The EI Group, Inc. (EI) is submitting the enclosed application for an Individual Permit to
Discharge Stormwater Associated with Industrial Activity under the National Pollutant Discharge
Elimination System (NPDES) Permitting Program for the above referenced terminal owned and
operated by Associated Asphalt Charlotte, LLC (Associated Asphalt). This application is being
submitted in response to our discussion with you using Microsoft Teams on August 17, 2023,
followed by guidance provided by Mr. Michael Lawyer of your office by e-mail on August 25,
2023.
This site is an existing petroleum distribution tenninal handling liquid asphalt that has been
considered as not discharging historically. This is due to the fact that the bulk storage tanks,
containing asphalt cement, are contained within an earthen diked area with a gate valve that is
closed under normal conditions(including normal stot to events). These storage tanks are provided
with secondary containment determined to be adequate in accordance with the 40 CF'R 112 Spill
Prevention, Control, and Countermeasure (SPCC) Plan for the facility. Additionally, asphalt
cement requires heating to remain fluid at temperatures in excess of 250' F and hardens quickly
when cooled to ambient temperatures, thereby providing "self-containment" when released.
During our Teams discussion, facility personnel reported that the gate valve had only been opened
once in the past eight (8) years when a hurricane was anticipated, and that event did not produce a
stormwater discharge.
Associated Asphalt anticipates that there will continue to be no stormwater discharge with this
closed gate valve in use. However, following receipt of DEMLR guidance, management has
decided to minimize risk by applying for an Individual NPDES Industrial Stonmwater Permit. The
application forrns and supporting documentation are included in the following subsequent section

Associated Asphalt anticipates a NPDES Permit for a bulk petroleum terminal handling liquid
asphalt only. A Stormwater Pollution Prevention Plan (SWPPP)in addition to the existing SPCC
Plan should not be required for the Charlotte Terminal,as controls and Best Management Practices
(BMPs) appropriate for bulk tank storage are adequately addressed in the existing SPCC Plan.
Stormwater monitoring conditions will need to include provisions for no flow, as there is not
discharge through the single outfall at the Charlotte Terminal during normal storm events.
Please review the enclosed application and supporting documentation to issue the requested
