Tlie existing 20.5' L x 18' W timber bridge needs to be replaced due to deterioration and insufficient width. Tlie proposed replacement stil�cture will be a 40' L s 24' W x 21" D cored slab bridge ou esisting location. Two 36" x 35' CMPs will be placed in Moses Creek downstream of the existing bridge to provide a temporary detour in order to inaiutain h�aftic on this dead-end road during construction. Enclosed are a PCN application, preliminairy jurisdictional form, SHPO forms, plau sheets showing the proposed �vork, a USGS quad map, photograpl�s, and odier supporting project inform�tion. Threatened s�nd Endangered Species The North Carolina Natural Heritage Program database was checked for records oY ttu�eatened and endangered species. There are 63 species with federal status that are known in Jackson County fi•om cun�ent or historical records. Of these, eiglit species, Carolina northern flying squin�el (Glaacomys snbrnras colorrrtiis), Indiana bat (Myo(is sodnlis), Appalachian elktoe (A(nsnridonla r�rvenelrrmn), spil�ce-fir moss spider (i�ficrol�extu•n �nontirngn), small whorled pogonia (Isofrin nre�leoloides), swamp pink (Helonrns badlnia), rock gnome lichen (Gynmo�fe�•r�ia linem•e), and nortliern long-eared bat (Myotis septe»Iriona(is, NLEB), are listed as eitlier threatened oi endangered. Jackson Couuty is uocv considered occupied suuuuer �nd �vinter l�abitat for NLEB and Indiana bats. The only records in Jackson County 1re fi•om the Tuckasegee River. Tl�e bridge is over 10 miles upstream of the design�ted critical habitat for Appalacliian elktoe mussels in the river. NLEBs and Indiana bats winter in caves or mines witli staUle, but not freezing cold, temperatures. This project only involves a small bridge replaceuient, so construction work will not extend far fiom tl�e existing roadway into areas where caves could occur. There are no caves or mines visible in tlie forest that surrounds dle bridge; however, accordiug to USGS data, there is or was an underground cave about 0.1 mile fi•om the bridge. Despite this prosimit��, the construction work should not disturb the present or hisroric mine location because there will be no blastiug ui�dertaken. In sununer, NLEBs and Iudiana bats may roost iu structures, but they generally prefer to roost under the loose bark of trees, either dead with peeling bark or cavities, or live trees with shaggy bark sucli as white oak, maples, sycamore and hickories. There are several large yellow poplar and other trees near tlie bridge tliat must be cleared for the temporaiy detour and the new bridge. Any tree removal will be completed fiom OctoUer 15 to April I S(winter clearing) to avoid tlie seasons �vlien either species of bat may be roosting in hees. Also, we conducted a survey of tlie bridge on September 18, 2015 and did not observe roosting bats or any evidence of bat usage (i.e. staining or guano). Tl�is bridge is only a 3-4 feet above the water surface and veiy cool underneath. Small whorled pagonia generally occurs in open, diy, deciduous woods �vith acid soil, thougl� habitats can include slopes along streams and mesic forest with white pine and rhododendron. Habitat near the bridge is likely too shaded by trees and rhododendron cover to support small whorled pagoni�. The Carolina northern flying squirrel, rock gnome lichen, and spruce-fir moss spider are found in spruce-Yir forests and other isolated higli elevation loc�tions in western North Carolina. I-Iowever, rock gnome lichen is an occasional exception because it cau be found at lo�ver elevations in deep river gorges witli liigh humidity or on some vertical rock faces tliat are periodically wet. The bridge site has au elevation of only 2,600 feet and lacks rock faces and other liabitat couditions required by these species. Wedattd habitat for swamp pink is lacking at the site. The project is liinited in scope to a bridge replacement on the esistiug road�vay aligiunent. Erosion and sedimentation control rneasures will be implemented to minimize adverse effects of the work on aquatic liabitats. Habitats for listed species appear lackiug at the project site and none of tfiese species were observed during field visits. For these reasous and those discussed above, �ve reco�mnend that a detemiination of "no effect" on listed species apply to tliis project, escept for NLEB and Indiana bat. This project was reviewed by NCDOT's Hum�n Enviromnent Unit in 2012 for potential effects on historic architecture and archeology. Suiveys were not required and it �vas determiued tliat tliere would be "no effect" on historic structures and archeological resources (see attached forins). Bridge No. 135 — Jlckson County Page 3 October 14, 2015 NCDOT best management practices will be used to minimize and control sedimentation aud erosion on this project. The consttliction foreman will review all erosion control measures daily to eusure sedimentation and erosion controls are being effectively controlled. Ifthe devices are not fimctioning as intended, they will be replaced immediately with better devices. Impacts to Waters of the United States Moses Creek (DWQ Class: WS-III Tr) is sl�own on the USGS topographic map as a perennial streaui. Tlie chamiel is approximately 15 feet in width and well defined with a substrate of boulders, cobble, gravel, and sand/silt. Tlie stream has sufficient flow to support fisli, iucludiug trout, and other aquatic life. Moses Creek flows to Caney Fork Creek, �vhich tl�eu flows to the Tuckasegee River. The Tuckasegee River meets tl�e definitiou of a Traditional Navigable Water (T`NW). For these reasais, we believe Moses Creek is a Relatively Permanent Water (RPW) and is uiider tlte jurisdiction of the U.S. Army Corps of Engineers. In order to construct the project, it will be necessa�y to impact �vaters of tlie Uuited States in tite Little Temiessee Rivei• B�sin (CU 06010203). A temporary detour will be constructed downslream of the existing bridge using 2@ 36" x 35' CMP's in Moses Creek in order to mainlain traffc on lhis dead-end road during conslruclion. Once the old bridge is removed and the new bridge completed, the detour will be removed and stream banks restored and stabilized. Moses Creek is a fairly steep gradient, high qualiry lrout stream, so a bridge is the preferable structure for this stream crossing. The bridge is designed to meet lhe hydraulic needs and roadway constraints of lhe site. The bridge will not impair aquatic life passage. 1 b. All instream work will be performed in a dry work area using an impervious dike and Flow diversion lo divert the water around the project site. In any circumstance where a permit applicant obtains an individual permit, or a Nationwide General Permit (NWP) or other general permit verification requiring "pre-construction notification" (PCN), or requests verification for a non-reporting NWP or other general permit, and the permit applicant has not requested an approved JD for the activity, the permit applicant is hereby made aware of the following: (1) the permit applicant has elected to seek a permit authorization based on a preliminary JD, which does not make an official determination of jurisdictional waters; (2) that the applicant has the option to request an approved JD before accepting the terms and conditions of the permit authorization, and that basing a permit authorization on an approved JD could possibly result in less compensatory mitigation being required or different special conditions; (3) that the appiicant has the right to request an individual permit rather than accepting the terms and conditions of the NWP or other general permit authorization; (4) that the applicant can accept a permit authorization and thereby agree to comply with all the terms and conditions of that permit, including whatever mitigation requirements the Corps has determined to be necessary; (5) that undertaking any activity in reliance upon the subject permit authorization without requesting an approved JD constitutes the applicanYs acceptance of the use of the preliminary JD, but that either form of JD will be processed as soon as is practicable; (6) accepting a permit authorization (e.g., signing a proffered individual permit) or undertaking any activity in reliance on any form of Corps permit authorization based on a preliminary JD constitutes agreement that all wetlands and other water bodies on the site affected in any way by that activity are jurisdictional waters of the United States, and precludes any challenge to such jurisdiction in any administrative or judicial compliance or enforcement action, or in any administrative appeal or in any Federal court; and (7) whether the applicant elects to use either an approved JD or a preliminary JD, that JD will be processed as soon as is practicable. Further, an approved JD, a proffered individual permit (and all terms and conditions contained therein), or individual permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331, and that in any administrative appeal, jurisdictional issues can be raised (see 33 C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary to make an official determination whether CWA jurisdiction exists over a site, or to provide an official delineation ofjurisdictional waters on the site, the Corps will provide an approved JD to accomplish that result, as soon as is practicable. This particular soil type is composed of coUbly and stony colluvium derived from i�ieous and metamorphic rock, an tmsorted mixture of weatliered rock in a matris of some kind of sediment. Colluvial deposits generally consist of hvo units: an upslope unit consisting of sm�ll boulders in a matrix of sediment eroded from upland areas, and a downslope unit containing large masses of bedrock slumped off the valley walls in a matrix of fine-grained sediment. Despite the presence of a�� historic fai�mstead (31JK410/410"�) located upsh�eam and outside of tl�e projecPs APE (determined to be not eligible for the National Register of Historic Places [NRHP]), the topography, soil conditions, and meandering stream channel at this pa�4iculac location would not be conducive for any form of occupation; therfore, the project corridor is unlikely to contain significant archaeological resources.
