Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). This final permit includes no major changes from the draft permit sent to you on October 24, 2007. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or pennits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. The daily effluent dissolved oxygen concentration shall not be less than 5.0 mg/l. . Effluent Temperature. The effluent temperature shall not increase receiving water temperature by more than 0.8 degrees C (June -August) nor more than 2.2 degrees C (September -May). In addition, effluent temperature shall not cause receiving water temperature to exceed 32 degrees C. Best Management Practice (BMP) Requirements for Seafood Processing. • There shall be no discharge of fish parts, floating solids, or visible foam in other than trace amounts. • The permittee shall direct employees and provide resources to follow, at a minimum, the following practices such that wastewater volume and wastewater constituents are reduced: a) All hoses used to provide on demand water delivery shall be equipped with automatic shut-off nozzles. b) Personnel shall be instructed to eliminate flows through idle equipment. c) All process and washdown equipment shall be fitted with high pressure/low volume nozzles. d) Dry cleanup shall be preformed prior to washdown of the facility Biocide Condition. There shall be no chromium, zinc or copper added to the treatment system except as pre -approved additives to biocidal compounds. The Permittee shall obtain approval from the Division of Water Quality's Aquatic Toxicology Unit (ATU) prior to the addition of any biocidal compound to the water discharged from Outfall 003. Approval for use of new compounds (not previously approved) must be submitted to the ATU at least 90 days in advance of any planned use of those compounds. Permit No. NCO048151 A. (3). IWC (0r6): PROJECT NOTES Summary • This is a permit renewal for a Minor Industrial operation (fish processing and packing) located in Dare County. This is a fish packing facility with a small processing room to fillet fish. Per the renewal application, there have been no changes since the last permit was issued. The discharge is small and intermittent due to production. • The facility discharges through three outfalls to Mill Landing Creek located adjacent to Roanoke Sound in the Pasquatank River Basin (subbasin 030151). The receiving stream is not listed as impaired on the 303(d) list, and there are no special basinwide permitting strategies presented in the Pasquatank River Basin Plan. The receiving waters are used as a harbor for commercial fishing vessels. Permit Development • The facility's renewal application was received July 2, 2007. • Outfall 002 (ice machine melt water)- Maintain same permit requirements. • Outfall 003 (fish processing). Maintain same permit requirements. Limit and monitor in accordance with Effluent Guidelines (40 CFR 408.212- for TSS, Oil and Grease, pl-I) as well as NC NPDES Seafood Processing and Packing Policy Memo (dated 1/5/93). Effluent Guidelines are based on production. According to the permit renewal application, 2,000 lbs/day is the average amount processed. Effluent Guideline limits for TSS and O&G are based on 2,000 lbs/day to develop Monthly Average Limits, and 4,000 lbs/day to develop Daily Max Limits. Fish processing is subject to monthly monitoring. • Outfall 004 (fish packing/rinsing)- Maintain same permit requirements. Limits and monitoring are based on General Permit conditions for fish packing/rinsing, as well as NC NPDES Seafood Processing and Packing Policy Memo (dated 1/5/93). The provisions of this subpart are ap- plicable to discharges resulting from the processing of bottom fish outside of Alaska in which the unit operations are carried out predominately through manual methods. However, the use of scaling machines and/or skinning ma- chines are considered to be normal practice within this subcategory. The 40 CFR Ch. 1 (7-1-06 Edition) provisions of this subpart apply to the processing of currently, commercially processed species of bottom fish such as flounder, ocean perch, haddock, cod, sea catfish, sole, halibut, and rockfish. These provisions apply to existing fa- cilities processing more than 1816 kg (4000 lbs) of raw material per day on any day during a calendar year and all new sources. § 408.211 Specialized definitions.
