Title 15A of the North Carolina Administrative Code, Subchapter 2B, Section .0506 enumerates specific
reporting requirements applicable to holders of NPDES permits issued by the State of North Carolina.
15A NCAC 2B .0506 (a)(1)(E) states that permittees must continue to submit monthly discharge
monitoring reports (DMRs) to the Division of Water Quality, even when there is no discharge from the
facility during the reporting period. This requirement may be waived by the Director of the Division of
Water Quality during extended periods of no discharge.
I have reviewed your May 18, 2009 letter requesting to the subject facility be placed on an inactive
status. You point out the facility's effluent has been pumped to the Long Creek WWTP for treatment
since March 2006 and since that time there has been no discharge to surface waters. This method of
operation is expected to continue into the future. However, while operating in this manner, the City is
maintaining the plant facilities such that they remain operable in the event that it must return to making a
direct discharge.
After reviewing your request and considering the recommendation of the staff of the Mooresville
Regional Office, I have agreed to waive the requirement to submit monthly DMRs for the subject
facility, effective with the May 2009 DMR. Additionally, I hereby waive the requirement for operator
visitation at this facility. Please keep the Surface Water Protection Section of the Mooresville Regional
Office apprised of any pertinent developments that arise regarding the future use of this facility. Please
be aware that if the facility exhibits a potential for discharge of treated wastewater, then visitation,
monitoring and reporting must resume as required by the terms of the permit and North Carolina's
environmental laws.
Please also be advised that while requirements for operator visitation, monitoring and reporting are
being waived during the period of no discharge, you are still required to pay the Annual Administering
and Compliance Monitoring Fee that is associated with this and all NPDES permits.

Dear Mr. Sledge,
According to our records, our last discharge under the above referenced permit was for the month of
February 2006. After- discussion with Wes Bell of the Mooresville office, we would like to request that
NPDES Permit# NCO040070 be placed in an inactive status until further notice.
Our Sludge Dewatering Facility was granted an SIU permit by the City of Gastonia Wastewater
Treatment Division (Permit# 1064) and we have been discharging our effluent to the Long Creek
Wastewater Treatment Plant since March 2006. We have continued weekly site visits and to publish
our DMR during this time. Ms. Sonja Basinger had advised that this inactive status was a possibility
during an earlier inspection of our facility, but we were concerned over the process for being
returned to active status should circumstances require, resulting in us not making a request at that
time. Mr. Bell has advised that we can return to active status at any time with notice to our
Mooresville office of our intentions. We will also continue to maintain the plant in accordance with
State of North Carolina standards during our period of inactive status.
