This correspondence is in reference to the Stinking Creek stream and wetland mitigation site
of the Chatham Umbrella Mitigation Batik, that you are developing. The specific site is located
approximately 0.5 miles west of the Gum Springs Church Road, Clark Poe Road intersection, in
southeast Chatham County, North Carolina, within the Cape Fear River Basin, hydrologic Unit
Code (HUC) 03030002. The mitigation site is anticipated to be one of several included in the
Chatham Umbrella Mitigation Bank. The purpose of this letter is to confirm the initial release of
credits from this Bank.
Pursuant to the approved stream restoration mitigation plan entitled, S."tinking Creek
Mitigation Site, dated December 2014, and the Mitigation Banking Instrument (MBI) entitled,
Chathain Uinbrella Mitigation Bank, received on December 30, 2014, one hundred percent
(100%) of this batik, site total preservation credits shall be available for sale immediately upon
completion of all of the following:
a. Execution of the MBI by the Sponsor, the Corps, and other agencies eligible for
membership in the IRT who chose to execute the agreement;
b. Approval of the final mitigation plan;
c. Delivery of the financial assurance described in paragraph II.B.9.a of the M131;
d. Recordation of the preservation mechanism described in paragraph II.B.8 of the MBI, as
well as a title opinion covering the property acceptable to the Corps;
By copy of this correspondence, we confirm that You have satisfied the above requirements
and 1,267 linear feet of stream credits and 2 wetland credits constituting 100% of the Stinking
Creek .Mitigation ,91e's total preservation credits are now available for sale.

Additionally, for your records, we have enclosed a copy of signatures for all parties that have
executed the agreement to establish the Chatham Umbrella Mitigation Bank in Chatham County,
North Carolina.
