As stated in that letter,the Division of Energy,Mineral and Land Resources(DEMLR) reviewed and approved the proposed revisions to Wake County 9101 Falls of Neuse Road water supply watershed protection boundary received by our office on July 29, 2022. A field survey and other supporting information documented the watershed boundary relocation. By examining site survey results and visiting the site, staff confirmed that the actual water supply watershed protection boundary lies west of the existing boundary(adjacent to Falls of Neuse Road). Additional information submitted by NCDOT(not Mr.Walt Jennette) supported the water supply watershed protection boundary change. Mr. Walt Jenrette advised that 1 obtain other information sources relevant to the proposed boundary change including those provided by NCDOT and that was the source of the mistake. I apologize for any confusion that this may have'generated. DEMLR approves these boundary changes in accordance with North Carolina General Statute 143-214.5 and North Carolina Administrative Code 15A NCAC 02B .0100, .0200, .0620-.0624. Specifically, 15A NCAC 02B .0623 (4)requires that all revisions to the water supply watershed boundaries must be approved by the Environmental Management Commission(EMC) or its designee prior to adoption by the local government.
