Director Tom Johnson City of Lexington 28 W Center St Lexington, NC 27292-3099 SUBJECT: NOTICE OF DEFICIENCY NORTH CAROLINA Environmental Quality November 20, 2023 Tracking Number: NOD-2023-DV-0097 Sanitary Sewer Overflows - October 2023 Collection System Permit No. WQCS00042 Lexington Collection System Davidson County Dear Mr. Johnson: A review has been conducted of the self -reported Sanitary Sewer Overflow (SSO) 5-Day Report submitted by City of Lexington. This review has shown the City of Lexington to be in violation of the requirements found in the subject permit and/or North Carolina G.S. 143-215.1(a)(1). Enforcement decisions are based on volume spilled, volume reaching surface waters, duration, gravity, impacts to public health, fish kills and other factors.
