8. PROJECT SUMMARY:
The property addressed by this application is located at 3 Ginguite Trail in the Town of Southern
Shores, Dare County. The need for the proposed project is to provide waterfront access for private
recreational uses associated with a future single-family residence. The address this need, an elevated
accessway and pier will be constructed to connect the uplands to water dependent structures proposed
along the main channel of Ginguite Creek. Water dependent structures proposed at the end of the pier
will include a covered boatlift, a fixed platform, a finger pier, and a lower deck.
9. NARRATIVE DESCRIPTION:
The subject property is located along the eastern shoreline of Ginguite Creek, a tributary of Currituck
Sound. The 1.52-acre parcel is presently undeveloped; however, a single-family residence is planned
for construction within the next several years. Uplands on the property range in elevation from 2.0 to
6.0 feet NGVD. Elsewhere on the property, elevations are 2.0 feet or less. Uplands on the property are
vegetated with pine/maritime forest. Elsewhere on the property, vegetation is comprised of scrub/shrub
and emergent wetland species. No archaeological resources are known to exist on or offshore of the
property.
A narrow shallow waterway is located between a small island and the high ground portion of the
property. Depending on wind conditions, depths along this waterway can range from 0 inches to 2.0
feet. Waterward (west) of the island, water depths along the main channel of Ginguite Creek increase
relatively quickly from 1.5 feet along the shoreline to 3.0 feet approximately ten feet offshore to 5.0
feet.
Ginguite Creek from its mouth southward to the project site is classified as a primary nursery area
(PNA). Water resources in the project area are classified as SC (Aquatic Life, Secondary Contact
Recreation, Tidal Salt Water) which are closed to shellfishing. Fishing waters in the area are classified
as "Inland" and are managed by the NC Wildlife Resources Commission. Submerged aquatic
vegetation (SAV) was not observed in affected portions of Ginguite Creek or the shallow waterway at
the time of site inspection.
10. PROJECT DESCRIPTION:
The project will include an elevated accessway measuring 320 feet by 5 feet 4 inches. The accessway
will be elevated at least three feet above the coastal wetland substrate as measured from the bottom of
the decking. At or near normal water line (NWL) of the main shoreline, the elevated accessway will
connect to a pier measuring 80 feet by 5 feet 4 inches. Where the elevated accessway and the pier meet,
the pier will make a slight bend to the north. This bend is necessary to allow waterfront structures to be
placed at the narrowest width of the island; thereby, minimizing encroachment into the main waterway
of Ginguite Creek.
The pier will connect to a 16-foot by 16-foot fixed platform. As per DCM's navigability determination,
the pier where it traverses the shallow waterway located between the island and the mainland will be
elevated a minimum of 6 feet above normal water level (NWL) to accommodate navigation by kayaks,
canoes, and other small watercraft. Elsewhere, the pier and platform will be constructed with decking
material at least 36 inches above the normal water level (NWL), with a target height of 48 inches above
NWL. A 15-foot by 26-foot covered boatlift with open sides will be constructed adjacent to and north
of the fixed platform. These dimensions include a one -foot overhang along all four sides. The roof of
the boathouse will be no lower than 11 feet above NWL, with a 12-foot target height of the ceiling. A
3-foot by 24-foot finger pier will be constructed along the east side of the covered boatlift to allow
access from the fixed platform. A 4-foot by 15-foot lower deck will be constructed along the south side

of the fixed platform to allow water access for canoes, kayaks and other small watercraft. At this point,
decking will be elevated at least 12 inches above NWL. To accommodate access, a set of three -foot -
wide stairs will connect the lower deck to the pier.
Assuming 10-foot spacing, approximately 64 eight -inch piles will be driven into coastal wetlands and
404 wetlands for construction of the elevated accessway. Similarly, approximately 16 eight -inch piles
will be driven into coastal wetlands and shallow bottom for construction of the pier. Approximately 35
eight -inch piles will be driven into shallow bottom for construction of the covered boatlift, fixed
platform, finger pier, and lower deck. Water depths have been deemed adequate for navigation by
small recreational watercraft. No dredging is proposed.
11. ANTICIPATED IMPACTS:
In total, 2,186 square feet of the property will be shaded following completion of the project,
including:
• 556 square feet of coastal wetlands that will be shaded following construction of the elevated
accessway,
• 451 square feet of non -coastal wetlands that will be shaded following construction of the elevated
accessway,
• 53 square feet of upland that will be cleared and graded at the launch -point of the elevated
accessway,
• 212 square feet of coastal wetlands that will be shaded following construction of the pier,
• 133 square feet of shallow bottom (between the island and the mainland) that will be shaded
following construction of the pier, and
• 781 square feet of open water that will be shaded following construction of the covered boatlift,
fixed platform, finger pier, and lower deck.
In addition, it is estimated that 115 piles will be driven to construct elevated structures.
To gain access to the main shoreline of Ginguite Creek, a narrow, shallow, yet navigable inlet will be
crossed at sufficient height (a minimum of six feet) to allow for passage of small watercraft.

Proposed Development Purpose:
• In conjunction with building a Residential Home, a pier with a platform and covered 10,000 pound boat lift will be built
• To access the water, 404 and Coastal Wetlands need to be crossed.
Buildings/Facilities/Units/Structures:
The project will consist of an approximately 400' by 5'4" pier that extends to a 16' by 16' platform. The pier
and platform will be constructed with the decking material at least 36" above the Normal Water Level
(NWL), with a target height of 48" inches above NWL. The pier will be required to go over approximately 30'
of open water to an island owned by the property owners.
• On the south side of the pier adjacent to the platform and pier, will be 3' wide stairs that will lead to a 16' by
4' finger pier, with the decking material 12" above NWL, to allow water access for canoes and kayaks.
• On the Northeast side of the platform, there will be a 3' by 26' finger pier that will allow access to the
boathouse lift. The boathouse will not be enclosed on the sides, and will only consist of a roof. The lower
edge of the roof of the boathouse will be no lower than 11' above NWL, with a target height of the ceiling to
be over 12'. The roof will have 12" overhangs.
• The pier over the waterway between the island and the mainland will be elevated to allow 6' of clearance
from NWL to the bottom of the structure, to allow water access under the bridge. The 6' clearance will have
a minimum width of 8 feet, towards the centerline of the water.

The project will consist of a pier measuring 400 feet by 5 feet 4 inches that
will extend to a 16-foot by 16-foot fixed platform. The pier and platform will
be constructed with decking material at least 36 inches above the normal water
level (NWL), with a target
height of 48 inches inches above NWL.
On the south side of the pier (adjacent to the platform and pier), will be
3-foot-wide stairs that will lead to a 16-foot by 4-foot finger pier, with the
decking material 12 inches above NWL, to allow water access for canoes and
kayaks.
On the northeast side of the platform, there will be a 3-foot by 26-foot finger
pier that will allow access to the boathouse lift on the west side of the finger
pier. The boathouse will not be enclosed on the sides and will only consist of
the roof. The roof of the boathouse will be no lower than 11 feet above NWL,
with a 12-foot target height of the ceiling. The roof will have 12-inch
overhangs on all sides.
As per DCM's findings, the pier as it traverses the shallow waterway located
between the island and the mainland will be elevated 8 feet above normal water
level (NWL) to accommodate navigation by kayaks.

Location description: The review area for this Jurisdictional Determination is located at 3 Ginguite Trail, Kitty Hawk, Dare
County adiacent to Jean Guite Creek. Parcel #: 022519060. The property totals 1.52 acres and contains 1.08 acres of wetlands.

A. Preliminary Determination
® There appear to be waters, including wetlands on the above described project area/property, that may be subject to
Section 404 of the Clean Water Act (CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33
USC § 403). The waters, including wetlands have been delineated, and the delineation has been verified by the Corps to be
sufficiently accurate and reliable. The approximate boundaries of these waters are shown on the enclosed delineation map
dated 5/18/2023. Therefore, this preliminary jurisdiction determination may be used in the permit evaluation process,
including determining compensatory mitigation. For purposes of computation of impacts, compensatory mitigation
requirements, and other resource protection measures, a permit decision made on the basis of a preliminary JD will treat
all waters and wetlands that would be affected in any way by the permitted activity on the site as if they are jurisdictional
waters of the U.S. This preliminary determination is not an appealable action under the Regulatory Program
Administrative Appeal Process (Reference 33 CFR Part 331). However, you may request an approved JD, which is an
appealable action, by contacting the Corps district for further instruction.
❑ There appear to be waters, including wetlands on the above described project area/property, that may be subject to Section 404
of the Clean Water Act (CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403).
However, since the waters, including wetlands have not been properly delineated, this preliminary jurisdiction determination
may not be used in the permit evaluation process. Without a verified wetland delineation, this preliminary determination is
merely an effective presumption of CWA/RHA jurisdiction over all of the waters, including wetlands at the project area, which
is not sufficiently accurate and reliable to support an enforceable permit decision. We recommend that you have the waters,
including wetlands on your project area/property delineated. As the Corps may not be able to accomplish this wetland
delineation in a timely manner, you may wish to obtain a consultant to conduct a delineation that can be verified by the Corps.

1. The Corps of Engineers believes that there may be jurisdictional aquatic resources in the
review area, and the requestor of this PJD is hereby advised of his or her option to request
and obtain an approved JD (AJD) for that review area based on an informed decision after
having discussed the various types of JDs and their characteristics and circumstances when
they may be appropriate.
2. In any circumstance where a permit applicant obtains an individual permit, or a Nationwide
General Permit (NWP) or other general permit verification requiring "pre- construction
notification" (PCN), or requests verification for a non -reporting NWP or other general
permit, and the permit applicant has not requested an AJD for the activity, the permit
applicant is hereby made aware that: (1) the permit applicant has elected to seek a permit
authorization based on a PJD, which does not make an official determination of
jurisdictional aquatic resources; (2) the applicant has the option to request an AJD before
accepting the terms and conditions of the permit authorization, and that basing a permit
authorization on an AJD could possibly result in less compensatory mitigation being
required or different special conditions; (3) the applicant has the right to request an
individual permit rather than accepting the terms and conditions of the NWP or other
general permit authorization; (4) the applicant can accept a permit authorization and
thereby agree to comply with all the terms and conditions of that permit, including
whatever mitigation requirements the Corps has determined to be necessary; (5)
undertaking any activity in reliance upon the subject permit authorization without
requesting an AID constitutes the applicant's acceptance of the use of the PJD; (6)
accepting a permit authorization (e.g., signing a proffered individual permit) or undertaking
any activity in reliance on any form of Corps permit authorization based on a PJD
constitutes agreement that all aquatic resources in the review area affected in any way by
that activity will be treated as jurisdictional, and waives any challenge to such jurisdiction
in any administrative or judicial compliance or enforcement action, or in any administrative
appeal or in any Federal court; and (7) whether the applicant elects to use either an AJD or
a PJD, the JD will be processed as soon as practicable. Further, an AJD, a proffered
individual permit (and all terms and conditions contained therein), or individual permit
denial can be administratively appealed pursuant to 33 C.F.R. Part 331. If, during an
administrative appeal, it becomes appropriate to make an official determination whether
geographic jurisdiction exists over aquatic resources in the review area, or to provide an
official delineation of jurisdictional aquatic resources in the review area, the Corps will
provide an AJD to accomplish that result, as soon as is practicable. This PJD finds that
there "may be" waters of the U.S. and/or that there "may be" navigable waters of the U.S.
on the subject review area, and identifies all aquatic features in the review area that could
be affected by the proposed activity, based on the following information:

The project will consist of an approximately 400' by 5'4" pier that extends to a 16' by 16' platform. The pier and
platform will be constructed with decking material at least 36" above the Normal Water Level (NWL), with a target
height of 48" inches above NWL.
On the south side of the pier adjacent to the platform and pier, will be 3' wide stairs that will lead to a 16' by 4' finger
pier, with the decking material 12" above NWL, to allow water access for canoes and kayaks.
On the Northeast side of the platform, there will be a 3' by 26' finger pier that will allow access to the boathouse lift
that will be on the west side of the finger pier. The boathouse will not be enclosed on the sides and will only consist of
the roof. The roof of the boat will be no lower than 11' above NWL, with a target height of the ceiling to be 12'. The
roof will have 6" overhangs on all sides.
The pier over the waterway between the island and the mainland may require to be elevated as determined by
appropriate governing body that determines what craft the water is navigable by.
