NCS000614 Application Return Charlotte Asphalt Cement Terminal Mecklenburg County- Return #1352 Dear Applicant: The Division of Energy, Mineral, and Land Resources (DEMLR) Stormwater Permitting Program received your application for an NPDES Individual Stormwater discharge permit on September 22, 2023. Upon review of the application, the facility does not qualify for coverage under an NPDES stormwater permit due to the size of the storage tanks onsite. Information provided during the permit review states there is over 5 million gallons of liquid asphalt stored onsite in above ground tanks. Per the 2005 permitting strategy from the Compliance and Expedited Permitting Unit for Petroleum Bulk-Storage, "North Carolina's Division of Water Quality issues individual, point-source NPDES permits for stormwater to all vehicle-fuel and petroleum terminals with above ground storage capacities exceeding one million gallons." With this letter, your application is being returned to you. Please be advised that if the State determines that discharges from this site contribute to a water quality standard violation or are a significant contributor of pollutants to waters of the State,the Department of Environmental Quality (DEQ) is authorized to require an appropriate discharge permit or eliminate the discharge. The return of this application does not affect the legal requirements to obtain other permits, which may be required by the Division of Energy, Mineral, and Land Resources, or permits required by the Division of Water Resources (DWR), Coastal Area Management Act, or any other federal or local government permit or approval that may be required.
