Good afternoon Roy,
Per the submitted documents on September 7, 2023, DWR has additional questions regarding avoidance and
minimization and compliance with the regional conditions of the USACE RGP291. Proposed fill depicted in the plans for
wetland impact at Lot 29, appears to be for the construction of a road/driveway crossing and DWR is requesting
clarification on the number of slips compared to lots. In accordance with 15 A NCAC 02H .0506 (b)(1) the Division shall
evaluate if the proposed activity: has avoided and minimized impacts to surface waters and wetlands to ensure any
remaining surface waters or wetlands, and any surface waters or wetlands downstream, continue to support existing
uses during and after project completion. The DWR is placing your application on hold until such time as the following
requested additional information has been provided to complete the review:
1. Avoidance and minimization; stated in your application the dock modification would provide a docking facility to
each lot owner. Yet there are 36 proposed boat slips, compared to the 35 lots. Can you please identify the need
for 36 slips instead of 35 slips and who would the 36th slip be providing docking for or deeded to?
2. Revised plan drawings show the proposed 24-inch CPP pipe buried 12 inches, it should be installed level with the
existing wetland elevation.
Pursuant to Title 15A NCAC 02H .0502(c) the applicant shall furnish all the above requested information for the proper
consideration of the application. If all the requested information is not received in writing within 30 calendar days of
receipt of this email, the DWR will be unable to approve the application and DWR will move to deny your application as
required by 15A NCAC 2H.0506.
