Good afternoon,
Per the submitted documents on September 14, 2023, DWR has additional concerns regarding the location and
discharge of Storm Water Control Measure. The proposed SCM is located almost on the sidewalk and does not show any
grading contours, also where is the discharge from this SCM located? There are two other storm water lines that appear
to collect drainage from the driveway to the west and discharge it directly to the stream, can you please clarify these or
provide more detail. In accordance with 15 A NCAC 02H .0506 (b)(1) the Division shall evaluate if the proposed
activity: has avoided and minimized impacts to surface waters and wetlands to ensure any remaining surface waters or
wetlands, and any surface waters or wetlands downstream, continue to support existing uses during and after project
completion. The DWR is placing your application on hold until such time as the above requested additional
information has been provided to complete the review:
Pursuant to Title 15A NCAC 02H .0502(c) the applicant shall furnish all the above requested information for the proper
consideration of the application. If all the requested information is not received in writing within 30 calendar days of
receipt of this email, the DWR will be unable to approve the application and DWR will move to deny your application as
required by 15A NCAC 2H.0506.

Good morning Nadean,
The only additional information needed is the location of the stormwater pond outfall and anything else NC DWR needs
clarification on. When I receive a plan showing the outfall location I can send a provisional verification that is dependent
on receiving the 401 WQC. After the 401 is received and coordinated I'll send my tear sheet verifying authorization
under the NWP 39.

Our team has been in contact with NCDOT regarding the stormwater ditch running along Western Boulevard. NCDOT is
requiring that the existing ditch be regraded and armored (similar to what is in front of the Walmart across Carolina
Forest). We have not yet applied for the driveway permit, but have been coordinating our design with DOT for the past
several months. Can you please provide additional guidance on what is being required by the Corp?

Hi Michelle and Nadean,
After internal discussion we can't require the connection between the non -jurisdictional west off -site ditch and the
project area ditch and stream. NC DOT would require a driveway permit and we fully expect them to require a driveway
pipe. Have you or the applicant been in touch with NC DOT?
I know DWR has requested a few pieces of additional info. about the stormwater pond etc. Once received I will plan to
move forward with Corps authorization unless you think there will be design changes with a DOT driveway permit that
would require a change in impact.
