Preston Howard, Jr., P.E., Director November 16, 1993 Mr. Thomas Fonville FMRK, Inc. p 3- o 4- o 3 3600 Glenwood Ave., Suite 150 Raleigh, NC 27612 Subject: NPDES Permit Application No. NCO066150 Brighton Forest Subdivision Wake County KivvL-,;�- wovw Mr. Fonville: On July, 9 1993 the Division sent a letter to you requesting that an Engineering Alternatives Analysis be submitted as part of the renewal package for the subject permit. In this letter it was stated that, without the Alternatives Analysis, the Division considered the renewal package incomplete. The original deadline for the submittal of this Analysis was August 9, 1993. This deadline was extended to October 18, 1993 to allow you more time to compile he report. As of this date, the Division has no record of receiving the requested analysis. Therefore, the Division considers the application incomplete and is returning the t package. Upon return of this package, FMRK, Inc. is in violation of 15A NCAC 021-1.0106 (b) which requires that all NPDES Permit renewal applications be filed at least 180 days in advance of the date on which an existing permit expires. As such, FMRK, Inc. n .issubject to a $400.00 late application fee upon submittal of a cmplete applicationpackage $250.00 non-compliance fee for failure to submit a timely renewal application. The failure to provide a proper and timely request may also subject FMRK, Inc. to enforcement action under the authority of the Environmental Management Commission If a renewal request is not received by January 31, 1994, the permit will be allowed to expire and will no longer be valid. Please be advised that discharging wastewater to the waters of the State of North Carolina without a valid NPDES permit can subject the discharger to fines of up to $10,000 per day. Please be informed that this discharge is located in a watershed where the assimilative capacity has been exhausted. In the future, the Division will most likely require that a alternative to discharge, such as a connection to the Fuquay-Varina Waste Treatment facility be pursued. P.O.
