On behalf of Piedmont Natural Gas (PNG), S&ME, Inc. (S&ME) hereby submits this Pre-
construction Notification (PCN) for temporary impacts to waters of the U.S. in accordance with
Nationwide Permit (NWP) No. 12.
PNG is planning to relocate an approximately 0.65-mile segment of their existing natural gas
pipeline (Line 209) west of Spruce Pine in Mitchell County, North Carolina. Submission of this
PCN is required because the project will take place within one of North Carolina's designated
Trout Counties. The project as proposed also requires written authorization from the North
Carolina Division of Water Resources (NCDWR), because the gasline will not cross one of the
streams at a near perpendicular angle, due to topographic and constructability constraints.
Otherwise, the work will be performed in accordance with the applicable conditions of Water
Quality Certification (WQC) No. 3884.
The project will involve no loss of waters of the U.S. In support of this application, please find
enclosed the following:

A copy of this PCN will also be provided to the North Carolina Wildlife Resources Commission
(NCWRC) office in Swannanoa, N.C., and to the U.S. Fish and Wildlife Service (USFWS) in
Asheville, N.C, in order to further coordinate potential effects to designated trout waters and
protected species, respectively.
`��� GENERAL PROJECT INFORMATION
PNG is planning to relocate an approximately 0.65-mile segment of their existing natural gas
pipeline (Line 209) west of Spruce Pine in Mitchell County, North Carolina. The purpose of the
relocation is to accommodate proposed NCDOT work that is scheduled to occur along U.S.
Highway 19 East, along which the current gasline is located. The replacement project will
originate on the south side of the highway, just west of Ned Hughes Road
(35.903217°N,82.111516°W) and extend generally southwest, where it will tie back into the
existing gasline north of Hinson Thomas Road (35.899219°N,82.117985°W). The approximate
location of the project area is depicted on the Site Vicinity Map (Figure 1), the 1994 Spruce Pine,
N.C. USGS Topographic Quad Sheet (Figure 2) and a recent Aerial Photograph dated 2010
(Figure 3).
The gasline will be relocated to a new right-of-way (ROW) that crosses primarily through
agricultural land and undeveloped woodland. The tie-in points will be located within PNG's
existing, maintained ROW. Surrounding land use is limited to low density residential areas and
undeveloped forest. The new gasline will cross two unnamed tributaries to Brushy Creek, as well
two small wetland areas. Representative photos of the project area are included in Appendix II.
�'t:�`� DESCRTPTION OF THE PROPOSED WORK
Installation of the new pipeline will first involve identification of the clearing limits, followed by
preparation of a suitable work surface where necessary. PNG will limit the proposed work to a
50-foot corridor. At stream crossings, an equipment bridge will be installed over the stream
along one side of the easement to allow equipment to work from. Removal of bank vegetation
will be conducted in a manner that minimizes soil disturbance and exposure. Appropriate
sediment and erosion control measures will be employed as necessary to prevent sedimentation
outside of the work area. To prepare a"dry" work surface for the stream crossings, a clean water
bypass will be established by constructing coffer dams upstream and downstream of the
proposed work area. A pump will then be used to convey clean water from upstream of the
coffer dam to down-stream of the work area. Water between the coffer dams will be pumped
up through a filter bag in a vegetated high ground area.

A trench will then be excavated using a small trackhoe. The top six inches of streambed material
will be segregated from the subsurface material are temporarily stockpiled on high ground.
Following installation of the new pipe, the excavated area will be backfilled, with segregated
streambed material replaced last. Affected streams and wetlands will be reconstructed and
restored as closely as possible to pre-disturbance contours and conditions, seeded with a
customized riparian seed mix and stream banks will be stabilized with coir matting. PNG does
not anticipate that the work will temporarily impact more than 110 linear feet (Ifl of streambed,
including those portions affected by placement of the coffer dams. No more than 0.008 acre of
wetlands will be temporarily disturbed. Details of the proposed work are included on Figures 4
through 9.
°�� JURISDICTIONAL AREAS
On January 21, 2015, S&ME conducted a pedestrian review of the proposed project area to
delineate jurisdictional surface waters located therein. S&ME followed the procedures set forth
in the 1987 US Army Corps of Engineers (USACE) Wetlands Delineation Manual and the Eastern
Mountains and Piedmont Region Supplemental Guidance. Field conditions were documented
using USACE Routine Wetland Determination Data Forms, as appropriate. The field review also
included identification of tributaries (streams orjurisdictional ditches) within the project area.
Drainage features identified during the field review were assessed to determine the jurisdictional
status of the tributary. Drainage features were classified as either non-jurisdictional or
jurisdictional. S&ME used the NCDWR Stream Classification Form to document characteristics
of identified drainage features on the day of the assessment.
Jurisdictional areas located within the proposed disturbance limits include two perennial streams
and small areas of riparian wetlands. The streams and wetlands were delineated by S&ME and
subsequently surveyed and mapped. The delineated boundaries were reviewed and approved in
the field by the USACE (Tasha Alexander) on April 7, 2015. Thejurisdictional limits are depicted
on Figure 3, and the Pre-JD approval letter is included in Appendix III.
The proposed project will temporarily impact two perennial stream channels (SX2 = 50 If, and
SX5 = 60 Ifl and two wetland areas (WX4 = 0.004 ac, and WX6 = 0.004 acre), as depicted on
Figures 4 and 5. The project will not result in permanent stream impacts or loss of waters of the
U.S. Permanent impacts are limited to the conversion of 0.004 acre of Wetland WX6 from
forested to emergent vegetation. Typical impact details are depicted on Figures 6 and 9.
Following construction, the temporarily affected jurisdictional area will be returned to their pre-
construction grade and contour, seeded and stabilized.
•:' ADDITIONAL REGULATORY CONSIDERATIONS
Federally-Protected Species
To comply with applicable sections of the Endangered Species Act (ESA) of 1973 (16 USC 1531-
1543), S&ME provided scoping letters to the N.C. Natural Heritage Program (NCNHP) and the
USFWS on January 27, 2015. The scoping letters included project information and maps

detailing the location of the proposed relocation. The NCNHP responded with a February 11,
2015 letter stating that their database does not show any records of rare species, important
natural communities, natural areas, or conservation/managed areas within the proposed project
area. Within one mile of the project area, the NCNHP database showed a historical element
occurrence record of superb jewelwing (Ca(opteryx amata), a state-listed rare species carrying
no federal protection.
The USFWS responded with a February 27, 2015 letter stating that they believed the project area
contained suitable habitat for the northern long-eared bat (Myotis septentriona(is). During the
summer, northern long-eared bats typically roost singly or in colonies in a wide-variety of
forested habitats, underneath bark or in cavities/crevices of both live trees and snags. Northern
long-eared bats have also been documented roosting in man-made structures (i.e., buildings,
barns, etc.) during the summer. Northern long-eared bats predominately winter in hibernacula
that include caves and abandoned mine portals.
The USFWS went on to say that a conservation measure included in the 4(d) rule states that
incidental take from forest clearing activities will not be prohibited if the activity is conducted in
a manner that avoids cutting or destroying known, occupied maternity roost trees during the
pup season (June 1-July 31). Because at that time, a final determination decision had not been
made, the USFWS recommend that no tree clearing/cutting occur between May 15 and August
15 to minimize potential impacts to the northern long-eared bat. Accordingly, PNG amended
their proposed construction schedule to avoid tree clearing until October 2015. As such, we
anticipate that a"not likely to adversely affect" determination is the appropriate conclusion, and
further consultation on the northern long-eared bat is not necessary.
Copies of the aforementioned NCNHP and USFWS letters are included in Appendix IV, and a
copy of this PCN will be submitted to the USFWS Asheville Regional Office, with a request that
they provide any additional comment directly to your office.
Historic and Archaeological Resources
On January 27, 2015, S&ME provided a scoping letter and project information to the N.C. State
Historic Preservation Office (SHPO). The SHPO responded with a February 16, 2015 letter stating
that they were aware of no historic resources that would be affected by the project, and
therefore had no comment on the project as proposed. A copy of the SHPO letter is included in
Appendix IV.
Trout Resources
On January 27, 2015, S&ME provided a scoping letter and project information to the NCWRC.
The NCWRC responded with a February 23, 2015 letter stating that there are wild rainbow trout
in the vicinity of the project area, and that stream work should be avoided between January 1
and April 15. Accordingly, PNG plans to observe the rainbow trout moratorium and avoid
conducting the necessary stream work during that timeframe. A copy of the NCWRC letter is

included in Appendix IV, and a copy of this PCN will be provided to the NCWRC, with a request
that they provide any additional comment directly to your office.
��� AVOIDANCE AND MINIMIZATION
PNG originally explored pipe installation beneath the two affected stream channels by use of
horizontal directional drill (HDD) or conventional boring methods. However, it was determined
that these options were not feasible at either location.
The Stream SX2 crossing is located on the west side of Golf Drive, approximately 1,240 feet
south of Highway US-19E. Geotechnical borings performed on either side of Golf Drive indicate
that bedrock will be encountered when crossing under the stream by either HDD or open trench
construction. An HDD of this crossing was extensively studied but ultimately determined to be
unfeasible at this location. The HDD could not be designed within acceptable entry and exit
angles due to the existing mountainous terrain and length of the drill that would be required.
To accommodate the necessary angles, the drill would need to exit near the peak of the
mountain, requiring additional wooded land that would need to be acquired and cleared in
order to string pipe for welding and pullback operations.
The Stream SX5 crossing is located just south of Highway US-19E and approximately 125 feet
from the proposed pipeline tie-in to the existing gas main, with a proposed 38-degree bend
located 50 feet beyond that. The pipeline alignment was chosen to cross the stream as
perpendicular as possible, and to minimize encroachment into the landowner's property by
locating the gas easement along the property line. An HDD is not possible in this location due
to space constraints at the tie-in location. There is not enough space to set the drill rig and get
the HDD under the stream and exit before the proposed bend in the pipe alignment. The
geotechnical report indicates the presence of partially weathered rock and bedrock at elevations
where an HDD would need to traverse through beneath the stream.
Accordingly, PNG plans to install the pipe at these locations "in the dry" through conventional
isolation and clean-water bypass methods. To further minimize impacts to waters of the U.S.,
PNG will limit the work to a 50-feet wide corridor at the stream crossings, and the width of the
permanent maintenance corridor will be reduced to 30 feet at these locations. Additionally,
construction equipment operating near the streams and wetlands will be limited to that
necessary for excavation, pipe installation and restoration activities. Vegetation near the stream
will be cut at ground level, leaving existing root systems in place to promote re-growth.
Appropriate sediment and erosion control practices outlined in the most recent version of the
"North Carolina Sediment and Erosion Control Planning and Design Manual" and approved by
the local governing authority shall be in compliance with specifications governing the proper
design, installation, operation and maintenance of such Best Management Practices (BMPs) to
comply with the appropriate turbidity water quality standard.
As proposed, the project will comply with applicable conditions of NWP No. 12 and WQC No.
3884. Following the work, the affected stream banks and wetland areas will be restored to their

original grade and contour. As proposed, the project will not result in permanent changes to
the ground surface elevation(s) in the area or affect dimension, pattern or profile of the affected
streams. Affected areas are proposed to be restored in accordance with the attached
Restoration Plan (Appendix V) following completion of the work.

3. Project Description
3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application:
A portion of the Line 209 natural gas pieline will be relocated to a new right-of-way (ROW) that crosses primarily through
agricultural land and undeveloped woodland. The tie-in points will be located within PNG's existing, maintained ROW.
Surrounding land use is limited to low density residential areas and undeveloped forest.
3b. List the total estimated acreage of all existing wetlands on the property:
Less than 0.10-acre.
3c. List the total estimated linear feet of all existing streams (intermittent and perennial) on the property:
600 linear feet of stream was delineated. Less than 110 will be affected.
3d. Explain the purpose of the proposed project:
To relocate a segment of gasline that conflicts with a pending NCDOT improvement project.
3e. Describe the overall project in detail, including the type of equipment to be used:
Construction of the new line and station will first involve identification of the work limits, followed by preparation of a
suitable work surface where necessary. PNG anticipates that the proposed work will be conducted within a corrdior not
exceeding 70 feet wide. At the stream crossings, the workspace will be reduced to 50 feet, and a"dry" work surface will
be established by constructing coffer dams upstream and downstream of the proposed work area. A pump will then be
used to convey clean water from upstream of the coffer dam to downstream of the work area. Water between the coffer
dams will be pumped up through a filter bag in a vegetated high ground area.
Efforst will be made to remove bank surface vegetation in a manner that minimizes soil disturbance and exposure.
Appropriate sediment and erosion control measures will be employed as necessary to prevent sedimentation outside of
the work area.
A narrow trench will then be excavated through the dry work area using a small trackhoe, and the new pipe installed. The
top six inches of streambed material will be segregated from any subsurface material. Following installation of the pipe,
the excavated area will be backfilled, with segregated streambed material replaced last. The affected streams and
wetlands will then be restored as closely as possible to pre-disturbance contours and conditions, seeded with a
customized riparian seed mix and banks will be stabilized with coir matting. PNG does not anticipate that the work will
cumulatively impact more than 110 linear feet (If) of streambed, including those portions affected by placement of the
coffer dams.

that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicant's acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will
provide an approved JD to accomplish that result, as soon as is practicable.

Dear Mr. Homans:
On January 27, 20l 5, we received (via e-mail) a letter from you requesting our comments about the
subject project. We have reviewed the information you presented and are providing the following
comments in accordance with the provisions of the Fish and Wildlife Coordination Act, as amended
(l6 U.S.C. 661-667e), and section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C.
1531-1543) (Act).
According to the information that you presented, PNG is proposing to relocate a 0.65-mile long
segment of existing natural gas line to accommodate proposed North Carolina Department of
Transportation (NCDOT) work where the current natural gas line exists. The existing gas line,
currently within NCDOT right-of-way, will be relocated to a new right-of-way that crosses through
agricultural and forested areas. About ],800 feet of new right-of-way will be created within forested
areas. The new gas line will cross multiple un-named tributaries to Brushy Creek and several small
wetland areas.
Endangered Species. We believe there is suitable habitat within the project area for the northern
long-eared bat (Myotis septent�^ionalis). On October 2, 2013, the northern long-eared bat was
proposed for listing as an endangered species and the project site occurs within its published range
(per the United States Fish and Wildlife Service (USFWS) — Northern Long-Eared Bat Interim
Conference Planning Guidance). i During the summer, northern long-eared bats typically roost singly
or in colonies in a wide-variety of forested habitats, underneath bark or in cavities/crevices of both
live trees and snags. Northern long-eared bats have also been documented roosting in man-made
structures (i.e., buildings, barns, etc.) during the summer. Northern long-eared bats predominately
winter in hibernacula that include caves and abandoned mine portals. It should be noted that the

general habitat types described above may not be all-inclusive, and additional habitat types may be
identified as new information is obtained.
Section 7(a)(4) of the ESA of 1973 states that "Each Federal agency shall confer with the Secretary
on any agency action which is likely to jeopardize the continued existence of any species proposed to
be listed ... or result in the destruction or adverse modification of critical habitat proposed to be
designated for such species (please note that, at this time, no designated critical habitat has been
proposed for the northern long-eared bat). This paragraph does not require a limitation on the
commitment of resources as described in subsection (d)." Section 7(a)(4) was added to the ESA to
provide a mechanism for identifying and resolving potential conflicts between a proposed action and
proposed species or proposed critical habitat at an early planning stage. While consultations are
required when the proposed action may affect listed species, a conference is required only when the
proposed action is likely to jeopardize the continued existence of a proposed species or destroy or
adversely modify proposed critical habitat. However, Federal action agencies may request a
conference on any proposed action that may affect proposed species or proposed critical habitat. The
USFWS also can request a conference after reviewing available information suggesting a proposed
action is likely to jeopardize proposed species ar destroy or adversely modify proposed critical
habitat. Please be aware that while the lead federal agency for this project is not prohibited from
jeopardizing the continued existence of a proposed species until the species becomes listed, as soon
as the listing becomes effective, the prohibition against jeopardy applies, as does the prohibition
against taking a listed species under section 9 of the ESA, regardless of the proposed action's stage
of completion. We anticipate a final listing decision for the northern long-eared bat by April 1,
2015.
On January l 6, 20l 5, the USFWS entered a proposal in the Federal Register titled "Listing the
Northern Long-Eared Bat With a Rule Under Section 4(d) of the Act". Although the USFWS has not
yet made a final determination for the northern long-eared bat, the USFWS published the 4(d)
proposal in the event that the final determination is to list northern long-eared bat as a threatened
species. A Conservation Measure included in the proposed 4(d) rule states that incidental take from
forest clearing activities will not be prohibited if the activity is conducted in a manner that avoids
cutting or destroying known, occupied maternity roost trees during the pup season (June 1-July 31).�
Because a final determination decision has not been made, and these dates may change due to public
comments, we recommend that no tree clearing/cutting occur between May 15 and August 15 to
minimize potential impacts to the northern long-eared bat. If your client will be implementing the
aforementioned tree cutting restrictions, once the northern long-eared bat is placed on the endangered
and threatened species list, our concurrence with a"not likely to adversely affect" determination can
be assumed from this letter and further consultation on the northern long-eared bat "post-listing" is
not necessary as long as circumstances remain the same. Similarly, if all tree clearing is conducted
before the species is placed on the endangered species list, the action is not likely to jeopardize the
species existence and no further consultation is necessary.
WetlandlStream Protection and Erosion Control - We are concerned with the stream-crossings
that are being proposed for this project. We assume, because a Section 404 permit is required, that
your client is proposing an open-cut/trench method far the stream crossings. From our past
experiences with similar projects, we believe this technique increases the likelihood of future lateral
movement of the stream (which could undercut or erode around the gas pipeline), and the correction

of these problems could result in additional future maintenance and impacts to the stream. Just this
year, we have reviewed several projects where PNG is conducting (and financing) stream-bank
stabilization activities because of past pipeline projects where open-cut/trenching was used for
stream crossings. Therefore, we recommend the use of directional boring under the stream to prevent
stream impacts, and we recommend that vegetated riparian buffers (a minimum of 100 feet wide on
perennial streams and 50 feet wide on intermittent streams) be restored and preserved. Directional
boring under streams significantly minimizes impacts to aquatic resources, and forested riparian
buffers serve as filters for contaminants, lessen storm-water velocities, provide thermal cover, and
protect stream-bank stability. If this method cannot be used and trenching is determined to be the
only viable option, we recommend the development of a stream-bank monitoring and maintenance
program that would allow for the prompt stabilization of stream banks near the pipeline crossing
(should any stream-bank erosion or destabilization occur) throughout the life of this project.
We strongly recommend that stringent measures to control erosion be implemented prior to any
ground disturbance and that these measures be maintained throughout project construction. Any
disturbed areas should be reseeded with seed mixtures that are beneficial to wildlife. Fescue-based
mixtures should be avoided. Native annual small grains appropriate for the season are preferred and
recommended. Biodegradable erosion-control matting should be used in conjunction with
appropriate seeding on disturbed soils in steep slope and riparian areas. Matting should be secured in
place with staples, stakes, or live stakes of native trees (whenever possible). The vegetation should
be monitored, and subsequent plantings should be installed when needed. Fertilizers and pesticides
should not be used near streams.
We also recommend that construction equipment be kept out of the stream by operating from the
banks in a fashion that minimizes disturbance to woody vegetation. Equipment should be inspected
daily and should be maintained to prevent the contamination of surface waters from leaking fuels,
lubricants, hydraulic fluids, or other toxic materials. All fuels, lubricants, and other toxic materials
should be stored outside the riparian management area of the stream, in a location where the material
can be contained. Equipment should be checked for leaks of hydraulic fluids, cooling system liquids,
and fuel and should be cleaned before fording any stream.

Biologists with the Narth Carolina Wildlife Resources Commission (NCWRC) received your January 27,
2015 letter about the PNG Line 209 Relocarion Project. You requested input from NCWRC regarding
interests of this agency with respect to trout waters. Our comments are offered for your consideration
under provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d).
PSNC intends to relocate a 0.65-mile segment of natural gas pipeline in conjunction with NCDOT
upgrades to US 19 E. This pipeline will cross an unnamed tributary (UT) to Brushy Fork. There are wild
Rainbow Trout in the vicinity of the project, and work should be avoided between January 1 and April 15.
We have the following additional recommendations:
1. Effective erosion controls should be used to minimize losses of sediment downstream. Coir matring
over seed and straw should be used on stream banks that have erodible soil. Matting used for bank
stabilization should be free of nylon mesh; nylon mesh netting frequently entangles wildlife and is
slow to degrade resulting in a hazard that may last for years.
2. The stream channel at the utility crossing should be restored to near pre-disturbance conditions.

RESTORATION PLAN
PNG Line 209 NCDOT 2519B Relocation
Spruce Pine, North Carolina
The proposed project has been designed to avoid and minimize jurisdictional impacts
where practicable. As part of mitigation for unavoidable impacts, the following plan
shall be implemented to restore temporarily-affected wetlands and streams. This plan
entails restoration of temporarily-disturbed areas to their original contours and
conditions to the degree practicable upon project completion. No fills or spoils of any
kind will be placed within wetlands or along the stream banks. Further, disturbed
wetland areas and streambanks will be permanently stabilized with a native vegetative
cover. The measures outlined below will be specified in the contract documents
prepared for construction of the proposed project.
Proposed restoration activities will include the removal of placed fill material and
restoration of original pre-disturbance contours. Excavated material shall be returned to
the trench to the extent possible, and remaining material relocated and retained on an
upland site. Excavated topsoil will be stockpiled separately, kept viable, and then
replaced uniformly over the area of excavation from which it was removed. The native
seed mix identified in Table 1 below will be utilized within temporarily-disturbed
portions of the ROW comprised of wetlands and along streambanks.
