Salisbury St., Archdale Bldg. 9t" Fir Raleigh, NC 27604 On behalf of The Estate of Bobby Powers (property owner) and Ellis Developments Group (applicant), please find attached a complete application and supplemental information requesting written concurrence from the US Army Corps of Engineers (USACE) that the activities associated with the proposed development of the China Grove — Eva Lane subdivision (Project) may proceed under Nationwide Permit (NWP) 29 and General Certification 4256 (GC 4256). Project Purpose and Locatio8 The Project includes the construction of a residential subdivision. The +/-123.61-acre tract is bounded to the north by Ed Weavers Road and to the south by Mount Hope Church Road, approximately +/- 0.71 mile west of US 601 Highway in Salisbury, Rowan County, NC. The coordinates of 35.5824°N, 80.5326°W generally correspond to the center of the Site. Project Detail The proposed Project consists of the construction of a residential development with associated utilities and roads. Access to the Site will be provided via Mount Hope Church Road to the south. Heavy equipment typically used for utility installation projects (e.g., backhoes, bulldozers, etc.) will be utilized. No federally threatened or endangered species are listed to occur on the Site according to the NC Natural Heritage Program (NCNHP) Database, (see attached report dated December 21, 2023). The Site is not listed as a historic property or within a historic district. No historic structures were found on the Site. There are eight (8) historic properties identified within one mile of the Site. Project History The Site is an assemblage of eleven individual properties, bounded to the north by Ed Weavers Road and to the south by Mount Hope Church Road, approximately +/- 0.71 mile west of US 601 Highway in Salisbury, Rowan County, NC. Three additional parcels are located across Mount Hope Church Road, immediately west of the intersection of Menius Road and Mount Hope Church Road. The Site consists of a mix of agricultural fields, with undisturbed forested areas on the northern and eastern property boundaries. There is an existing residence and several outbuildings on the Site as well. Surrounding land use includes agricultural fields, undisturbed forested areas and some residential properties. Avoidance and Minimization Four jurisdictional streams (SA, SB, SC & SD), fourteen forested riparian wetlands (WA-01, WA-02, WB-01 through WB-05, WC and WD-01 through WD-06) and one pond (Pond 1) are located on the Site. The proposed roadway infrastructure results in one (1) wetland crossing and one (1) stream crossing; these features bisect the China Grove — Eva Lane Subdivision Page 1 of 2 property, and the road crossings are necessary to access useable upland portions of the Site. Streams are not crossed multiple times by roads. All other jurisdictional features on the Site have been avoided. Lots were positioned to avoid additional fill and/or impact to streams and wetlands. Stormwater outfalls were designed to minimize impacts to jurisdictional areas. Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts. Silt fencing will be installed to provide additional protection from stormwater runoff. Project Impacts Impact Area 1 proposes 0.01 acres of permanent wetland impact for lot fill. Impact Area 2 proposes 0.022 acre of permanent wetland impact and 0.007 acres of temporary wetland impact associated with a roadway crossing. Impact Area 3 proposes 138 linear feet of permanent stream impact, 29 linear feet of permanent stream impact (no permanent loss), and 41 linear feet of temporary stream impact associated with a roadway crossing. Impact Area 4 proposes 0.038 acre of temporary wetland impact associated an aerial sewer line installation. There is also a boardwalk being installed at this location, however, it will be installed via top -down construction using pile - driven, timber piers. Historically, the USACE and NCDWR have not considered this a loss of function impact to the wetland. Impact Area 5 proposes 0.008 acre of permanent wetland impact associated with grading for SCM drainage structures and a portion of a greenway trail. Mitigation Permanent wetland impacts total 0.04 acre which is below compensatory mitigation thresholds. Permanent stream impacts total 138 linear feet (0.015 acre) which are also below compensatory mitigation thresholds. If you have any questions, please call me at (919) 559-1537. Based on the project area mapped with your request, a query of the NCNHP database indicates that there are no records for rare species, important natural communities, natural areas, and/or conservation/managed areas within the proposed project boundary. Please note that although there may be no documentation of natural heritage elements within the project boundary, it does not imply or confirm their absence; the area may not have been surveyed. The results of this query should not be substituted for field surveys where suitable habitat exists. In the event that rare species are found within the project area, please contact the NCNHP so that we may update our records. The attached `Potential Occurrences' table summarizes rare species and natural communities that have been documented within a one -mile radius of the property boundary. The proximity of these records suggests that these natural heritage elements may potentially be present in the project area if suitable habitat exists. Tables of natural areas and conservation/managed areas within a one -mile radius of the project area, if any, are also included in this report. If a Federally -listed species is found within the project area or is indicated within a one -mile radius of the project area, the NCNHP recommends contacting the US Fish and Wildlife Service (USFWS) for guidance.
