Dear Ms. Beckwith:
The North Carolina Department of Transportation (NCDOT) is proposing to replace the subject
bridge. The esisting 19' L X 21' W timber bridge needs to be replaced due to deterioratiou and
insutflcient widtli. The proposed replaceuient structure will be a 1� 69' L X 12' W x 4' H
reintorced concrete box culvert (RCBC) on a 141° skew and 2.7% slope. Traftic will be
maintained ou tl�e road usiug staged construction. Tlie culvert will be buried one and one-half
feet below tlie stream bed and there �vill be five 8' W X 1.5' H notched concrete sills/baffles
equally spaced iu tlte ciilvert The baYfles will create rougfiness and flow disruption, help
maintain cl�aiuiel stability and retain bedload, and facilitate aquatic organism passage.

acceptance letter, SHPO fomis, plan sheets showing the proposed work, a marked vicinity map, a
USGS topograpl�ical map and photographs.
Ttireatened :�nd Endangered Species
Tlie North Carolina Natural Heritage Database lists 42 species for Graham County tl�at liave
federll status aud tl�at are kno�vn ti•om current or I�istorical records. The bog turtle (Glyplenrys
nri�Mlerabergii) is listed as threatened dae to similarity to the listed northern bog hlrtle. Seven
species, Appalacliian elktoe (Alasmido�rtn rrrnenelinnc�), Carolina northeru flying squirrel
(Glniiconrys sabi•intts colornh�s), roek gnome lichen (Gymiaodei•m�� li�tenre), Iudiana bat (�l�Iyatis
sodnlis), northern long-eared bat (ddyotis sepie�th•ionalis), Virginia spiraea (S�irnea rirginrman),
and spotfin chub (Erimonns nronacluis) are listed as either tfueatened or endangered and liave
current records. Begi�uiing in 2009, spotfin chub were released into the Cheoali River
downstreaui of Lake STnteetlali, therefore the lower river is now considered occupied habitat.

Additionally, the bald eagle (HaHaeeh�s leucocet�haltis) is known from Graham Cotuity and has
special protection under the Bald and Golden Eagle Protection Act.
The only records of listed species witliin 5 nliles of the bridge are Indiana bats aud an
Appalachian elktoe mussel found in Tallulah Creek. This mussel record is old (Pre-1981). Since
that discovery, Appalachian elktoe have not been found else�vhere in the Cheo�h River
waterslied upstre�m of Santeetlah Lake. Similarly, spottui chub have not been docuuiented in
the upper watershed. Mou��tain Creek at the bridge is too small, steep, and cold for Appalachian
elktoe and it is isolated from the luiown elktoe and spotfin chub populations in tlie Lower
Cheoah River by Lake Santeetlali Daui.
Virgina spiraea is usually found in scoured, open-canopy areas such as gravel bars and rocky
baiilcs along high gcadient large rivers, sucli as the Cheoah River, thoug� it has been documented
along medium-sized streams as welL Ho�vever, scow•ed river bauks or gravel bars are lacking at
the bridge and Virginia spiraea was uot seen during nmltiple site visits.
Carolina noi�tliern flyi��g squirrel and rock gnome lichen are usually found at high elevations,
though the latter can occur at lower elevations on cliffs that occasionally receive seepage and on
damp rock faces in river gorges �vhere there is liigh humidity. Tlie elevatiou is too low (�2,240
feet) for tliese species. Additionally, there are no rock faces near the bridge and this stream is
not sihiated in a gorge where rock gnome lichen is sometimes found.
Lidia��a bats and northern long-e�red bats (NLEB) winter in caves or mines with stable, but uot
fi•eezing, cold temperatures. Accordiug to USGS data, Clie uearest known undetground mine is
over 5 miles fi�om the bridge and d�ere are no mines or caves visiUle near tlie bridge. In summer,
these bats generally roost in the loose bark of trees, eitlier dead �vith peeling b�rk or cavities, or
live trees with shaggy bark such as wliite oak, maples, sycamore and hickories. Therefore, as
prescribed in Gr�ham Couuty Uy the USFWS, any tree removll at tlie bridge will occur ti•au
October 15 to April l5 (winter clearing) to prevent incidental impacts to roostiug Indiana bats.
This moratorium period also encompasses the period �vhen NLEB could be roosting in trees
nearby, thougli tl�ere are uo luio�vn roosts, or liibernacula, for NLEB near the bridge. The
esisting bridge is � lo��� timber stnicture aud therefore probably too cool for bat roosting; we did
not see any evidence of bat tiisage (i.e. staining or guano) during site visits. NCDOT
recommends a"may affect, not likely to adversely affect" determination for lndiaua bat and
NLEB.
The project is limited to the replacement of au existing bridge with a reinforced concrete box
culvert. Erosion and sedimentation coutrol measures will be implemented to protect aquatic
habitats. Adverse effects of the work on aquatic habitat shoald be minor and temporary aud only
occur a short distance downstreaui. The culvei�t will have baffles to reduce the potential for
do�vnstrevn scour and chamiel i��stability and to promote aqu�tic life passage. For the reasons
described above, we recommend a"no effecY' determination for threatened aud endangered
species for this project, escept for the Indiaua bat and NLEB.

This project was reviewed by NCDOT's Human Environment Unit in 2013-2014. It was
determined that no surveys would be required for historic architecture or archeological resources
with a determination of "uo effecY' (see attached forms).
NCDOT best mauagement practices will be used to minimize and control sedimentation and
erosion on this project The consh•action fa•eman will revie�v all eiosion control measures daily
to ensure sedimentation �nd erosion controls are Ueing controlled effectively. If tlie devices are
not fimctioning as intended, they will be replaced immediately with better devices.
Impacts to Waters of tlie United States
Mountain Creek (DWR Class: C Tr) is sho�vn on the USGS topographic map as a perennial
stream. The channel is well deiined with a substrate of boulders, cobble, gravel, and saud/silt.
Mountain Creek at the bridge flows about 3.5 miles downstreatu to the Cheoali River upstream
of Clieoah Lake. The Cheoah River meets the detiuitiou of a Ti-�ditional Navigable Water
(TNW). For these reasons, we believe Mountaiu Creek is Relatively Permanent Water (RPW)
and is under thejurisdiction of the U.S. Anny Corps of Ettgineecs. In ocder to consh•act die
project, it will be necessa�y to impact waters of tlie United States u� the Little Tennessee River
(HUC 06010204). Specifically, NCDOT is requesting to replace Bridge No. 107 witli an RCBC.

roadway, landscaped yard, woods slopes, and driveway.

To replace a structurally deficient and functionally obsolete 19' L x 21' W single span timber bridge with a new 1@ 69' L
x 12' W x 4' H RCBC on the exisling location with sills and baffles.

Erosion and sedimentation devices will be installed. The culvert will be slage constructed. Traffic will be routed on the
west half of the bridge while the east half is removed for stage I of the culvert work. Traffic will then be diveAed to lhe
stage I culvert once completed and the west half of the bridge removed and stage II of the culvert completed. Heavy
equipment, water pumps, sandbags, diversion pipe and various hand tools will be used to accomplish the work.

The bridge is being replaced with an RCBC on the same disturbed location as the existing bridge. Sills/baffles will be used in
lhe culvert to help retain bedload, create bed roughness and reduce stream velocities, and ullimately facililate fish passage.

Erosion and sedimentation control measures will be installed prior to ground dislurbance. The slream will be diverted away
from lhe old bridge abutments as needed during removal, culvert installation, and rip rap bench/stabilization placement to
prevent sedimenlation of downstream aqualic habitats.

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected parly
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicanYs acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activiiy
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will
provide an approved JD to accomplish that result, as soon as is practicable.
This preliminary JD finds that there "may be" waters of the United States on the
subject project site, and identifies all aquatic features on the site that could be
affected by the proposed activity, based on the following information:

Bridge No. 107 is locared north of Robbi��sville and east of Snnteetlnh Lake nev the center of Graham
Counry, North Carolina. The project area is ploltcd in the nortl�east corner of the Robbinsville USGS 7.5'
topographic quadrangle (Figure l).
A map review a��d site file search �vas conducted at tl�e Office of State Archaeology (OSA) on Februaty
20, 2013. No previously recorded archaeological sites havc beeu identified wilhin the APE or n mile
r�dius of bridge. Accordiug to the North Carolina State Historic Preseivation Office online data basc
(HPO WGB 2014), there are no knowu l�istoric architectural resources witl�in the APG �tiat may yield
intact archaeologicnl deposits. Topographic maps, USDA soil survcy maps, �erial photographs (NC One
Mnp), and historic maps (North Carolina maps website) �vere examined for inforu�ation on enviromnental
aud cultural variables that may have contributed to prel�istoric or hisloric settlement withi�� tl�e project
limits aud ro nssess the level of grouud disturbancc.
Bridge No. 107 and Moui�tain Crcek Road cross Mount�u� Creek roughly north to soutl�. Mouvtain
Creek drains south into tlie Chcoal� River. Tl�ese water�vays are part of the Little Teimessee draivage
basin. The APE resides wit�in the nTn�ow Mountain Creek draivageway witl� stecp l�illsides to tl�e east
and wesl (Figw�e 2). A very narro�v stream tcrrace is bchveen the road and the creek just northwest of ihe
bridge, but this landform is mnrginal withi�� the APE. Tl�e project area is mostly forested witli past
�ouud disturb�nce limited to previous road coustructioi�.
Thc USDA soil survey m�p sl�ows that most of Ihe APE is composed of the Dellwood-Reddies soi(
complex (DeB) (see Pigure 2). This scries is described as moderately well drniued sandy loam soils that
are suUject to occasionnl flooding. Slope is bctween 0 to 5 percenL Howevcr, review of the coi�tour
iuiage and photographs of the project area show that slope along the hillsides is much grcater thau 5
percenL More than likcly the neighboring Sylco-Cataskn complex (SyF), Spivcy-Whitwak complex

(SvD), aud the Junaluska-Tsali complcx (JtE) composc the soils wilhiu tlie APG. These soils all have
slope bet�vee�i 15 �ud 50 percent, �vl�ich more accur�tcly describes the landforms. Typically, slope of IS
percent or �nore is unlikely to contaiu significant archaeological resources and do uot required subsw-face
testing.
A revic�v of the site 6Les shows no archTeological iuvesligatious within thc viciniry of the piroject area,
aud no known sites are within a uule of the bridge. Archaeological work is needed iu the area before
conclusions cnn be drawn an the predictability of sites based upon lu�own sitcs iu the region. Ho�vever,
the currcut project �vill not provide the necessaiy data in helpii�g to predict new archaeological sites, since
it is �vidcly known that the preseirt Iandforn�s generally do uot yield significaut sites.
Lastly, a historic map review was conducted. The first accurate and recognizable map in �vl�ich the
vicinity is depicted is the 1838 U.S. rLmy composite map, complied from the 1837 army field survey of
part of the Cheirokee Territory prior to their removal (Figure 3). fu� approximate location o£ the project
area can be located on this map as Mountain Creek is the only feature idenUficd. The map provides no
fiirlher informatio�� as no trail orhomestead are sho�vu in the viciiuty. ]t is uot until the early 20th cenhuy
that ttie uext mnp is publisl�ed tl�at depicts the project area with any clarity. Although tl�e 1906 USGS
Nantahala topographic map pro��ide a reliablc location for ihc project erea, it plots the road, �vhich has a
similar aligmnent as Mouut�in Creek road, sligl�dy m the west and upslope (Figure 4). The crossing over
ihe waterway is sho�vn fiuther to the nortlie�st. This wuld be an inaccurncy in the map, but subsequcnt
carly 20th centuiy maps show the same road alignment. Tl�e Tennessec Valley Authority (TVA)
produced a map of industries ai�d ag�iculture iu Graham County iii 1935 (Figure 5). This map shows thc
s�me road alignmcut and crossing as die previous 1906 USGS map, but historic struchire are sho�vn �long
thc creek. However, none are depicted ne�r the project area. It is not uutil the High�vay maps of Graham
County are publislied in the 1950s thTt the modcru aligument aud crossing are showi�. Agaiu, uo l�istoric
shlictures are depicted on these maps. It �vould seem from this i�evie�v that uo deposits associated with
significaut historic siruchire should be encouutered within tl�e APG.

The de£ined arcliaeological APE for Ihe proposed replace�uent of Bridge No. 107 is locatcd along the
Mountain Creek drainage�vay �vith stecp slope on either side. Only a very small arca of fairly Ievcl
property is within tl�c APE. This nan�o�v sheam terrace is found norlh�vcst of the bridge. lt is nnlikcly
iutact aud significaut arcl�aeological dcposits will be encowitered. This is mostly due to steep slope along
tl�e hillsides, wliicl� do not require subsurface testing. 'fhe level stream terrace is nunor and covers only a
small extei�t of the APE. Due to the miuimal amount oC impact within suc� a small arca, it is doubtful
siguificai�t archaeological deposits will be present on ihe uau�ow landform. Also, the l�istoric maps
suggest tliat no foi�ner l�istoric structures ancVor feahues are ui the area. As long as impacts to the
subsurface occur witl�in the definccl APE, no fi�rther archaeological �vork is recouuuended for tlie
replacement o£Bridge No. 107 iv Graham County. If construction should affect subsurface arcas beyond
the defined APE, further archacological consultaliou might be necessary.
