Replace Bridge No. 135 on SR 1740 (Moses Creek Road) over Moses Creek
Jackson Count
State Project No. 17BP14.R.62
Dear Ms. Beckwitli:
Tlie North Carolina Department of Transportation (NCDOT) is proposing to replace tlie subject
bridge. Tlie existing 20.5' L x 18' W timber bridge needs to be replaced due to deterioration and
insufficient width. Tlie proposed replacement stilcture will be a 40' L s 24' W x 21" D cored
slab bridge ou esisting location. Two 36" x 35' CMPs will be placed in Moses Creek
downstream of the existing bridge to provide a temporary detour in order to inaiutain haftic on
this dead-end road during construction.
Enclosed are a PCN application, preliminairy jurisdictional form, SHPO forms, plau sheets
showing the proposed vork, a USGS quad map, photograpls, and odier supporting project
informtion.
Threatened snd Endangered Species
The North Carolina Natural Heritage Program database was checked for records oY ttueatened
and endangered species. There are 63 species with federal status that are known in Jackson
County fi•om cunent or historical records. Of these, eiglit species, Carolina northern flying
squinel (Glaacomys snbrnras colorrrtiis), Indiana bat (Myo(is sodnlis), Appalachian elktoe
(A(nsnridonla rrvenelrrmn), spilce-fir moss spider (ificrolextu•n nontirngn), small whorled
pogonia (Isofrin nreleoloides), swamp pink (Helonrns badlnia), rock gnome lichen (Gynmofe•ria
linem•e), and nortliern long-eared bat (Myotis septe»Iriona(is, NLEB), are listed as eitlier
threatened oi endangered. Jackson Couuty is uocv considered occupied suuuuer nd vinter
labitat for NLEB and Indiana bats.
Appaladiia elktoe are fowid in some well-osygenated streams with moderate to fast flowiug
vater and stable, mixed substrates of silt, sand, gravel, and/or cobble. Streams that support this

mussel are typically mucl larger and warmer than Moses Creek. The only records in Jackson
County 1re fi•om the Tuckasegee River. Tle bridge is over 10 miles upstream of the designted
critical habitat for Appalacliian elktoe mussels in the river.
NLEBs and Indiana bats winter in caves or mines witli staUle, but not freezing cold,
temperatures. This project only involves a small bridge replaceuient, so construction work will
not extend far fiom tle existing roadway into areas where caves could occur. There are no caves
or mines visible in tlie forest that surrounds dle bridge; however, accordiug to USGS data, there
is or was an underground cave about 0.1 mile fi•om the bridge. Despite this prosimit, the
construction work should not disturb the present or hisroric mine location because there will be
no blastiug uidertaken.
In sununer, NLEBs and Iudiana bats may roost iu structures, but they generally prefer to roost
under the loose bark of trees, either dead with peeling bark or cavities, or live trees with shaggy
bark sucli as white oak, maples, sycamore and hickories. There are several large yellow poplar
and other trees near tlie bridge tliat must be cleared for the temporaiy detour and the new bridge.
Any tree removal will be completed fiom OctoUer 15 to April I S(winter clearing) to avoid tlie
seasons vlien either species of bat may be roosting in hees. Also, we conducted a survey of tlie
bridge on September 18, 2015 and did not observe roosting bats or any evidence of bat usage (i.e.
staining or guano). Tlis bridge is only a 3-4 feet above the water surface and veiy cool
underneath. Witli winter tree clearing, ve reconunend a"may affect, not likely to advei•sel,y
affecP' detennination for NLEB and Indiana bat.
Small whorled pagonia generally occurs in open, diy, deciduous woods vith acid soil, thougl
habitats can include slopes along streams and mesic forest with white pine and rhododendron.
Habitat near the bridge is likely too shaded by trees and rhododendron cover to support small
whorled pagoni.
The Carolina northern flying squirrel, rock gnome lichen, and spruce-fir moss spider are found in
spruce-Yir forests and other isolated higli elevation loctions in western North Carolina.
I-Iowever, rock gnome lichen is an occasional exception because it cau be found at lover
elevations in deep river gorges witli liigh humidity or on some vertical rock faces tliat are
periodically wet. The bridge site has au elevation of only 2,600 feet and lacks rock faces and
other liabitat couditions required by these species.
Wedattd habitat for swamp pink is lacking at the site.
The project is liinited in scope to a bridge replacement on the esistiug roadvay aligiunent.
Erosion and sedimentation control rneasures will be implemented to minimize adverse effects of
the work on aquatic liabitats. Habitats for listed species appear lackiug at the project site and
none of tfiese species were observed during field visits. For these reasous and those discussed
above, ve recomnend that a detemiination of "no effect" on listed species apply to tliis project,
escept for NLEB and Indiana bat.
This project was reviewed by NCDOT's Humn Enviromnent Unit in 2012 for potential effects
on historic architecture and archeology. Suiveys were not required and it vas determiued tliat
tliere would be "no effect" on historic structures and archeological resources (see attached
forins).
Bridge No. 135 — Jlckson County Page 3 October 14, 2015
NCDOT best management practices will be used to minimize and control sedimentation aud
erosion on this project. The consttliction foreman will review all erosion control measures daily
to eusure sedimentation and erosion controls are being effectively controlled. Ifthe devices are
not fimctioning as intended, they will be replaced immediately with better devices.
Impacts to Waters of the United States
Moses Creek (DWQ Class: WS-III Tr) is slown on the USGS topographic map as a perennial
streaui. Tlie chamiel is approximately 15 feet in width and well defined with a substrate of
boulders, cobble, gravel, and sand/silt. Tlie stream has sufficient flow to support fisli, iucludiug
trout, and other aquatic life. Moses Creek flows to Caney Fork Creek, vhich tleu flows to the
Tuckasegee River. The Tuckasegee River meets tle definitiou of a Traditional Navigable Water
(T`NW). For these reasais, we believe Moses Creek is a Relatively Permanent Water (RPW) and
is uiider tlte jurisdiction of the U.S. Army Corps of Engineers. In order to construct the project, it
will be necessay to impact vaters of tlie Uuited States in tite Little Temiessee Rivei• Bsin (CU
06010203). Specitically, NCDOT is requesting to replace Bridge No. 135 with a cored slab
bridge on esisting locatio. Listed Uelo is a suuuuary of the proposed impacts.

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that
the appiicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicanYs acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation ofjurisdictional waters on the site, the Corps will
provide an approved JD to accomplish that result, as soon as is practicable.
This preliminary JD finds that there "may be" waters of the United States on the
subject project site, and identifies all aquatic features on the site that could be
affected by the proposed activity, based on the following information:
IMPORTANT NOTE: The information recorded on this form has not
necessarilv been verified bv the Corps and should not be relied upon for
later iurisdictional determinations.

A map review and site file search was conducted at the Office of State Archaeology (OSA) on Monday,
August 20, 2012. A comprehensive archaeological suivey at this particular brictge location has never
been conducted; lowever, one (1) archaeological site has been recorded within one-half (1/2) mile of the
proposed project. Digitl copies of IIPO's maps (Tuckasegee Quadrangle) as well as the HPOWEB GiS
Service (http://gis.ncdcr.gov/hpoweb were last reviewed on Friday, August 31, 2012. There are no
known historic architectural resources located vithin the project arca that may have intct
archaeological deposits wittin the footprint of the proposed project. In addition, topographic maps,
listoric maps (NCMaps website), USDA soil swvey maps, and aerial phorographs vere utilized and
inspected lo gauge environmental factois that may have contributed to liistoric or prehistoric settlement
within the project liuilts, nnd to assess the level of modern, slope, agriculhnal, hydrological, and other
erosive-type disturUances witliin and surrounding tle archaeological APE.

This is a State-funded projech, however, various Federal permits vill be requirecl, and additional ROW
may be required. In addition, both sides of SR 1740 (Moses Creek Road) covsists of US Porest Service
Property, being a part of the Nantahala National Forest. The entire APE coiisists of Cullasaja-
Tuckasegee comples soils, I 5-30% slopes, stony (CuD), which re typically %und on fans,
drainageways, and mountain coves. This particular soil type is composed of coUbly and stony colluvium
derived from iieous and metamorphic rock, an tmsorted mixture of weatliered rock in a matris of some
kind of sediment. Colluvial deposits generally consist of hvo units: an upslope unit consisting of smll
boulders in a matrix of sediment eroded from upland areas, and a downslope unit containing large
masses of bedrock slumped off the valley walls in a matrix of fine-grained sediment. Despite the
presence of a historic faimstead (31JK410/410") located upsheam and outside of tle projecPs APE
(determined to be not eligible for the National Register of Historic Places [NRHP]), the topography, soil
conditions, and meandering stream channel at this pa4iculac location would not be conducive for any
form of occupation; therfore, the project corridor is unlikely to contain significant archaeological
resources. Based on the information above, tliere shoidd be no archaeological survey required for this
project. If desigi plans change, or are made available, prior to construction, then additional consultation
