Dear Ms. Beckwith:
The North Carolina Department of Trausportation (NCDOT) is proposing to replace die subject
bridge. The existing 18.5 L x 20' W timber bridge needs to be replaced due to deterioration and
insufficient �vidth. Tlte netv bridge will be a 40' L s 27' W s 18" D cored slab structure on
esisting location. An onsite temporaiy detour �vill be used and constructed using a 72" Y 60'
CMP in Soutl� Fork Beech Creek do�vnstream of the esisting bridge.
Please find enclosed a PCN applicatiou, Jurisdictional DetermivationFonn, SHPO Forms, plan
sheets showing the proposed work, viciiuty map, USGS topographic m1p, photographs, and
other supporting project iufonnation.
The North C�rolina Natural Heritage Database lists 42 species for Graham County that have
federal status aud that are kno�vu fiom curreut or l�istorical records. The Uog turtle (Glyp(enrys
miJ�lenbergii) is listed as threatened due to similarity to the listed northern bog tui�tle. Seven
species, Appalachian elktoe (dlnsnrrdontn rrrne�ielinnn), Carolina iiortheru flying squirre]
(G(nttconrys saGri�7us colora/i�s), rock giome lichen (G�nri�aotferntn /i�teare), Indiana bat (�Lf��otis
so�lydis), nortliern long-eared bat (il�Iyolis sepieirh•ionali.$), Virginia spiraea (Spirnen vrrgrnrnna),
aud spotfin cliub (Ei•rmonn.r monnchirs) are listed as either tlu•eatened or endangered and liave
current records. Beginning in 2009, spotfin chub were released into the Cheoah River
dowustream of Lake S�nteedah, therefore the lower river is now considered occupied habitat.
Additionally, the bald eagle (Hnlrneel��s (eucoce�halus) is luio��m from Graham County and has
s}�ecial protection imder tlie Golden and Bald Eagle Protection Act.
The only record of a listed species witliin 5 miles of the bridge is for an Appalachian elktoe
mussel fowid iu Talhilah Creek. This record is old (Pre-1981). Since that discovery, uo

Appalachian elktoe have been found elsewhere in the Cheoali River watershed upstream of
Santeetlah Lake. Similarly, spotfin chuU have not been documented in the upper watershed.
South Fork Beech Creek at the bridge is too small, steep, aucVor cold for App�l�chi�n elktoe and
it is isolated from the laio�vn elktoe and spotfin chub popiilations in tlie Lower Cheoah River
belo�v Lake Santeetlali dam.
The landscape around tlie bridge is rural with scattered single family residences. There is a
narrow �vooded riparian strip downstreain of the bridge with a wider �vooded area upstream. The
innnediate bridge area is disturbed by the bridge and road, a maintained yard, and a pasture. The
project will require removal of mature trees for tlie installation of the temporary onsite detow•
pipe dowustream of tlie bridge.
Virginia spiraea is usually fouud in scoured, open-canopy areas sucli as gravel bars and rocky
banks along high gradieut, large rivers, though it lias been found along mediuiu-sized streams.
This p1a��t occurs along tlie Cheoah River downstream of Lake Santeetlah, but it has not been
found upstream of the l�ke. Scow•ed river banks or gravel bars are lacking at the bridge site.
Virginia spiraea �vas not observed in tlie project are� during tlie bridge scoping �neeting or
subsequent site visits.
Carolin� northern flying squin�el aud rock guome lichen are usually found at the higliest
elevations, though die latter can occur at lower elevations on cliffs that occasionally receive
seepage fiom overlying-soil aud on damp rock faces in river gorges where diere is high
humidity. Tl�e elevation at tlie project site is too low (�2,330 feet) Yor these species.
Additionally, rock faces are absent and this stream is not situated in a gorge.
Indiana bats and northern long-eared bats (NLEB) wiuter in caves or mines with stable, but not
freezing, cold teuiperatures. According to USGS data, die nearest k�iown uudeiground niiue is
over 5 miles fiom the bridge and there are no mines or caves visible uear the bridge. In swivuer,
tl�ese bats generally roost in die loose bark of trees, either dead �vitl� peeling bark or cavities, or
live trees witli shaggy bark such as white oak, maples, sycamore and hickories. Therefore, as
prescribed in Graham Couuty by the USPWS, any tree removal at the bridge will occur from
October 15 to April 15 (winter clearing) to prevent iucidental impacts to roosting Indiana bats.
This moratoriwn period also encomp�sses the period when NLEB may be roosting in trees as
well. The existing bridge is a low timber structure and therefore probably roo cool for bats. We
did not obseive any evidence of bat usage (i.e. stainiug or guano) duriug site visits. With winter
tree clearing, we recommend a"ma}� nffect, i�ot likely to adversely affecP' determination for
NLEB and Indiana bat.
The project is limited in scope to a bridge replacement on the e�isting aligmnent. Erosion and
sedimeutatiou control me�sures w�ill be implemented to minimize adverse effects of tlie �vork on
aquatic habitats. Habitats for listed species are lackiug at tlie project site and noue of tl�ese
species were observed during tield visits. For these reasons and those discussed above, we
reconunend tl�at a determination of "no effect" on listed species apply to this project, e�cept for
NLEB and Indiana bat.

Tliis project w�as revie�ved by NCDO"C's Huuian Enviromnent Unit in 2014. It was determined
that no suivey was required for historic architecture. A survey for archeological resow•ces was
conducted and it was deterviined that the project �vould have "no effecP' (see att�ched SHPO
forms).
NCDOT best management practices will be used to minimize �nd control sedimentation and
erosion on this project. Tlie construction foremau �vill review all erosiou control uieasures daily
to ensure sedimentation and erosion controls are being controlled effectively. If the devices are
not fimctioning as intended, tliey will be replaced iuunediately with better devices.
Impacts to Waters of the United States
Soutli Fork Beech Creek (DWQ Class: WS-III) is shown on the USGS topograpl�ic map as a
perennial stream. Tlie channel is well defined with a subsh�ate of primaeily cobble and gravel
witl� some exposed bedrock. South Fork Beech Creek at the bridge flows 0.25 miles to Beedi
Creek which than flows 0.6 miles to Sweehvater Creek. S�veetwater Creek firotu the Beech
Creek junction flo�vs 4.2 miles inro ro tl�e Cheoah River about 1 S uiiles upstream of Lake
Sauteetlah. Lake Santeetlah meets the detlnition of a Traditional Navigable Water (TNW). Por
these reasons, we believe South Fork Beech Creek is Relatively Pei'manent Water (RPW) and is
under the jurisdiction of the U.S. Anuy Corps of Eugineers. In order to caistruct tlie project, it
will be necessary to impact waters of d�e United States in the Little Teiuiessee River Basin (HUC
06010204). Specifically, NCDOT is requesting to replace Bridge No. 49 with another bridge on
esisting location. Listed below is a suuvnary of the proposed impacts.

The land use is primarily single family residential and agricultural. The landscape in the area is felds and yards with
some forest along the valley margins. The immediate vicinily of the project is pasture with a few trees along lhe slream.

To replace a structurally deficient and funcfionally obsolete 18.5' L x 20' W single span limber bridge with a new 45' L•
27' W x 18" D cored slab bridge on the existing location.

Erosion and sedimentation devices will be installed. Traffic will be detoured on-site downstream of lhe bridge using a
temporary culvert and roadway. The new bridge abutments will be constructed behind the old abutments. The old
abutments and road fill will be removed behind temporarily dewatered stream sections. Rip rap bank stabilization will be
added along lhe new vertical abutments and the bridge deck completed. Once completed, lhe detour will be removed
and stream banks restored. Heavy equipment, paving equipment, water pumps, sandbags, diversion pipe and various
hand tools will be used to accomplish the work.

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activiiy, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicanYs acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity

such jurisdiction in any administrative orjudicial compliance or enforcement

the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will
provide an approved JD to accomplish that result, as soon as is practicable.

The proposed Bridge No. 49 project is situTted east ofRobbinsville aud south�vest of Stecoali in the
enstern lialf af Grnlinm Couuty, Nortl� Cnrolinn. The project nrea is plotted in the nortl�west swtion of tlie
Robbinsville USGS 7.S topographic quadr�ngle (Figure 1).
A ivap revie�a end site file swrch wes conducted at the Office of State Archaeology (OSA) on Mm'cli 7,
2014. No previously recorded arclineological sites hnve been identiCed �vithin the APE, but six Imown
sites (31GH78, 31GH79, 31GH598, 31GH599, 31GH612, Tnd 31GH618) are reported withiu a mile of
the project Accocdiiig to the North Carolina State Historic Preservation Of�ce online dnta base
(HPOWG�B 2014), there Rre no laio�vn hisroric architectural resources wit�iu t�e APE IhTt may yield
intact nrclineologicel deposi�s. Topogrnphic mTps, OSDA soil swvey maps, aerial plioto�apl�s (NC One
Map), and historic mnps (1�a�th Carolina maps �vebsite) were examined for iuformatiou on emironmeutal
�nd cultural variables lhat mny l�ave contributed to prehistoric or l�istoric settlemeut witl�in the project
limits aud to assess the level of gromid disturbance. An archTeological reconnaissauce a��d field survey
was can�ied out on March 18, 2014, to furtl�er assist in evaluating the project area.
Bridge No. 49 nnd Beech Creel< Rond cross tlie South Fork of Beecli Creek roughly nortl�west to
soulhe�st. Tl�e creekjoius with Beecl� Creel< approsimately 350 m(c�. 1,148 ft) to tlie northwest. The
stream then dcaius iiito S�veehvater Creek furtlrer to tlie nortli�vest. These weterways are part of the Little
Teiwessee drainage basin. Most of the project area is silualed on suenui terraces with hillside slope to tlie
south (Figure 2). Tl�e area cousists of eesidential properties to tl�e west of the rold �nd at the southern end
(Pigures 3 nud 4). A pashu�e is prese��t to the east (Fi�ire 5), while the Soutli Forlc of Beech Creek runs
adjacent to tl�e road in the ��orthenst and southmest quadrnvt (Figure 6). Tlie bn�ilcs of the creel< to tlie
noctl�e�st have beeu built up �vitL tossed field stones fi�om the pasture. Gronnd disturbniice is uvnimal in
the pasture �vitl� more severe disturbauce along the private drives and home sites to the west aud soutli.
According to the USDA soil suivey map, Iwo soil types compose the APE (see Figures 2). Most o£ the
project nre� co�isists of tl�e Delhvood-Reddies complex (DeB). This iucludes the pasture aud property
adjacent to the creek. Delhvood-Reddies complex are made up of modernlely well drained sands or
loan�s found on tl�e stream terrace�s. It is subjcct to occasional Ilooding a��d lms a slope of 0 to 5 perceut.
This series Las the potential of yieldii�g significant �cchaeological site nssociated with enrly settlement
�ctivities due to tlie pi�esents of well dr�incd laudforms wilh slope of less than 15 perceut. Tl�e secoud
soil type is the Udorthents-Urbnn land complex (UoA). Tl�is is present aloug most of the residential
properties to the west. The Udorlhents-Urban Iand complex cousists of Loamy soils iu �reas of cut �ud fill
found ou slre2m terraces anct tloodpl�ins. They r�rely flood aud have a slope of less tl��u 5 percent. It is
m�lilcely for intact arcl�aeological deposits to be ideulified on this series dne ro previous grouud
disturbance. Altliough it is displayed outside of tl�e APE, the neighUoring Soco-StecoaU complex (ScF)
malces up the soil series for the hillside to the south. This is �vell deained IoTUry soils witl� a slope of 50 to
95 percenL Due to steep slope, it is unsuited of early settlement activities avd is uot generally subject to
subsurfncc Icstivg.
A review of the site files slio�v that two iutensive archaeologicll investigTtions hlve been cariied out iu
the nrea. These investigntions �vere for the relocatio�� of US 19/74 Sectio��s B nud C(TIP A-9). Survey
�vorlc for these investig�tions was conducted iu tl�e viciniry of S�veehvater Ceeek, nocQiwest of the curreut
project. A totaLofsix sites (31GH78, 31GH79, 31GH598, 31GH599, 31GH612, and 31GHG18) �vere
identified within a mile of the bridge during the course of tl�e hvo projecls. Sites 31 GH7S aud 31 GH79
were recorded during the first A- 9 iuvestigations in 1980 by Soil System, lua Site 31 GH78 appcars lo
Ue n]�rge multicomponent prehisloric site consisting of overl�ppiug occupatio��s. It is sitt�nted on tlie
Sweet�vater Creelc floodplain nnd stream terraces, south of tl�e stream. It has been recommeuded eligible
for the Nation�l Register of Historic Pl�ces (NRHP). Site 31GH79 is adjacent to 31GH78, but just uortl�
of S�veehv�ter Creek. It too is loc�ted on a strenm terrnce nnd consists of prehistoric lithic materinl from

an uiuden[iCied period. Its eligibility for the NRHP is unassessed. The remni�ing fouc sites (31GH598,
31GII599, 31GH612 and 31GHG18) were recordect Uy TRC in 2010 and 2011. Tl�ese sites are situated
south of S�veet�vater Creek ou eit�er the floodplain or stream terraces. Sites 31 GH612 and 31 GH618 �re
isolated finds cousisting of prehistoric nnd historic nrtifacts. Being isol�ted artifact occurceuces, they �re
not eligible for tl�e NRHP. Site 31GH598 is an enrly to mid-20t1� ceutury household tl�at provides no
significant or ne�v d1ta. It is recoimnended as ineligible for the NRHP. Lastly, site 31GH599 is a
prehistoric and l�istoric site t�at yielded intact pre�istoric deposits. T�e prehistoric component is
Woodland, most likely from the Connestee phase. Since intact deposits nre presevt, this site l�ns been
recouunended �s eligible for the NRHP. The residts of these investigatious su�gest tl�at �vell dcained
floodplains and stream teeraces in regiou l�ave tlic poteutial to yield sigiiificTnt nrchTeological
informntiou. Also, more work is needed on t�e minor tributaries to better understa��d enrly settlemenl
patterns as most of the previous investigations liave been confiued to the major draiiinges.
A historic m�p review �vas also conducted prior to the reco�maissance nnd field swvey. The first accurnte
and recognizable map in �vhich the vicinity is depicted is the 1838 U.S. Arnry composite map, couiplied
fiom the 1837 �rnry field swvey ofpart of the Cherol<ee Territory prior to tlie removal of the Cl�erokee
population (Figure 7). Tl�e project m�ea is part of tlie Cheoah conmmnity, tivhich �v�s Iocated alaig the
Cl�eoal� River at Robbinsville and up Loug, S�veet�v�ter, and Talula Creeks. Tl�e 1838 .4rmy map
illustcates Sweehvater Creel<and a road alongside the water�vay, but faits to sho�v Beecl� Creek or its
tributnries. The map also depicts no structures iu the vicinity. Altl�ongh no documented Cheralcee �
household nre sho�vii, it does not rule out the possibility of one beingpreseut. If is believe tl�Tt 1838 m�p
shows only 50 percent of tlie houseliolds in the regiou at this time. SuUsequent 1911� ceutury mnps
provide no additional informTtion. IL is not until �he e�rly 20t1i century t�at maps are piiblisl�ed tliat
depicts tlie project area with �ny clarily. The 1906 USGS Nanta�al� topograpliic mTp provide a reliable
Iocnlion for ihc project area aud shows n rond �vith an alignment similnr ro Beecli Creek Road. It 11so
depicts � crossiu� over the South Fork of Beech Creek near the cun�ent bridge (Figure S). Unfortunately,
tliis map illastr�tes no structures. The Temiessec Valley Antl�ority's (TVA) 1935 mnp of Iudustries and
Agriculture in GrTham Cow�ty does sho�v structures iucludiug two nortliwest of tl�e bridge (Figure 9).
Although the su�uctures ou tliis map �re nearby, they nppear to be well outsidc of the project limits. It
would seem from this revie�v tliat uo deposits associated witli siguificaut historie strncture should be
eucouutered, bnt nndocumented 19t1� century Cherokce lionseholds are Imown to be in 8ie region and
could fall within the APE.
The archaeologicTl field investigations at Bridge No. 49 cousist of only one shovel test placement (STPs)
aud surface inspection. Thc STP was excavated wit�ii� tl�e pashu�e along the strenm terrace in the
souttieast quadrnnt (see Figures 2 and 5). '1'lie soil stratigrnphy consists of hvo layers. Tl�e uyper is a derlc
yello�vish brown (lOYR 4/4) rocicy silry clny loam thnt is approximately 30 em (ca. 12 iu) ttiick. lt is
followed by second layer (subsoil) of darl<yellowish brown (IOYR 3/4) silty clay that exteuds at least
45 cm (ca. 1 S in) below the surf�ce. No cultur�l mnterial �vas recovered fi�om this tesk Altl�ough the
nortliwest quadrant is level, uo STPs were pl�ced on ihc la�vn of the re�sidential property due to past
grouud disturbance (see Figures 2 and 3). Tl�is landform l�as beeu subject to cut and filled in order to
level the property for structures. Like�vise, slope iu excess of IS percent nnd ciit U�iil<s into the hillside
for a liouse to Il�e soutl� �vere not tested (see Pigure 4). No additionTl subsurface tesling was needed iu tlie
northeast or south�vest qu�drauts as �vell due to ll�e pcesence of siream (see P ig�ue 6). Lastly, a surface
inspection was carried out iu the pasture �vhere ��ound visibility was at orjnst nnder 50 percent. Again,
no �rtifacts �vere identiCed.
Tl�e arcl�aeological investigations for tlie proposed replacemeut of Bridge No. 49 in Grnham County
