As discussed on the conference call, I am sending the information related to the cove where there could be concerns.
The attachments are as follows:
1. Lake Norman Cove-a snip of the google map of the area. I have added a few notes for clarification.
2. Google earth snip of the same area—it includes overlays of the I-77 project
3. The REALLY long file name—pic from the Iredell County GIS site showing lot numbers in yellow/red and address
numbers in black.
4. Excel spreadsheet of land owners on Perrin Road. I wasn't sure who/what you wanted, so I left all owners in the
spreadsheet. I am sure the ones on the cove have the greater interest.
5. Picture from the complaint (from the complaint I investigated—no report was generated)
6. Notice of Violation sent to Lowes concerning the site (I was not involved in writing it, but I was on a site visit
with Polly)

On February 9, 2009, Polly Lespinasse of the Division of Water Quality (DWQ) and Charlie Whaley, Scott
Harrell, Chad Broadway and James Moore of the Division of Land Resources (DLR), conducted a site
inspection at the Lowe's Corporate Offices. Kevin West, Lowe's Project Manager and representatives of the
general contractor, were also present during the site inspection. The inspection was conducted in response to
a citizen complaint received by DLR regarding sediment deposition in Lake Norman from a tributary located
upstream of the lake. As part of the complaint investigation, DWQ also conducted an inspection associated
with the NPDES Construction Storm Water Permit and 401 Water Quality Certification (WQC), Number 2001-
0774, issued to you by DWQ on August 21, 2001.
WQC Number 2001-0774 authorized 520 linear feet (If) of permanent stream impacts, 0.1 acre of wetland
impact and 2,900 linear feet of permanent flooding impacts to an unnamed tributary to Work Creek [Classified
as Class WS-IV, B, CA (Critical Area) Waters of the Catawba River Basin].
The following impacts/violations were observed during the site inspection:
• Riprap stream impacts were observed for an approximate distance of 75 linear feet from dam
(constructed by Lowe's). The placement of the riprap in the streambed is impeding stream flow and
aquatic passage.
• Sediment, ranging from depths of approximately 16" to 3', was observed in the stream just below the
dam to a point approximately 850 feet downstream, to the inlet end of the culvert located under
Interstate 77.
• A review of the construction stormwater records indicate some discrepancies associated with rainfall
amounts and outfall monitoring.

Inspection records being kept for the project did not clearly indicate which outfalls had been monitored,
for several months at the onset of construction. Note: This has subsequently been corrected and all
outfalis have been properly identified and monitored.
As a result of the site inspection and records review, the following violations, detailed below, are noted:
Item I. Removal of Best Usage
The improper placement of riprap represent violations of 15A NCAC 02B .0211 (2) - The waters shal�

short-term or long-term basis shall be considered to be violating a water quality standard.
Item II. Other Waste
Sediment in the stream represents a violation of 15A NCAC 26.0211(3) f— Oils; deleterious
substances; colored or other wastes: only such amounts as shall not render the waters injurious to the
public health, secondary recreation or to aquatic life and wildlife or adversely affect the palatability of
fish, aesthetic quality or impair the waters for any designated uses.
Item III. NPDES Construction Stormwater Permit Conditions
Lack of accurate qualitative observation/inspection records for stormwater outfalls represents a
violation of the NPDES Construction Stormwater Permit, NCG010000, specifically Section B., Condition
#2.
Requested Response
This Office requests that you respond to this letter in writing within 30 days of receipt of this Notice. Your
response should be sent to both this Office at the letterhead address and to the attention of Mr. John
Hennessy at the Wetlands and Stormwater Branch, NPS Assistance and Compliance Oversight Unit, 1617
Mail Service Center, Raleigh, NC 27699-1617. Your response should address the following items:
1 Explain why the above referenced impacts occurred without prior authorization.
2 Submit a Stream Restoration Plan to this Office for review and approval. This plan should include the
following:
• An explanation of how you plan to restore the approximate 850 feet of stream that is impacted by
sediment.
• An explanation of how you plan to provide for passage of stream flow and aquatic life in areas
where riprap is impeding flow and aquatic passage.

which is necessary to achieve compliance.

of Water Quality regarding these issues and any future/continued violations that may be encountered. Your
above-mentioned response to this correspondence will be considered in this process. This office requires
that the violations, as detailed above, be abated immediately. These violations and any future
violations are subject to a civil penalty assessment of up to $25,000.00 per day for each violation.
