This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). This final permit contains no changes from the February 22, 2012 Draft permit. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits, which may be required by the Division of Water Quality, or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. The modification will include conversion of two existing ion exchange vessels into carbon filter vessels. Detailed information about the modification is provided in the attached PDF file. There is only one minor thing regarding the remediation system components that needs to be corrected. The JW Smith backwash system is a manual backwash system not a hydro -solenoid. The original permit request was for a General NPDES permit (groundwater treatment) that was rejected by the Division because of the receiving waters. The permit request was modified to provide ion exchange treatment to help with the toxicity testing required by the Individual NPDES Permit. We were concerned about ambient metals in groundwater causing toxicity. After review by the Division, the toxicity testing requirement was withdrawn from the individual NPDES Permit. At this point in time, we are still required to operate the system as approve with the ion exchange units. Based on recent changes within the Division regarding the ion exchange units we agreed that the ion exchange units may be no longer required. Before we remove the ion exchange units from the treatment process.. Pyramid requires that the DWQ approve the removal of these treatment system components for the JW Smith remediation system. Please provide a permit modification that includes this component removal for Pyramid/Sparks. We do not want to change the system and risk penalties; we need approval for this change. We are prepared to remove the system components (ion exchange units) and adjust the discharge piping upon your approval. If you are ready, we will re -pipe the system when we meet you on March 1, 2012 to by-pass the ion exchange units. The ion exchange units can be removed from the system building over the next month. Since we are in the NPDES Permit renewal phase, this time seems the most appropriate time to remove the ion exchange units from the treatment process and to reflect that change on the new permit. Please include this change in the JW Smith NPDES permit # NC0088692. If you need any additional information or clarification, please let me know. Box 16265 503 Industrial Ave. Greensboro, NC 27416-0265 v Residuals Collection, Handling, Processing, Storage & Disposal As requested by the Construction Grants and Loans Section of Division of Water Quality of North Carolina Department of Environment and Natural Resources (NCDENR), collection, handling, processing, storage and disposal of residuals generated in the product storage drum, oil water separator (OWS), bag filter, aggregate filter, carbon vessels, ion exchange vessels, and backwash filter are addressed in this plan. OR Water Separator and Product Storage Drum Free product from the OWS discharges by gravity to a 65 gallon polyethylene product storage drum installed outside of the system building. The product storage drum is equipped with a high- level switch to shut down operation of the remediation system. Residuals from the OWS and product storage drum are collected and handled by a contractor in accordance with all applicable regulations on an as needed basis. After the collection of the residuals, the contractor immediately hauls the residuals off the site. The contractor is also responsible for the proper disposal or storage/processing of residuals. Bag Filter The bag filter is changed every month during scheduled monthly maintenance events. The used bag filters are removed from the bag filter housing using disposable gloves and placed in a sealed plastic container. The used bags are immediately shipped as a non -hazardous waste for proper disposal. Pyramid is responsible for the collection, handling, and disposal of used bag filters. Aggregate Filter and Carbon Vessels The aggregate filter and carbon vessels are exchanged every six months by a contractor in accordance with all applicable regulation. Used aggregate filter and carbon vessels are immediately hauled off the site. The contractor is responsible for the residuals handling and proper disposal or storage/processing. Ion Exchange Vessels Ion exchange vessels are backwashed on an as needed basis. The backwash from the units are collected in a truck -mounted 320-gallon holding tank and transported off the site for proper disposal. Pyramid is responsible for the backwash collection, handling, and disposal. The used resin from ion exchange units is changed on an as needed basis by a contractor in accordance with all applicable regulation. The resin is immediately placed in sealed containers and removed from the site for processing and/or disposal. The contractor is responsible for proper disposal or storage/processing of the ion exchange residuals. Backwash Filter The used backwash filter media is collected and handled by a contractor in accordance with all applicable regulations on an as needed basis. After the collection of the used media, the contractor immediately removes the filter media from the site for processing and/or disposal.
