Thank you for allowing The Chesson Group the opportunity to respond to this Notice of Violation issued August 26, 2023;
received on September 01, 2023, regarding the fecal coliform limit violations for the June monitoring period.
First of all, we want to mention that the Fecal coliform values of 600 Colonies /100ml, reported on 6/6/2023, 6/21/2023,
6/26/2023, as well the Monthly geometric mean with a value of of 455.9 Coliform colonies /100ml, does not represent the
actual performance of the facility, in fact, the facility has been operating properly with no incidents on any of the different
parameters monitored, with the single exception of the fecal coliform.
The values obtained by the Laboratory are not congruent, this because the system is being treated with disinfectant to
eliminate any possible traces of bacteria, the TRC monitoring is sampled exactly before the outfall, and it exhibits the
presence of the disinfectant in the system. The overall concentration of Chlorine in the system has been maintained without
significative changes, but not reflecting any changes on the Fecal coliform concentration, this was brought out to the lab
and has been determined that is caused by the incorrect handling of the sample by the Laboratory new personnel, since the
same incongruent results have been detected on other systems.
It is always our goal to remain in compliance with regulations set forth by the Division of Water Resources. It is our request
that our cooperation and action in these matters be taken into account by the Division when proceeding with enforcement.
