Dear Mr. Wood:
The Division received a request to modify the subject permit to correct an error by replacing the
Whole Effluent Toxicity (WET) testing requirement. Enclosed with this letter is a replacement for Part I
A. (2) of the NPDES permit for the Daniel Stowe Botanical Garden issued on January 23, 2008. Please
replace the original Part I A. (2) with the attached new version. The new version of the WET testing
requires Daniel Stowe Botanical Garden to perform monitoring only.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such
demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division
may require modification or revocation and reissuance of the permit. This permit does not affect the
legal requirements to obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, the Coastal Area Management Act or any other
Federal or Local governmental pemdt that may be required.

A. (1.) EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS (001)
During the period beginning on the effective date of the permit and lasting until expiration, the Permittee is
authorized to discharge backwash wastewater from reverse osmosis (RO) water treatment system and similar
wastewaters from outfall 001. Such discharges shall be limited and monitored by the Permittee as specified
below:

2. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units.
3. The total residual chlorine (TRC) monitoring and limit will become effective on March 1, 2008. The TRC is applicable
only when chlorination is used.
4. Whole Effluent Toxicity (Ceriodaphnia dubia) at 90 %; quarterly during March, June, September and December. See
Special Condition A. (2.).
There shall be no discharge of floating solids or visible foam in other than trace amounts.

I have a copy of the draft permit and it contains a limit. Should this be a
monitoring only?

Sounds like the statements in the first paragraph are correct - although I'd
caveat no. 2 with the approved/active pretreatment program (even if they're under
1 mgd), they'd still need to do the 2nd species test (but I'd want to know the
details to figure out where the conflict may be if there is one and if they're
getting some different info). If they're still confused - have them call here.
For the botanical garden - yes, terrible that they have to do the tox monitoring;j
(and we should have it as monitoring -not a limit). However - after an extensive
stakeholders workgroup (which Matt was party to) - all RO treated "backwash" has
to have tox testing. We can't change that - no matter that we know the tox
outcome. I totally agree with you. I'm not sure what the future holds for all.
these folks with RO tox monitoring. But these folks were lucky to get a permit of
RO discharge into fresh waters - believe it or not.

Second item is a new NPDES permit for NC Botanical Gardens outside Charlotte.
They asked for a NPDES permit to discharge the backwash from a Reverse Osmosis
system. They are using ground water that has been through a water softener
system to water the plants . The back wash water is being discharged into a
wet weather stream bed. A WET test is required for this NPDES permit. The test
is performed at 90%. He is permitted to discharge about 3600 gallons a day.
The discharge is based on temperature. If the temperature is below 50degrees
then there would be no discharge. They have a septic system for the domestic
waste. He is basically set up to fail the tox test every month because of the
nature of R.O. systems.
