Good afternoon Liz and Mickey,
DWR received the CAMA major permit application for the West Carteret County Boat Launch in
accordance with 15A NCAC 02H .0502 (b) on 6/5/2023 which started the 60-day State review clock,
additional information was requested on 8/3/23 (attached), a partial response to the DWR RFAI was
received on 9/1/23. The DWR RFAI requested additional information on the model used to conduct
the flushing analysis, including a flushing modeling plan be provided to DWR for approval. DWR
Basin Planning and Branch staff have reviewed the information and cannot approve the model that
was provided. DWR has requested a meeting with the applicant and consultant to discuss the
flushing model requirements and concerns listed in the attached email. Once a flushing model has
been provided that can be approved by DWR, the model will need to be run, the results analyzed
and reports reviewed by DWR Basin and Planning Branch staff. DWR's request for additional
information referenced Division of Marine Fisheries (DMF) memorandum dated 6/21/2023 which
outlined concerns, suggestions and requested additional clarification and information on the
project. A response to the DMF memo was received on October 16, 2023. A technical discussion
was held on October 27, 2023 with the state resource agencies to discuss the response to the DMF
and DWR RFAls and outstanding resource concerns. Specific concerns were raised regarding the
proposed mitigation plan including private ownership of the proposed mitigation site and lack of
authority to conduct the mitigation as proposed.
Based on the information above, DWR is requesting an extension to the federal reasonable period of
time to the review the project. DWR requested and was granted an extension to the federal
reasonable period of time for review to December 1, 2023. However, Per state rule 15A NCAC 02H
.0507 (a) the 60 day State clock for DWR to take action does not restart until DWR receives all of the
information requested. Given the flushing model has not been approved, modeling has not been
conducted and reports not reviewed, combined with unresolved resource agency concerns, DWR is
requesting an extension to federal reasonable period of time to review the project be extended to
