Dear Ms. Beuchert:
Division of Water Resources' Central and Regional staff has reviewed the application package
received on May 24, 2023. However, additional information is required before the review may be
completed. Please address the items on the attached pages no later than the close of business on September
5, 2023.
Please be aware that you are responsible for meeting all requirements set forth in North Carolina
rules and regulations. Any oversights that occurred in the review of the subject application package are
still the Applicant's responsibility. In addition, any omissions made in responding to the outstanding items
in Sections A through D, or failure to provide the additional information on or before the above -requested
date may result in your application being returned as incomplete pursuant to 15A NCAC 02T .0107(e)(2).
Please reference the subject application number when providing the requested information. All
revised and/or additional documentation shall be signed, sealed, and dated (where needed), with an

A. Operator in Responsible Charge (ORC):
1. In the submitted application for Permit Number WQ0015515, Robert Gross Rowe, III and Robert
Patrick Barr are designated as the Grade SI ORC and Back -Up ORC respectively. However, neither
Mr. Rowe nor Mr. Barr have been designated as a Grade WW-2 ORC and Back -Up ORC for this
facility. According to public records, both Mr. Rowe and Mr. Barr have a Grade WW-2 or greater
certification. To designate Mr. Rowe and Mr. Barr as the Grade WW-2 ORC and Back -Up ORC,
please submit a Water Pollution Control System Operator Designation Form (attached). It is
important to note that the Non -Discharge Branch does not process this form. Please submit the
form to the Water Pollution Control System Operators Certification Commission (WPCSOCC) by
mail, fax, or email at the following addresses:

B. Articles of Incorporation, Declarations, and By-laws
The Articles of Incorporation, Declarations, and By-laws for Heavenly Mountain Residential
Association, Inc. were not included in the renewal application package submitted for Permit
WQ0015515. Please submit a copy of the Articles of Incorporation, Declarations, and By-laws
pursuant to 15A NCAC 02T .0115(c).
C. Attachment B — Signature Authority Delegation:
The Signature Authority listed in the renewal application for Permit WQ0015515 is "Missy
Beuchert - President". However, the Applicant's Certification and Operational Agreement were
both signed by a "Barbara Beuchert — President". Please confirm that Missy Beuchert and Barbara
Beuchert are the same person. If they are different people, please confirm who is the current
President of Heavenly Mountain Residential Association, Inc.
D. Attachment J — Civil Penalties and Outstanding Violations:
On September 23, 2022, Jennifer Graznak with the Winston-Salem Regional Office of the
Department of Environmental Quality issued a Notice of Violation (NOV-2022-PC-0554) for the
Bear Pen Village Wastewater Irrigation System. This NOV listed a violation of Permit Condition
II.1 due to concerns regarding the integrity of the above -ground storage tank. At the previous site
visit, a seep was noted around the base of the storage tank. Sampling showed the seep had similar
characteristics to wastewater that was currently being irrigated. Please provide an update on the
investigation into the source of the seep as well as plans to resolve this situation.
