The purpose of this visit was to conduct an inspection of the subject NPDES facility. During the inspection, the presence and cooperation of Jonathan Stamas, Operator in Responsible Charge (ORC), and Joyce Dishmon, Subject Matter Expert for Wastewater, were helpful and appreciated. The Cape Fear Plant is located at 500 CP&L Road in Moncure North Carolina. The facility is classified as a Physical/Chemical-1 wastewater treatment plant that treats industrial wastewater and is authorized to discharge the treated wastewater through outfall 007 into an unnamed tributary to the Cape Fear River and through outfalls 008 and 009 into the Cape Fear River. The receiving waters of the discharges are classified as WS-IV in the Cape Fear River Basin. This NPDES compliance evaluation inspection consisted of the following: • Review of the NPDES permit; • Review of the owner/facility information; • Review of October 2016 — September 2018 monitoring data; • Review of October 2016 — September 2018 compliance history; • On -site inspection of the wastewater treatment units; and • On -site inspection of the discharge outfall. Findings during the pre -inspection file review were as follows: 1. The current NPDES permit was issued effective October 1, 2018, and will expire June 30, 2023. Beginning December.21, 20I drlrr NPIES Electronic Reporting Rule requires permittees _ to submittt 1e1i discharge monttartng repora (DMRs) electronically, instead of on paper. The first DMR the Divis' ly from the permittee was for November 2016. For the review period October 2016 — September 2018, the following violation was detected: Aquatic toxicity permit limit violation on August 14, 2017. No enforcement actions have been issued during the review period to Duke Energy for the subject permit. Findings during the inspection were as follows: 5. The operator's log and supporting analytical documentation were consistent and up to date. 6. During the period October 2016 through September 2018, no discharge was recorded on the DMRs for October through December 2016, and January through September 2018. The inspector compared the April 2017 DMR data against the ORC's bench lab data and Duke Energy's lab results. No discrepancies were noted. 7. The treatment systems were maintained and no apparent issues of concern were noted. 8. Sanitary wastewater generated at the Cape Fear Plant is pumped and hauled off -site. 9. The inspector observed the receiving streams for effluent discharges to be clear with no observable solids or foam. No detrimental impacts to the UT to the Cape Fear River and to the Cape Fear River from the effluent discharges were observed. Item 12 directed DEP to provide your office with an update on the development of the Ash Pond Closure Plan and to indicate whether decanting from the East and West Ash Basins and the voluntary use of the reverse osmosis treatment system would be part of the plant's closure plan. DEP's response is as follows: 1. Development of Ash Pond Closure Plan DEP has developed a draft closure plan for Cape Fear, but the plan has not been finalized. The company does not have a planned date for submitting the plan to the Department. The five impoundments at Cape Fear are classified by the Department as "intermediate -risk" under the Coal Ash Management Act of 2014 ("CAMA"), meaning that a closure plan is not due under the statute until December 31, 2019.' For these reasons, DEP has elected not to finalize the closure plans while additional details of the CAMA process are worked out. As an additional consideration, Cape Fear has been one of the subjects of a law suit by the Department in Wake County Superior Court. Last year, the Superior Court issued an Order Granting Motion for Partial Summary Judgment, which resolved the case as to Cape Fear and two other sites (H.F. Lee and Weatherspoon). The Order was negotiated and agreed to by both DEP and the Department (although the Department identified certain provisions to which neither objected nor endorsed). Among the requirements of the Order, the following are most relevant to closure planning: 32. Duke Energy Progress shall comply with the following requirements: a. Excavate and remove all CCR and Coal Combustion Products from the Cape Fear Impoundments ("Cape Fear Removed Ash") to lined locations for disposal in a CCR landfill, industrial landfill, or municipal solid waste landfill or for use as structural fill or other beneficial use pursuant to applicable law, and thereafter stabilize and close the area where the Cape Fear Impoundments are ' Cape Fear is not subject to the federal CCR Rule and is not required to generate a closure plan under that regulation. The Cape Fear Impoundments shall be closed according to the following timetable: For the 1956, 1963, and 1970 Ash Ponds, Duke Energy Progress shall begin excavation within five years of receiving the required permits and shall complete excavation within ten years of receiving the required permits. For the 1978 and 1985 Ash Ponds, Duke Energy Progress shall begin dewatering within one year of receiving the required permit(s), shall begin excavation within three years of dewatering, and shall complete excavation within ten years of dewatering. 41. The terms of this Order define Duke Energy Progress' minimum obligations regarding closure. Any closure plan submitted by Duke Energy Progress shall not be inconsistent with this Order. 42. A decision by any agency on the closure plan for Cape Fear that is final under the North Carolina Administrative Procedure Act and otherwise appealable under applicable law may be challenged by Duke Energy Progress and/or any of the Plaintiff - Intervenors by filing a contested case in the Office of Administrative Hearings, but only to the extent it is inconsistent with this Order. The terms of the Order dictate to a large extent the contents of the closure plan, but DEP recognizes that they do not supersede the requirement to submit a closure plan one year prior to the closure of the facility, as stated in the NPDES permit. 2. Decanting of the East and West Ash Basins The decanting currently taking place at Cape Fear is not part of the closure process. Rather, it is taking place as part of the Duty to Mitigate found in Part II.B.2. of the NPDES permit standard conditions. The authorization to decant was communicated to DEP by the Department by letter dated December 17, 2015. The authorization was later modified the Department by letter dated July 20, 2016, which mandated the use of physical -chemical treatment facilities. Both letters are attached for your reference. The current decanting is not designed to bring the impoundments to the point that they are ready for closure. The Department's authorizations only allow drawdown to three feet above the ash in the vicinity of the pump under current permits. Further decanting and dewatering of interstitial water must be authorized by a new permit. The current decanting is an interim measure to mitigate risks until a new permit is issued and closure can begin. NC 27559 NC Dept of Environmental Qualiry MAY 11 2017 Raleigh Regional Office As you are aware the central North Carolina Region experienced a large rain event early Friday morning May 5, 2017. The rain event at Cape Fear Steam Electric Plant (Cape Fear Plant) measured approximately 1.7 inches within 90 minutes Prior to the rain event Cape Fear Plant grading contractors had been working to remove the sediment basin associated with the plant demolition project CHATH-2013-015. The demolition area had been stabilized with ground cover and was in preparation for final grading. All that was left to complete final grading was to remove the detention basin and establish ground cover. The final grading contractor, as well as Duke Energy personnel were aware of the potential for rain in the forecast on Thursday evening/Friday morning. In preparation for the upcoming rain, the final grading contractor had placed 5-6 yards of rip rap, along with 2-3 yards of 57 stone in front of the silt fence outlet. The North Carolina Division of Water Resources (DWR) Construction General Permit, NCG 10000 requires an inspection of all erosion control BMP's after a rainfall event of over 0.5 inches. During the after rain event inspection, it was discovered that sediment laden water had overtopped the silt fence associated with the plant demolition project CHATH-2013-015. Approximately 1 cubic yard of sediment laden water overtopped the silt fence and discharged into the neighboring wetlands. As mentioned above, Cape Fear Plant had approximately 1.7 inches of rain within an hour and a half, which flooded the area resulting in sediment laden water overtopping the silt fence. After the inspection Duke Energy took immediate action. Additional 57 stone was used to dress the area in front of the silt fence. With the area inundated with water it is not accessible to equipment. Therefore with the situation mitigated ( no sediment was leaving the construction site) and no other rain expected over the weekend a plan was formulated to make repairs and remove as much sediment as possible from the wetlands area on Monday, May 8. On Monday May 8, Duke Energy took the following steps to further mitigate the off -site sedimentation issue experienced at the Cape Fear Plant on Friday May 5: • Cleaned out sediment in the neighboring wetlands with hand tools, Duke energy removed as much sediment by hand tools as possible. • Any sediment remaining in front of the silt fence was dug out and removed • Duke Energy installed an approximate 25' section of additional silt fence in the main area the discharge occurred • Installed 2 additional silt fence outlets with 57 stone • Installed an additional approximate 75' check dam utilizing 9 yards of riprap and 9 yards of 57 stone • Re -graded the entire disturbed area • Added thick layer of compost along entire surface area to aid in establishment of ground cover • Reseeded the area of the detention basin If you have any questions regarding this notification please contact Steve Cahoon at (919) 546- 7457 orsteve.cahoon@duke-energy.com. During routine inspection after rainfall, it was discovered that sediment laden water had overtopped the silt fence in the area of the formal coal pile. This area has been stabilized with grass and the grading contractor had been working to take the pond out of service for final E&SC plan closure. The pond area had been prepped and re- seeded. In preparation for the upcoming rain, the final grading contractor had placed 5-6 yards of rip rap, along with 2-3 yards of 57 stone in front of the silt fence outlet. We had approximately 1.7" of rain, within an hour and a half, which backed up the wetlands water over the silt fence resulting in a discharge. Approximately 1 cubic yard of sediment discharged into the neighboring wetlands. Actions taken this morning were to add additional 57 stone to dress the area in front of the silt fence. With the area inundated with water it is not accessible to equipment. As we are no longer discharging sediment, and with no rain forecasted for the weekend we will be making final repairs first thing Monday morning. We will make an attempt to remove the sediment with hand tools in the wetland area once the area is accessible and we can remove the sediment. If it is more damaging to the resource to remove the sediment, we will leave it in place and stabilize it with a wetlands seeding mix. Please let me know if you have any further questions. Also, per our certified lab's website, the certification number for the field parameters for the Cape Fear Plant is 5101. 1 noticed on the January 2017 monitoring report the certified lab number is listed as 248, which is the certification number for Duke Power Company lab in Huntersville, North Carolina. The Huntersville lab is certified as a commercial lab for both field and non -field parameters. During the inspection you indicated that you analyze pH and temperature 4 days per week and Pace Analytical collects samples (field and non -field parameters) on Tuesdays and provides analyzes for these collected samples. Box 1006 Charlotte, NC 28201-1006 As you are aware during the daily inspection at the Cape Fear Plant last month, one new outlet pipe was identified that flows in to the old cooling tower basin. The coordinates for the pipe are 350 35'25.62" N and 790 02'46.96" W. The pipe has a very low flow and was difficult to sample, however a sample of the discharge from the pipe was obtained. We have continued to monitor the flow from the pipe, we believe the origin of the water is from an old French drain system in the vicinity of the cooling tower. The water in the pipe has been re-routed and combined with Seep S-5 into one discharge point into the discharge canal (effluent channel) so it will be monitored at Outfall 007. Pb, Mo, NL8e, TI LL 10 March 2017 Mr. Ron Berry North Carolina Division of Water Resources 1617 Mail Service Center Raleigh, NC 27699-1617 Subject: Notification of Newly Discovered Pipe at Cape Fear Steam Station Dear Dr. Chemikov, As you are aware during the daily inspection at the Cape Fear Plant last month, one new outlet pipe was identified that flows in to the old cooling tower basin. The coordinates for the pipe are 350 35'25.62" N and 790 02'46.96" W. The pipe has a very low flow and was difficult to sample, however a sample of the discharge from the pipe was obtained. We have continued to monitor the flow from the pipe, we believe the origin of the water is from an old French drain system in the vicinity of the cooling tower. The water in the pipe has been re-routed and combined with Seep S-5 into one discharge point into the discharge canal (effluent channel) so it will be monitored at Outfall 007.
