Box 2210 Atlanta, Georgia 30301-2210 Dear Mr. Nouvel: edd I"N'J Ft Subject: NPDES Permit No. NCO072575 Authorization to Construct Golden Poultry WWTP Lee County A letter of request for an Authorization to Construct was received January 28, 1997 by the Division and final plans and specifications for the subject project have been reviewed and found to be satisfactory. Authorization is hereby granted for the construction of a 1.0 MGD wastewater treatment facility consisting of three (3) 900 gpm influent pumps, an 18 MG covered anaerobic lagoon lined with 60 mil. HDPE, a 17 MG emergency lagoon, a 2.4 MG aeration basin, a magnesium hydroxide feed sysetm, four (4) 1143 CFM blowers, one 78 ft. diameter clarifier, two (2) 1595 gpm return activated sludge screw pumps, one 36 foot square tertiary filter, a dechlorination basin, chlorine and sulfur dioxide feed systems, two (2) 400 gpm reuse pumps, three (3) 900 gpm return pumps, two (2) 100 pgm sludge wasting pumps and cascade aeration, with final discharge of treated wastewater into the Deep River in the Cape Fear River Basin. Issuance of this Authorization to Construct requires that dual feed lines for both chlorine and sulfur dioxide be installed. The receiving stream into which Golden Poultry discharges is an endangered species habitat. As such, dual feed lines will insure that proper disinfection and dechlorination is provided under all operating conditions. The Division understands that the operation of an anaerobic environment will generate fewer solids than operation of an aerobic environment. The Division does, however, recommend that solids accumulation in the anaerobic lagoon be monitored on a regular basis to insure continued adequate treatment volume. Should any episode of noncompliance be attributed to a power outage at the subject facility, the Division may require Golden Poultry to install emergency on -site power so as to provide at least minimum treatment at all times. This Authorization to Construct approves the treatment system at a capacity of 1.0 MGD. Should the facility wish to operate at 1.5 MGD, appropriate non -discharge permits must be secured for the additional 0.5 MGD. As part of that non - discharge permitting process, Golden Poultry must show that all treatment facilities proposed to be used in association with the non -discharge system are capable of operating at a flow of 1.5 MGD. As a condition of this Authorization to Construct, it is the understanding of the Division that discharge of effluent from the treatment system will be discontinued in the event of a significant upset condition which could reasonably be expected to cause noncompliant discharges. It is the Division's further understanding that Golden Poultry commits to disontinuing all process operations at the facility if the treatment system has not recovered from an upset/malfunction and the emergency storage pond is full. The sludge generated from these treatment facilities must be disposed of in accordance with G.S. 143-215.1 and in a manner approved by the North Carolina Division of Water Quality. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement wastewater treatment or disposal facilities. The Raleigh Regional Office, telephone number (919) 571-4700, shall be notified at least forty-eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with the NPDES Permit, this Authorization to Construct and the approved plans and specifications. Mail the Certification to the Permits and Engineering Unit, P.O. Box 29535, Raleigh, NC 27626-0535. Upon classification of the facility by the Certification Commission, the Permittee shall employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the wastewater treatment facilities. The operator must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the wastewater treatment facilities by the Certification Commission. The Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of Title 15A, Chapter 8A, .0202. The ORC of the facility must visit each Class I facility at least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and must properly manage and document daily operation and maintenance of the facility and must comply with all other conditions of Title 15A, Chapter 8A, .0202. Once the facility is classified, the Permittee must submit a letter to the Certification Commission which designates the operator in responsible charge within thirty days after the wastewater treatment facilities are 50% complete. A copy of the approved plans and specifications shall be maintained on file by the Permittee for the life of the facility. The Operational Agreement between the Permittee and the Environmental Management Commission is incorporated herein by reference and is a condition of this Permit. Noncompliance with the terms of the Operational Agreement shall subject the Permittee to all sanctions provided by G. S. 143-215.6 for violation of or failure to act in accordance with the terms and conditions of this Permit. Failure to abide by the requirements contained in this Authorization to Construct may subject the Permittee to an enforcement action by the Division of Water Quality in accordance with North Carolina General Statute 143-215.6A to 143- 215.6C. The issuance of this Authorization to Construct does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. Box 2210 Atlanta, Georgia 30301-2210 AT�:' [D FEE HNF110 Subject: Acceptance of Duality Alternative Authorization to Construct Application Number AC0072575 Golden Poultry Lee County Dear Mr. Woodruff: This letter is in reponse to the proposal discussed at the August 12, 1996 meeting between Golden Poultry representatives and Division of Water Quality staff. At that meeting, Golden Poultry requested that a 15 million gallon emergency storage lagoon be accepted in lieu of dual aeration basins. The Division accepts this alternative and agrees that the lagoon provides additional protection to the receiving stream beyond problems related to mechanical equipment failure. As part of this agreement, the Division will include, as a special condition in the permit, the language pertaining to plant shutdown similar to that proposed by Mr. Craig Bromby in his letter of August 20, 1996. The Division will also agree to modify the monitoring frequencies for the facility to Class 11 requirements during the time that Golden Poultry will only operate its overland flow system. The instream monitoring requirements are still being investigated at this time and the Division will update you on any progress. A design package incorporating the emergency storage lagoon may be submitted for review at your convenience.
