A final copy of the permit is attached to this letter for your records. This permit is issued pursuant to the requirements of the North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated December 6, 1983. The following list has been included to outline the changes that were addressed in the draft permit. These changes remain unchanged in the final permit: The permit expiration date has been changed. The permit renewal will expire on September 30, 2003. The expiration date has been revised so that an equal number of permit renewals will come in at any one time. This change will allow the Division to issue permits more efficiently. ➢ A summer ammonia limit of 22.6 mg/1 was included for Outfall 001. This limit was included based on the mass balance calculation results. ➢ Quarterly monitoring for Total Nitrogen and Total Phosphorus has been included in the draft permit. Tlie Division has included these monitoring requirements for all dischargers in the Yadkin Basin. The results of this additional monitoring will be used in the development of a nutrient management strategy for the Yadkin Basin. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of P.O. In addition, this permit does not affect the legal requirement to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other Federal or Local governmental permit that may be required. Summary Facility has applied for a permit renewal with no modifications. The history of this facility is somewhat confusing. The most recent WLA was prepared in 1990. Evidently the school used to discharge into a dry ditch 1200 feet upstream of a lake. In 1980 the school board agreed to pipe the effluent below the lake in order to receive secondary limits. At the time the WLA was prepared, it was recommended that the facility must prepare an engineering proposal to evaluate discharge options (No record of this report in the file). If no feasible alternatives were identified, the limits were to change to 5 and 2. The model was run at the location below the lake because the 7Q 10 is positive at this location (7Q 10 = 0.05 cis), but secondary limits were still given to the facility. The school has moved the discharge point below the lake into a positive flow location as referenced in the ATC dated August 4, 1994. The region confirmed that the discharge point has been moved. Mass balance calculations using the positive flow stream conditions below the lake indicate that ammonia limits are necessary. Ammonia limits were included as part of the permit renewal. Region, please comment on how these limits should be phased in. Secondary limits were give�e facility with the understanding that the discharge point would be moved (out of a zero flow location). The facility was required to perform an EAA within 12 months. If no alternatives were determined to be available, the facility would get 5 & 2 limits. The facility has moved the discharge location to a point further down on the UT to Mulberry Creek. Originally, several sites were proposed. Flow data was requested at these locations. The attached flow data request was prepared for a location on the UT to Mulberry Creek (very close to the actual discharge location). This flow data was used in estimating the need for ammonia limits. • Staff Report (prepared in 1993): Region recommended that the permit be issue . Facility is rated as Class I. • DMR Review: Facility appears to be operating within the constraints of the exisiting permit with the exception of the following violations: BOD violation January 1997 Flow violation October 1996 Flow violation August 1996 It appears that the facility should be able to comply with the summer ammonia limit of 22.6 mg/l The facility has performed instream monitoring as specified in the NPDES permit. The DO range is well above the standard of 6.0 mg/1 both upstream and downstream of the discharge point. In addition, temperature and fecal monitoring appear to be normal. No special basinwide management strategies apply Facility has applied for a permit renewal with no modifications. Facility appears to be operating within the constraints of the existing permit (effluent TRC levels appear to be high). It is recommended that the permit be renewed as drafted.
