Hi Kristina,
I thought I'd quickly follow-up with you on something. Dickie Harmon just called me just to check in on
everything and I shared with him what you're doing right now in terms of trying to get some guidance from
your central office. Dickie let me know that if you find out that the original authorization can be used
(because nothing has or will change to the application), you can simply email him directly and then he
should be able to take care of things relatively quickly on the USACE end of things. I let Dickie know that
you probably wouldn't be following back with me until later this week anyhow.
I hope you don't mind but I went ahead an added Dickie to this email so that everyone is in the loop and
my communication with the two of you is consistent.
I appreciate you both and the attention you're giving me.

Hi Jeff,
Thank you for sharing all of this information. This does help to clarify the situation. I will contact our central office
and see if we need anything else. I believe since version 1 was issued and you will be adhering to the approved

impacts we may be good to move forward, but let me verify. I will also make a note in our records to remove
version 2 so we know version 1 is the correct permit.
I should have an answer by the end of this week and then we can loop the USACE in.

Kristina,
I got some more details from the previous GC and it all makes sense now. He said Colleen was struggling
with a revision I had requested to do more bulkhead and docks but we decided not to go down that road.
Collen last told him on phone the resubmittal (i.e., second submission) was going to be deleted or made
inactive.
Therefore, the original authorization is what we're going off of and as a reiteration, none of those plans
have or will change. Basically, the second submission should be disregarded.

This is what was originally sent to me by Colleen Cohn (original email way below):
This project currently has a buffer authorization for temporary impacts to 650 square feet of Zone 1 for
Construction Access. It also a 401 Water Quality Certification for 300 square feet of dock, 670 square
feet of rip rap below normal pool, and 670 square feet of rip rap above normal pool. These were issued
March 10, 2021. The 401 Water Quality Certification is associated with the use of Regional Permit
197800080, which is issued by the U.S. Army Corps of Engineers and would have been a separate email.
A second buffer authorization for 1,070 square feet of permanent impacts to Zone 1 was submitted on
July 8th, 2021. Please provide more detail to explain the necessity of the additional buffer impacts
requested.
Nothing has or will change related to the buffer authorization for temporary impacts to 650 square feet of
Zone 1 for Construction Access and the 401 Water Quality Certification for 300 square feet of dock, 670
square feet of rip rap below normal pool, and 670 square feet of rip rap above normal pool. This remains
the same and no additional requests are being made. It was (and still is) my understanding that the only
thing I needed to do was get authorization for the construction access, the dock, and rip rap. I am not
aware of why the second buffer authorization was done and believe that it's not necessary (i.e., can be
dropped). As long as the authorization I receive allows for construction access, rip rap, and dock, I think
that's all I need.
For what it's worth, when Colleen noted that USACE would send a separate email, I did not receive one.
When I spoke with Dickie Harmon last week, he said that once DEQ is in a good place with this, he could
probably help get it through on the USACE side of things. But I definitely don't want to misrepresent him
so I/we would need to follow back up with me.

Per our conversation on Friday regarding the Milroy Waterfront project, I am including some additional information
below:
1. This project currently has a buffer authorization for temporary impacts to 650 square feet of Zone 1 for
Construction Access. It also a 401 Water Quality Certification for 300 square feet of dock, 670 square feet of rip
rap below normal pool, and 670 square feet of rip rap above normal pool. These were issued March 10, 2021.
The 401 Water Quality Certification is associated with the use of Regional Permit 197800080, which is issued by
the U.S. Army Corps of Engineers and would have been a separate email. A second buffer authorization for 1,070

is not needed, please formally withdraw the application by emailing me at colleen.cohn@ncdenr.gov and
request that the July 8th application be withdrawn. Please include the project name and reference
DWR#20201944.
2. For a bulkhead, a new application must be submitted. This includes requesting a pre-filing meeting again and
paying the application fee again. Please mention the revision/version number in the project title, and you should
be able to reference DWR#20201944 in the Project Information and Prior Project History section . The
application should include the impacts listed on the prior 401 and buffer authorizations, including the dock, as
well as the new requested bulkhead. Please include updated square footage for each impact as well as updated
drawings.
