Mr. Allen,
On November 8, 2023, the Division of Water Resources (Division) received your applicaƟon requesƟng a 401 Water
Quality CerƟficaƟon from the Division for the subject project. The Division has determined that your applicaƟon is
incomplete and cannot be processed. The applicaƟon is on‐hold unƟl all of the following informaƟon is received:
1. Note 3.0 on Sheet C‐1 of the project plans incorrectly states the turbidity standard. Please revise this note to
reflect the current standard for turbidity to ensure the turbidity monitoring is accurate and necessary erosion
and turbidity control measures are uƟlized. The current standard for turbidity is found at 15A NCAC 02B
.0211(21) and is included below. [15A NCAC 02H .0506(b)(2); 15A NCAC 02H .0211(21)]
a. Turbidity: the turbidity in the receiving water shall not exceed 50 Nephelometric Turbidity Units (NTU) in
streams not designated as trout waters and 10 NTU in streams, lakes, or reservoirs designated as trout
waters; for lakes and reservoirs not designated as trout waters, the turbidity shall not exceed 25 NTU; if
turbidity exceeds these levels due to natural background condiƟons, the exisƟng turbidity level shall not
be increased. Compliance with this turbidity standard shall be deemed met when land management
acƟviƟes employ Best Management PracƟces (BMPs), as defined by Rule .0202 of this SecƟon,
recommended by the Designated Nonpoint Source Agency, as defined by Rule .0202 of this SecƟon.
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested informaƟon for the
proper consideraƟon of the applicaƟon. Please provide your response by January 5, 2024. If all of the requested
informaƟon is not received, the Division will be unable to approve the applicaƟon and it will be denied as incomplete.
The denial of this project will necessitate reapplicaƟon to the Division for approval, including a complete applicaƟon
package and appropriate fee.
