Aqua North Carolina, Inc. (Aqua) offers the following response to the above -referenced Notice of
Violation, for the Division of Water Resources late/missing the Non -Discharge monitoring (NDMR) as
well as the Non -Discharge application report of the following month July 2023.
Aaua's Response:
Both the NDMR and NDAR were submitted within the required timeframe; however, the owner's
signature was not complete. This was an oversight by the ORC. The owner has provided additional training
to the ORC to minimize the risk of recurrence. With respect to the ORC designation form it was sent on
January 3, 2023 to Wanda Gerald, please see attached email string. Aqua respectfully requests that the
Notice of Violation be rescinded and recommends a simple phone call for these situations which can reduce
the administrative workload for minor errors and omissions by both groups.

Hi Mr. Robert,
Sure, I will be glad to assist.
1. Yes, Eric Riggins is showing as the ORC for the above facility, and he can continue signing the NDMR's. I do show
him active in our system as the ORC for the above facility.
2. The two individuals that is considered as outside third -party, yes, a new ORC form must be completed if they are
not listed in our system. The new ORC form for the two outside individuals will not override Eric Riggins as the
ORC, it will only add the two individuals so the NDAR reports can be approved. As far as the classification for the
two outside individuals, if their classification is SI then you will need to put SI as their classification on the ORC

form. If their classification is WW-2, you will need to put WW-2 on the ORC form. I think their license should
explain their correct classification.

I need clarification....
1. Eric Riggins is an Aqua employee and ORC of the Preserve and Chapel Ridge WWTP. He should be signing the NDMR's .
2. The two outside third -party folks that spray irrigate our effluent for the golf community should be signing the NDAR's
for Chapel Ridge and Preserve. So when filling out the new forms ... do we pick (SI) for the location class so it doesn't
override Eric Riggins as ORC of the plant?

Thank you for responding to my email. Yes, I reviewed our database and I do see Eric Riggins as the ORC for the above
facility. However, Jade Wicker signed the monitoring report as the ORC, which he is not listed as the ORC in our system.

Aqua ORC Eric Riggins is the current Primary ORC of the Chapel Ridge WWTP and that should be correct in your system.
We have re -submitted his ORC form several times in the past. Eric Riggins completes the NDMR's for this facility. William
Brian Peters, Regional Golf Course Superintendent
at Century Golf Partners -Triangle Golf is the owner and certified operator of the spray irrigation system and spray
activities. Jade Wicker is a spray operator employed by Mr. Brian Peters who is filling out the NDAR's.

During our recent records update, Jade Wicker is not listed as a primary ORC designated for this facility. Upon
the Water Pollution Control System Operators Certification Commission's (WPCSOCC) classification of the
subject non -discharge facilities, the Permittee shall designate and employ a certified operator in responsible
charge (ORC), and one or more certified operators as back-up ORC's. The ORC or their back-up shall operate
and visit the facilities as required by the WPCSOCC [15A NCAC 02T .01171. Please complete and submit the
