Accordingly, we are forwarding the attached NPDES discharge permit. This pemtit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This final permit includes no major changes from the draft permit sent to you on October 10, 2007. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. Flow may be measured using a totalizing flow meter. 2. Chronic Toxicity (Ceriodaphnia) limit at 90% with testing in January, April, July and October (see A. (2) and A. (3)). There shall be no discharge of floating solids or visible foam in other than trace amounts. Quarterly samples for monitored parameters shall coincide with the chronic toxicity test. (2) CHRONIC TOXICITY PERMIT LIMIT (Quarterly) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 90%. The permit holder shall perform at a minimum, quarterlu monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of January, April, July and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP313 for the pass/fail results and THP313 for the Chronic Value. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, -pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. .� Permit NCO088692 A. (2) CHRONIC TOXICITY PERMIT LIMIT (Quarterly) continued. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. A. (3) ACUTE TOXICITY PASS/FAIL PERMIT LIMIT (Quarterly) The permittee shall conduct acute toxicity tests on a guarterlbasis using�.protocols defined in the North Carolina Procedure Document entitled "Pass/Fail Methodology For Determining Acute Toxicity In A Single Effluent Concentration" (Revised -July, 1992 or subsequent versions). The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24 hour static test. The effluent concentration at which there may be at no time significant acute mortality is 90% (defined as treatment two in the procedure document) . Effluent samples for self -monitoring purposes must be obtained during representative effluent discharge below all waste treatment. The tests will be performed during the months of January, April, July and October. All toxicity testing results required as part; of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGE6C. Whole Effluent Toxicity (WET) Test WET requirement is a Quarterly Chronic and Acute Toxicity Pass/Fail using Ceriodaphnia at 90%. Reasonable Potential Analysis (RPA) RPA analysis was based on the assumption that system will operate with 95% removal efficiency. Consultant estimates that removal efficiency will be 100% are not realistic. Maximum predicted effluent concentrations were determined based on a coefficient of variation of 0.6 and multiplier of 13.2 (as outlined in NC's RPA procedure based on EPA's Technical Support Document, n = 1) . The final limits were established in accordance with 15A NCAC 02B. 0224, which requires a safety factor of 50% to be applied to toxic substances. JW Smith/Camp Springs 76 is an active gasoline station and convenience store. The location of the site is show in Figure 1 which is included in .. Appendix A. Three 3,000-gallon underground storage tanks (UST) for gasoline are currently in use. In September 1988, Sparks Oil Company removed two 1,000-gallon gasoline USTs, and one 280-gallon kerosene UST. No soil tests or assessments were .� required in 1988 when the USTs were removed. The primary groundwater contaminants detected at the site are the compounds, benzene, r toluene, ethylbenzene, total xylenes (BTEX), MTBE, EDB, and VPH aliphatics/aromatic. The maximum observed benzene concentration in the groundwater is 36,000 µg/l, the maximum observed MTBE concentration in groundwater is 310,000 µg/l, and the r maximum observed EDB concentration in groundwater is 680 µg/l. A list of chemicals found at the site with maximum observed concentration and the summary of most recent groundwater analytical results are included in Appendix B. No free products has been observed in the monitoring wells installed at the site to date. The site is located in an area of mostly residential and agricultural property use. The only available drinking water supply within 1500 feet of the source area is private water wells or springs. Twenty-five (25) water supply wells and one spring have been identified within a 1500-foot radius of the release. The laboratory results from the JW r Smith's supply well samples collected on April 11, 2000 and June 24, 2004 detected the presence of MTBE at a concentration of 6.7 parts -per -billion (PPB) and 2.9 PPB, respectively. The well was abandoned in 2004. Between November 19, 2001 and May 9, r 2003 water samples from five supply wells located within 500 feet of the source were analyzed for V OCs, xylenes, and MTBE. The analytical results from the supply wells did not detect any petroleum hydrocarbon compounds. The average depth to the static groundwater table is approximately 20 feet below ground surface (bgs). The average groundwater gradient for the site is approximately 0.005 toward west, southwest. The site has an average hydraulic conductivity of 0.34 feet /day (1.2 x 10-4 cm/sec) for surficial saprolite zone and 0.74 feet/day (2.7 x 104 cm/sec) for the fractured bedrock zone. Based on the types of soils and geology encountered, the r storage coefficient for saprolite (soils) is estimated to be 0.10 (dimensionless), and the storage coefficient for fractured saprolite/bedrock is estimated to be 0.15. Of the groundwater remedial alternatives considered in the CAP for this site, conventional pump and treat appears the best suited to the characteristics of this site. The _ need for plume control is paramount due to the private water well on site, and other JW Smith / Camp Springs 76 — Individual NPDES Permit 1 Pyramid Project 2006595 am asp private wells in the surrounding area. The relatively low soil hydraulic conductivity of the subsurface is considered adequate for the application of conventional pump and treat �► remediation. Pump & treat technology is well suited for hydrocarbon plume containment at the site, and will accomplish the primary remediation goal of protecting the water supply wells at the site. The focus of the site remediation will be to: (1) protect the water �► supply well users in the area; (2) control the spread of the hydrocarbons in the bedrock aquifer; (3) provide hydrocarbon mass removal from the subsurface soils. �+ Besides the pump and treat system with design flow of 4.5 to 6 gallons per minute (GPM) the proposed remediation system for JW Smith site will also incorporate soil -vapor extraction system. Attachment C contains the detailed engineering specification for the �+ remediation system while Attachment D includes the remediation system design plans. The remediation system equipment cut sheets are included as Attachment E. Groundwater analytical data used as a design basis for the treatment system and the air stripper removal efficiencies are presented as Attachment F, while the carbon breakthrough time for the carbon adsorption vessels is presented as Attachment G. "" Discharge of the effluent from the treatment system will be directed to a drainage ditch leading into an unnamed intermittent stream that is predominantly spring -fed. The location of the discharge point is presented in Figure 6, which is included in Appendix �"' A. The unnamed stream flows to the north-northwest 1.2 miles into Country Line Creek. M• 2.0 Evaluation of Wastewater Discharge Restrictions Based on the review of the wastewater discharge restrictions presented in the Engineering Alternatives Analysis Guidance Document obtained from the NC DENR Division of go Water Quality/NPDES Unit website, the proposed discharge of treated water at the location previously described should be allowed. To verify this finding, Pyramid Environmental & Engineering P. C. (Pyramid) contacted Mr. Agyeman Adu-Poku with the NC DENR Division of Water Quality/NPDES Unit. Mr. Adu-Poku confirmed that the proposed discharge should be allowed. In addition, Mr. Adu-Poku suggested that although the effluent from the treatment system is non -oxygen -consuming wastewater 7Q10 and 30Q2 flow statistics for the proposed discharge location should be obtained. To obtain the requested flow statistics, Pyramid contacted Mr. Curtis Weaver with USGS NC Water Science Center. According to the information provided by Mr. Weaver, 7Q 10 and 30Q2 are estimated at zero flow for the proposed discharge location. 3.0 Evaluation of Disposal Alternatives The selection of conventional recovery and treatment as the groundwater remedial alternative requires a suitable form of discharge for the treated groundwater. Several discharge alternatives were examined in order to select the most viable option. In consideration of the site conditions, it can be said that: Discharge to a sanitary sewer is not possible because the area where the subject site is located is not served by a public sewer collection system. It is very unlikely that a public JW Smith / Camp Springs 76 — Individual NPDES Permit 2 Pyramid Project 2006595 Am an sewer system will be available in the next five years because there is no a public sewerage system within a five mile radius. OR • Discharge to the subsurface via infiltration or injection wells is not technologically feasible due to relatively low hydraulic conductivity of the site. The site has an average �+ hydraulic conductivity of 0.34 feet /day (1.2 x 10-4 cm/sec) for surficial saprolite zone and 0.74 feet/day (2.7 x 104 cm/sec) for the fractured bedrock zone. To effectively apply pump and treat methodology with re -injection of treated groundwater hydraulic conductivity must be greater than or equal to 10-2 cm/sec. • Air sparging as an in -situ technology is not effective for large hydrocarbon plumes such as one at the JW Smith site. Also air sparging will most likely spread the plume, which is unacceptable at the subject site due to close proximity of water supply wells to the plume location. • Spray or drip irrigation is not feasible due to the low permeabilities of the soils. Additionally, there -is no appropriate space on the subject site or adjacent properties to "'� install holding lagoon for this alternative; and • Point -discharge directly to surface waters appears to be the only technically feasible means of disposing of the treated groundwater. There is one option for point discharge to surface waters from the subject property. Discharge of the effluent from the treatment system will be directed to a drainage ditch leading into an unnamed intermittent stream that is predominantly spring -fed. The unnamed stream flows to the north-northwest 1.2 miles into Country Line Creek. Discharge will be carried to the discharge point via a buried, 3-inch diameter PVC discharge line. The discharge line will connect the treatment system to the drainage ditch located approximately 600 to 700 feet west of the proposed treatment building location. The discharge line will cross four (4) properties (Farmer's, G.W. Smith's, Garrison's. and Teddy Smith's). Pyramid has received signed access agreements to install the discharge line. Copies of signed access agreements and authorized representative documentation are included as Appendix H. am 3.0 Present Value of Costs A 20-year present value of cost analysis (PVCA) of the proposed remediation system with point source discharge, which is deemed as only technologically feasible alternative for the JW Smith site, is presented at the next page. The saprolite crushes to sandy silt. Groundwater Incident # 21685 WHEREAS, Pyramid has agreed to perform or arrange for the performance of assessment and remediation services in connection with petroleum hydrocarbon contamination of the Project Site property (Environmental Services); and, WHEREAS, Pyramid and Sparks are entering into this Reimbursement Agreement with the expectation am that the reasonable and necessary costs associated with performing the Environmental Services are covered by and eligible for reimbursement under the Commercial Leaking Petroleum Underground Storage Tank Cleanup Fund (the Trust Fund), except for costs not reimbursable under the Trust Fund (such as the deductible, tank removal and disposal, and permits); and, WHEREAS, Pyramid agrees to perform or arrange for the performance of the Environmental Services according to guidelines for reasonable charges promulgated by the North Carolina Department of Environment and Natural Resources (DENR), and to submit to DENR all costs and expenses incurred by Pyramid and the contractors or other agents it employees in connection with its performance of the Environmental Services (the Project Charges); and, WHEREAS, Sparks agrees to pay Pyramid for the Project Charges in accordance with this Reimbursement Agreement until the application for reimbursement under the Trust Fund is approved by DENR and Sparks has paid an amount equal to the Charges from Trust Fund reimbursements under the co -payment method of payment (except as otherwise provided in this Reimbursement Agreement); NOW, THEREFORE, in consideration of the premises and the covenants contained in this Reimbursement Agreement, Pyramid and Sparks (the "Parties") agree as follows: Im A. Pyramid's invoices are due and payable on presentation, and are past due after thirty days. Past due amounts are subject to a service charge of one and one-half percent per month (18% per annum) on the outstanding balance. Attorney's fees, court costs, expert witness fees, and ofrier costs incurred by Pyramid in collecting past due amounts shall be paid by Sparks. B. Copayment reimbursement after meeting Deductible Amount. l • After the conditions of ParagraplY A.]. are satisfied, and subject to the limitations of Paragraph BA., Pyramid will submit to DENR for reimbursement, in a form satisfactory to DENR, all Project Charges (except any Non -Fund Charges) within a reasonable time after completing a segregable portion of work as appropriate and permitted by DENR rules. 2. Since the project site Q.W. Smith's Grocery ) has been found eligible for the Trust Fund under the $20,000 deductible, and the initial $ 20,000 out-of-pocket deductible has mostly been met b Sparks, Pyramid offers to perform reasonable and necessary y ary cleanup for J.W. Smith's Grocery with Sparks on a "Co -Payment" basis. The Co -Payment agreement will be structured as follows: a. Cleanup & assessment work will be performed as required by the DENR and a Trust Fund Package will be prepared to cover the work. b. The Trust Fund Package will be submitted to Sparks for signature and notary seal. Pyramid will seek the payment of all Trust Fund eligible charges from the State, after the deductible has been met. Sparks will return the signed and notarized �+ packages to Pyramid. c. The package will be submitted under this "Co -Payment" agreement for payment directly from the State. Pyramid will sign and notarize the Trust Fund package and send the package for processing with the State. Wlien Sparks receives the Co - Payment check, it will be transmitted to Pyramid. d. As described in 3 below, Pyramid will be responsible for any project charges not reimbursed by the DENR. 3. Subject to Section A and Paragraph BA., and except for any Non -Fund Charges, Pyramid is responsible for any Project Charges submitted to DENR for reimbursement under the Trust Fund that are not reimbursed by DENR, and Sparks shall not be responsible for paying any such Project Charge. if Pyramid decides in its sole discretion to appeal the denial of reimbursement of any such Project Charge, Pyramid shall be solely responsible for the costs of the appeal; however, a•► Sparks shall cooperate in the preparation and submission of any appeal. 4. Sparks will countersign and deliver any copayment reimbursement check made out to the Parties jointly and take any other actions necessary to ensure that Pyramid obtains sole possession of and rights to reimbursements from the Trust Fund. 5. Pyramid is unable to apply for or receive reimbursement of some or all of the costs of its Environmental Services, or the reimbursement schedule is significantly delayed, because the Trust Fund is insolvent, or is diminished, modified, or otherwise reduced so that it no longer pays all "reasonable and necessary costs" as the Trust Fund correctly reimburses under the statutory scheme and the substantive and procedural rules as they exist on the date of this Reimbursement Agreement. In addition, this Reimbursement Agreement is passed on the understanding that Pyramid is the sole consultant to provide Environmental Services at the Project Site. For as long as Pyramid is performing its obligations under this Reimbursement Agreement, Sparks will not employ another consultant to conduct environmental services for or in connection with the petroleum hydrocarbon release at the Project Site. C. Other pro'cdsions. 1 • The intent of the Parties is that Sparks will pay to Pyramid an amount in Project Charges equal to the deductible established by DENR and will pay any Non -Fund Charges, but that, subject to the limitations established in Section B, Pyramid will look solely to the Trust Fund for payment of all other Project Charges. thus, once Sparks pays the Deductible Amount, Pyramid will take the risk that any Project Charge (other than Non -Fund Charges) exceeds the amount considered reasonable and necessary by DENR. However, the Parties do not intend that Pyramid should take the risk of Trust Fund eligibility, insolvency, or any significant change to the Trust Fund which would preclude, diminish, or significantly delay Pyramid's substantive or procedural reimbursement rights under the Trust Fund. 2. At the present time, the account balance in the NC Trust Fund has a significant financial deficit of approximately ( - $ 17 Million ). This will delay payments of eligible costs from the Fund for months past the package submittal date. Due to the condition of the Fund, Pyramid is forced to make allowances for interest on the Co -Payment amounts for each package. The interest will be simple interest calculated as follows: After the Trust Fund package is submitted to the DENR, interest will begin on the 91" day after subnttal. The interest will be calculated as simple interest at Prime rate +1 %. This will help to defray the costs of Pyramid's effective loan while waiting for Trust Fund reimbursement. 3. The Parties will execute and deliver such additional or other documents and take such further actions as may be reasonably necessar y to carry out fully the intent and purpose of this Reimbursement Agreement. 4.
