Based upon the contractors assessment of the construction of the project... it appears that the bridge replacement can
be completed without moving the jurisdictional side channel.

Steve, Given the contractor's assessment that it can be done without impacting the side channel, I will not be submitting
a mitigation request to EEP. The project under the contractor's assessment would have no jurisdictional impacts, as any
riprap on the bank under the bridge is above average high water.

Donna, the 401 was issued in June 2015 by David Wainwright for relocation of the side channel. The NCDWR # is
20150591v.1. Will I need to submit a formal request to rescind the permit?
