Division staff have reviewed and approved your renewal application for an NPDES discharge
permit. Accordingly, the Division is forwarding the subject NPDES permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency dated May 9, 1994 (or as subsequently amended).
The following items from the DRAFT permit have been retained in this FINAL permit:
Outfall 002 (Ice machine melt water).
• Sample frequency is specified as "Annual."
Outfall 003 (Fish processing).
• The permit includes a separate effluent sheet for Outfall 003, since fish processing is
regulated according to EPA Federal Effluent Guidelines.
• Permit limits for TSS and Oil&Grease were updated based on average fish processing
rates of 2,000 pounds/day, and maximum processing rates of 4,000 pounds/day.
• The monitoring frequency for Outfall 003 parameters has been increased to Monthly,
which is consistent with other fish processing permits.
• The flow limit has been deleted, while monitoring has been retained.
• The monitoring requirement for BOD and settleable solids has been deleted.
• A limit and monitoring requirement for dissolved oxygen has been added, which is
consistent with other fish processing permits.
• Addition of a Temperature Condition (no monitoring), BMP Condition, and Biocide
Condition. These requirements are consistent with other fish processing permits.
Outfall 004 (Fish packing/rinsing)
• The permit includes a separate effluent sheet for Outfall 004. An annual monitoring
requirement has been added, which is similar to General Permits issued for fish rinsing
and packing operations.
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within
thirty (30) days following receipt of this letter. This request must be in the form of a written
petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-
6714. Unless such a demand is inade, this permit shall be final and binding.

Effluent Temperature. The effluent temperature shall not increase receiving water temperature by more than 0.8
degrees C (June -August) nor more than 2.2 degrees C (September -May). In addition, effluent temperature shall not
cause receiving water temperature to exceed 32 degrees C.
Best Management Practice (BMP) Requirements for Seafood Processing.
• There shall be no discharge of fish parts, floating solids, or visible foam in other than trace amounts.
• The permittee shall direct employees and provide resources to follow, at a minimum, the following practices
such that wastewater volume and wastewater constituents are reduced:
a) All hoses used to provide on demand water delivery shall be equipped with automatic shut-off
nozzles.
b) Personnel shall be instructed to eliminate flows through idle equipment.
c) All process and washdown equipment shall be fitted with high pressure/low volume nozzles.
d) Dry cleanup shall be preformed prior to washdown of the facility
Biocide Condition. There shall be no chromium, zinc or copper added to the treatment system except as
pre -approved additives to biocidal compounds. The Permittee shall obtain approval from the Division of Water
Quality's Aquatic Toxicology Unit (ATU) prior to the addition of any biocidal compound to the water discharged from
Outfall 003. Approval for use of new compounds (not previously approved) must be submitted to the ATU at least
90 days in advance of any planned use of those compounds.

Summary
• This is a permit renewal for a Minor Industrial operation (fish processing and packing)
located in Dare County. This is a fish packing facility with a small processing room to fillet
fish. Per the renewal application, there have been no changes since the last permit was
issued. The discharge is small and intermittent due to production.

According to Steve George with Etheridge Seafood, 50,000 lbs/month (2,000 lbs/day) is
average production, while 100,000 lbs/month (4,000 #/day) can be realized during good
months. Effluent Guideline limits for TSS and O&G are based on 2,000 lbs/day to develop
Monthly Average Limits, and 4,000 lbs/day to develop Daily Max Limits. Fish processing is
subject to monthly monitoring.
• Outfall 004 (fish packing/rinsing)- Previously this outfall was combined with 003, but it has
been separated in this draft renewal. Limits and monitoring are based on General Permit
conditions for fish packing/rinsing, as well as NC NPDES Seafood Processing and Packing
Policy Memo (dated 1 /5/93). Fish packing/rinsing is subject to annual monitoring.
DMR Data.
• Effluent Chemical/Physical Data. These are small discharges. In 2003, flow was estimated
at 90 gpd for Outfall 002, and 30,000 gpd for Outfalls 003+004 combined.
• Effluent Toxicity Data. Not applicable.

• The WaRO prepared a staff report dated 7/ 16/2002 and recommends permit renewal.

§408.210 Applicability; description of
the non -Alaskan Conventional bot-
tom fish processing subcategory.
The provisions of this subpart are ap-
plicable to discharges resulting from
the processing of bottom fish outside of
Alaska in which the unit operations
are carried out predominately through
manual methods. However, the use of
scaling machines and/or skinning ma-
chines are considered to be normal
practice within this subcategory. The
provisions of this subpart apply to the
processing of currently, commercially
processed species of bottom fish such
as flounder, ocean perch, haddock, cod,
sea catfish, sole, halibut, and rockfish.
These provisions apply to existing fa-
cilities processing more than 1816 kg
(4000 lbs) of raw material per day on
any day during a calendar year and all
new sources.
§ 408.211 Specialized definitions.
For the purpose of this subpart:
(a) Except as provided below, the gen-
eral definitions, abbreviations and
methods of analysis set forth in part
401 of this chapter shall apply to this
subpart.
(b) The term seafood shall mean the
raw material, including freshwater and
saltwater fish and shellfish, to be proc-
essed, in the form in which It is re-
ceived at the processing plant.

(a) In establishing the limitations set
forth in this section. EPA took into ac-
count all information it was able to
collect, develop and solicit with re-
spect to factors (such as age and size of
plant, raw materials, manufacturing
processes, products produced, treat-
ment technology available, energy re-
quirements and costs) which can affect
the industry subcategorization and ef-
fluent levels established. It is, however,
possible that data which would affect
these limitations have not been avail-
able and, as a result, these limitations
should be adjusted for certain plants in
this industry. An individual discharger

or other interested person may submit
evidence to the Regional Adminis-
trator (or to the State, if the State has
the authority to issue NPDES permits)
that factors relating to the equipment
or facilities involved, the process ap-
plied, or other such factors related to
such discharger are fundamentally dif-
ferent from the factors considered in
the establishment of the guidelines. On
the basis of such evidence or other
available information, the Regional
Administrator (or the State) will make
a written finding that such factors are
or are not fundamentally different for
that facility compared to those speci-
fied in the Development Document. If
such fundamentally different factors
are found to exist, the Regional Admin-
istrator or the State shall establish for
the discharger effluent limitations in
the NPDES permit either more or less
stringent than the limitations estab-
lished herein, to the extent dictated by
such fundamentally different factors.
Such limitations must be approved by
the Administrator of the Environ-
mental Protection Agency. The Admin-
istrator may approve or disapprove
such limitations, specify other limita-
tions, or initiate proceedings to revise
these regulations.
(b) The following limitations estab-
lish the quantity or quality of pollut-
ants or pollutant properties, controlled
by this section, which may be dis-
charged by a point source subject to
the provisions of this subpart after ap-
plication of the beat practicable con-

A NPDES WASTEWATER PERMIT
On the basis of thorough staff review and
application of NC. General Statute 143.21.
Public law 92-500 and other lawful stan-
dards and regulations, the North Carolina
Environmental Management Commission
proposes to issue a National Pollutant Dis-
charge Elimination System (NPDES) waste-
water discharge permit to the person(s)
listed below effective 45 days from the pub-
lish date of this notice.
Written comments regarding the proposed
permit will be accepted until 30 days after
the publish date of this notice. All comments
received prior to that date are considered in
the final determinations regarding the pro-
posed permit. The Director of the NC Divi-
sion of Water Quality may decide to hold a
public meeting for the proposed permit
should the Division receive a significant
degree of public interest.
Copies of the draft permit and other sup-
porting information on file used to determine
conditions present in the draft permit are
available upon request and payment of the
