(CEI) is providing the attached Pre - Construction Notification and associated plans and supporting materials. The attached materials, along with the information provided in this letter are provided for your review and issuance of a Clean Water Act Section 404 Nationwide Permit 12. A copy of this information is also being sent to the NC Division of Water Resources for their review and issuance of a Section 401 General Certification 3884. Project Purpose and Need (PCN Item B.3d) The City is planning to replace and relocate two water transmission lines (20 -inch and 24 -inch) with a new 30 -inch transmission line. The actual installation date of the current water system in the project area is not known, but based on plans for other infrastructure showing these lines they are at least 50 years old, and could be as old as 60 -80 years. Some of these lines have been repaired multiple times and continue to cause maintenance issues. On multiple occasions in the past, the existing City water mains have been relocated due to conflicts with University infrastructure expansion or improvements. Relocations involve temporary interruptions in water service, increased incremental costs of relocation to the City, and potential delays in project schedules. In order to avoid further conflicts with planned University infrastructure and to address the aging infrastructure issue, the proposed project would relocate the transmission line beyond the future expansion area of the University. The campus has grown in size and developed all around these existing water mains. Any problems, such as a break in the water main, could pose a danger to the buildings and students on campus. It would also be more difficult and more disruptive to the entire campus to repair or maintain these water mains in their present location. r—_—,,,_ Project Description (PCN Item B.3e) The City of Winston -Salem is proposing to replace and relocate two water inch and 24 -inch lines) from their existing R. A. Thomas Water Treatment Mr. John Thomas Page 2 of 3 September 20, 2015 Winston -Salem State University with a 30 -inch water transmission line (Figure 1). The City is proposing to combine and relocate these lines around the outer edge of the University. These water mains primarily serve the downtown Winston -Salem area, however required interconnection with other service areas does exist. The line replacement would involve two new stream crossings and one replacement of an existing stream crossing in order to avoid conflicts with unstable stream banks and existing high tension transmission lines. The proposed line would run approximately 3,000 linear feet from the WTP north to tie into existing City infrastructure (Figure 2). The construction corridor would be approximately 40 feet wide, resulting in a total disturbance area of approximately 2.75 acres. No new service areas and no increase in water supply are associated with this project. Construction equipment will include, but not be limited to, excavators, track hoes, and dump trucks. Construction within the Brushy Fork culvert under the railroad will be completed in the dry. The existing water infrastructure will be removed from the eastern barrel, which currently does not contain jurisdictional waters. Flow will be diverted into this barrel and the new water main installed in the western barrel, to align it with a future planned greenway crossing. Stream banks up and downstream will be stabilized with riprap and geotextile fabric to ensure stream stability. The water main will be secured within the culvert per the attached plans. A concrete sill will be constructed on the upstream side of the western barrel to ensure base flow passes through the eastern barrel. Vegetative bank stabilization was considered but due to the current instability of the bank, presence of significant invasive species outside the project area (and control of the City) including kudzu, and the highly variable flow regime of Brushy Fork due to its urban watershed, riprap stabilization was deemed the most appropriate method. Impact Minimization (PCN Item D.la) As described in the attached PCN form and thoroughly documented in the Environmental Assessment for this project, multiple alternatives were considered to avoid wetland and stream impacts while considering existing infrastructure conflicts and other project constraints. The alignment for this project was re- evaluated several times, including 2012 due to the presence of a contaminated area east of Brushy Fork, and 2015 due to the extreme costs of the rail bore described below. The proposed alignment involves the minimum amount of impact practical give the complexities of this project in its urban environment. Resources being impacted are of low quality including linear wetland ditches and stream channels previously impacted by development. Wetland impacts have been minimized to the greatest practical extent. Stream crossings are primarily perpendicular with the exception of the aforementioned crossing through the Brushy Fork culvert. This crossing is required for several reasons. First the practicability of boring under the railroad was thoroughly evaluated, including sending the project out to bid to obtain contractor pricing for that option. The lowest bid was approximately twice the budgeted cost for the project. The primary reason for the high cost was the bore under the railroad, as this area contains significant backfill of rubble and other material that would make this construction difficult to complete. This bid price made the project impractical. Directional drilling or boring of the other stream crossings is impractical due to the channels already being degraded, expanded area Mr. John Thomas Page 3 of 3 September 20, 2015 necessary for bore pits causing additional impacts or encroaching into contaminated areas, and presence of shallow bedrock at Salem Creek. The City is in the process of designing a proposed greenway but the time frame for that project has not been determined. Plans include crossing the railroad through the western barrel of the culvert and realigning Brushy Fork to flow through the eastern barrel as described above. In order to co- locate infrastructure as much as possible, the proposed water main is designed in the western barrel and would be constructed below the greenway elevation and protected. In the event the greenway is not constructed, the water main will continue to function and be protected. Passing through the western barrel also allows the proposed line to avoid a potentially contaminated area on the east side of Brushy Fork (Figure 2). Impact minimization was performed during both the planning and design phase of this project and is thoroughly documented in the SEPA EA. Wetland impacts have been avoided except for two minor jurisdictional ditch crossings. Stream crossings have been minimized to those necessary to avoid infrastructure conflicts and a potentially contaminated area. The stream relocation and stabilization minimizes disturbance to Brushy Fork by co- locating the main with a planned greenway project. See cover letter for additional details. 1 b. Mr. Wainwright asked that our comments be sent directly to you. We previously commented on this project in letters to you dated November 30, 2009 and June 20, 2012. The following comments are provided in accordance with the provisions of the National Environmental Policy Act (42 U.S.C.§ 4321 et seq.) (NEPA); the Fish and Wildlife Coordination Act, as amended (16 U.S.C. 661- 667e); and section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531 -1543) (Act). The City of Winston -Salem (City) is planning on replacing and relocating two water transmission lines (20 -inch and 24 -inch) with a new 30 -inch transmission line. This project was previously documented in an Environmental Assessment (EA) in 2010, which received a Finding of No Significant Impact (FONSI) from the NC Public Water Supply Section on July 29, 2010 and completed State Clearinghouse Review on September 14, 2010 (SCH File # 11 -E- 4300 - 0039). A minor alignment change in 2012 to avoid an area of potential contamination was reviewed and considered consistent with the FONSI. The water main alignment has been shifted to cross the railroad within the existing culvert barrel. This alternative was included in the 2010 EA and FONSI, but it specifically mentioned placing the water main in the eastern barrel if boring under the railroad was not practical. The City is in the process of designing a proposed greenway but the time frame for that project has not been determined. Plans include crossing the railroad through the western barrel of the culvert and realigning Brushy Fork to flow through the eastern barrel. In order to co- locate infrastructure as much as possible, the proposed water main is designed in the western barrel and would be constructed below the greenway elevation and protected. In the event the greenway is not constructed, the water main will continue to function and be protected. The eastern barrel currently contains two water mains, which will be taken out of service as part of this project. A sill would be placed at the upstream end of the western barrel to direct base flow in to the eastern barrel, and the banks in that area stabilized. The eastern barrel would be excavated to remove sediment and the two existing water mains, and banks would be stabilized in that area as well. A Clean Water Act 4041401 permit application would be-submitted detailing this design. The alignment changes would result in the following changes to the 2010/12 EA findings: ® Addition of one stream crossing on Brushy Fork and associated temporary impacts. ® Reduction in wetland impacts by realigning the new stream crossing. ® Avoidance of potential disturbance to the contaminated area. Overall changes to the 2010/2012 EA findings are as follows: Temporary disturbance to Brushy Fork for the stream bank stabilization at the upstream and downstream ends of the culvert. Avoidance of potential disturbance to the contaminated area. No other material changes to the evaluation in the 2010 EA and FNSI, or 2012 re- evaluation, are anticipated as other environmental effects have not been increased by the alignment changes. We do not anticipate any additional significant environmental impacts from the proposed realignment beyond those addressed in our previous letter. Based on the information provided, we also concur with you assessment that the proposed project is not likely to adversely affect the federally threatened northern long -eared bat, which has been added to the threatened and endangered species list since the project was last reviewed. Therefore, we believe the requirements under section 7 of the Act are fulfilled. However, obligations under section 7 of the Act must be reconsidered if. (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered, (2) this action is subsequently modified in a manner that was not considered in this review, or (3) a new species is listed or critical habitat is determined that may be affected by the identified action.
