Henderson County Code Chapter 42 Land Development Code
Article VIII Sub -part B as amended as well as Title 15A NCAC 2H.1000 and Session Law 2006-
246. We are forwarding Permit No. WS20150902, dated October 8, 2015, for the construction,
operation and maintenance of the subject project and the stormwater system. This permit shall be
effective from the date of issuance, and shall be subject to the conditions and limitations as
specified therein, and does not supersede any other agency permit that may be required.

supersede any other agency permit that may be required. Please pay special attention to the
conditions listed in this permit regarding the Operation and Maintenance of a a grassed Swale,
recordation of deed restrictions, procedures for changes of ownership, transferring the permit, and
renewing the permit. Failure to establish an adequate system for operation and maintenance of the
stormwater management system, to record deed restrictions, to follow the procedures for transfer of
the permit, or to renew the permit, will result in future compliance problems.
The permit issuance shall become null and void if the applicant fails to make substantial progress on
the site within one (1) year after the date of approval. The Water Quality Administrator may grant a
single, one year extension of this time limit, for good cause shown, upon receiving a written request
from the applicant before the expiration of the approved plan. In granting an extension, the Water
Quality Administrator may require compliance with standards adopted since the original application
was submitted unless there has been substantial reliance on the original permit and the change in

standards would infringe the applicant's vested rights.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing by filing a written petition with the Henderson County
Water Quality Board. The written petition must conform to Henderson County Code Chapter 42
Land Development Article XII Enforcement, violations and appeals Section §42 -379 must be filed
with the Henderson County Water Quality Board within thirty (30) days of receipt of this permit.

HENDERSON COUNTY WATER SUPPLY WATERSHED MANAGEMENT PERMIT
In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of a low impact development in compliance
with the provisions of Session Law 2006 -246 and 15A NCAC 2H .1000 (hereafter
referred to as the "stormwater rules "), the Henderson County Code Chapter 42 Land
Development Code Article VIII Sub -Part B as amended and the approved stormwater
management plans and specifications and other supporting data as attached and on file
with and approved by the County and considered a part of this permit.
The Permit shall be effective from the date of issuance until rescinded and shall be
subject to the following specific conditions and limitations:
I. DESIGN STANDARDS
1. Approved plans and specifications for projects covered by this permit are
incorporated by reference and are enforceable parts of the permit.
2. The only runoff conveyance systems allowed will be vegetated conveyances
such as swales with minimum side slopes of 3 :1 (H:V) as defined in the
stormwater rules and approved by the Stormwater Phase II Post Construction
Run -Off Division.
3. No piping is allowed except that minimum amount necessary to direct runoff
beneath an impervious surface such as a road or to provide access.
4. All roof drains must terminate at least 30 foot from the mean high water mark.
6. The built -upon areas associated with this project shall be located at least 30 feet
landward of all perennial and intermittent streams.
7. All swales shall that discharge into a wetland shall do so at a non - erosive velocity
for the 10 year storm.
II. SCHEDULE OF COMPLIANCE
1. The permittee is responsible for verifying that the proposed built -upon area does
not exceed the allowable built -upon area.

2. The Water Quality Administrator may notify the permittee when the permitted site
does not meet one or more of the minimum requirements of the permit. Within
the time frame specified in the notice, the permittee shall submit a written time
schedule to the Water Quality Administrator for modifying the site to meet
minimum requirements. The permittee shall provide copies of revised plans and
certification in writing to the Water Quality Administrator that the changes have
been made.
3. This project may not be sold or subdivided in whole or in part without first
receiving a permit modification.
4. The following deed restrictions must be recorded with the Office of the Register
of Deeds:
a. The following covenants are intended to ensure ongoing compliance with
Henderson County Water Supply Watershed Management Permit
Number WS20150902.
b. Henderson County is made a beneficiary of these covenants to the extent
necessary to maintain compliance with the Water Supply Watershed
Management Permit.
C. These covenants are to run with the land and be binding on all persons
and parties claiming under them.
d. The covenants pertaining to stormwater may not be altered or rescinded
without the express written consent of Henderson County.
e. Alteration of the drainage as shown on the approved plans may not take
place without the concurrence of Henderson County.
f. This project may not be sold or subdivided, in whole or in part, without first
receiving a permit modification from the Stormwater Phase II Post
Construction run -off Division.
h. Construction of additional impervious areas such that low- density
requirements are no longer met will require a permit modification prior to
construction. An engineered system will be required to collect and treat
the runoff from all built -upon area associated with the project, including
that area permitted under the low density option.
i. Filling in or piping of any vegetative conveyances (ditches, swales, etc.)
associated with this development, except for average driveway crossings,
is strictly prohibited by any persons.
j. The built -upon areas shall be located a minimum of 30 feet landward of all
perennial and intermittent surface waters.
5. A copy of the recorded restrictions must be received in this Office within 30 days
of the date of sale.
6. Filling in or piping of any vegetative conveyances (ditches, swales, etc.)
associated with the permitted development, except for average driveway
crossings, is strictly prohibited by any persons.
7. The permittee shall submit to the Water Quality Administrator and shall have
received approval for revised plans, specifications, and calculations prior to
construction, for any modification to the approved plans, including, but not limited
to, those listed below:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision, acquisition, or sale of the project area in whole or in
part. The project area is defined as all property owned by the permittee,

for which Sedimentation and Erosion Control Plan approval was sought.
Filling in, altering or piping any vegetative conveyance shown on the
approved plan.
8. During construction, erosion shall be kept to a minimum and any eroded areas of
the swales or other vegetated conveyances will be repaired immediately.
9. The permittee shall at all times provide the operation and maintenance
necessary to operate the permitted stormwater management systems at
optimum efficiency to include:
a. Inspections
b. Sediment removal.
c. Mowing, and re- vegetating of the side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.
10. Within 30 days of completion of the project, the permittee shall certify in writing
that the project has been constructed in accordance with the approved plans.
11. The permittee shall submit all information requested by the Water Quality
Administrator or his representative within the time frame specified in the written
information request.
III. GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and
approval by the Water Quality Administrator. The Water Quality Administrator
may require modification or revocation and re- issuance of the permit to change
the name and incorporate such other requirements as may be necessary. In the
event of a name or ownership change, a completed Name /Ownership Change
form, signed by both parties, must be submitted to Henderson County
accompanied by the supporting documentation as listed on page 2 of the form.
The approval of this request will be considered on its merits, and may or may not
be approved.
2. The permittee is responsible for compliance with all permit conditions until the
Water Quality Administrator approves a transfer of ownership. Neither the sale of
the project nor the transfer of common areas to a third party, such as a
homeowner's association, constitutes an approved transfer of the water supply
watershed permit.
3. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to an enforcement action in accordance with North
Carolina General Statutes 143- 215.6A to 143- 215.6C and Henderson County
Code Chapter 42 Land Development Code Article VIII Sub -Part B as amended.
4. The issuance of this permit does not prohibit the Water Quality Administrator
from reopening and modifying the permit, revoking and reissuing the permit, or
terminating the permit as allowed by the laws, rules, and regulations contained in
Henderson County Code Chapter 42 Land Development Code Article VIII Sub -
Part B as amended, Session Law 2006 -246, Title 15A NCAC 2H.1000, and
NCGS 143 -215.1 et.al.
5. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by Henderson County, such as the
construction of additional or replacement stormwater management systems.

6. The permittee grants permission to Henderson County Staff to enter the property
during normal business hours, for the purpose of inspecting all components of
the stormwater management facility.
7. The permit issued shall continue in force and effect until revoked or terminated.
The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and re- issuance, or
termination does not stay any permit condition.
8. Unless specified elsewhere, permanent seeding requirements for the swales
must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
9. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
10. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state and federal), which have jurisdiction.
11. The permittee shall notify the Stormwater Phase I I Post Construction Run -Off
Division in writing of any name, ownership or mailing address changes at least
30 days prior to making such changes.
