$500.00. No briefcases,large totes.etc.are permitted in the file review area.
6. You may take photos of large plans with your phone camera. Necessary large plan copies can be scheduled with
Cameron.Weaver@ncdenr.gov 910-796-7265 for a later date/time at an offsite location at your expense.Requests for
large plan copies should he attached on top of the file after completion of the review. Allways Graphics can be contacted
to set up payment options.

Dear Mr. Trask:
On October 9,2019,the Wilmington Regional Office of the Division of Energy,Mineral and Land
Resources(DEMLR)inspected the subject project, in New Hanover County,to determine the status of
compliance with the State Stormwater Management Permit Number SW8 990306,last revised on October
19,2018. DEMLR file review and site inspection revealed that the site is in compliance with the terms
and conditions of this permit but needs some attention on maintenance. Please fmd a copy of the
completed form entitled "Compliance Inspection Report" attached to this letter,which summarizes the
findings of the recent inspection.
As indicated in the attached inspection report,the following maintenance issues were found:
1. Slight erosion on the southside of pond,halfway up the bank.
2. Vegetation and trash were found on the grate of inlet box, creating a mat and obstructing flow.
Please be reminded that it is your responsibility as the permittee of record to submit a completed and
signed Permit Transfer Application Form to the Division of Energy,Mineral and Land Resources 30-60
calendar days prior to making any of the below listed changes. This form is available on our website at:

program/post-construction.
a. An ownership change including the sale or conveyance of the permitted project area in
whole or in part.This does not include the conveyance of subdivided residential lots to
individuals which are made subject to a recorded declaration of covenants and restrictions
which contain the statements required by the stormwater permit;
b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's
Association,subject to the requirements of Session Law 2011-256;
c. Foreclosure proceedings;
d. Filing for Bankruptcy;
e. Dissolution of the partnership, corporate entity or LLC. Per NCGS 57D-6-07,a
dissolved LLC shall wind up, which may include continuing the business of the LLC for
a period of time. The person charged with winding up the LLC shall collect the LLC's
assets [which include the stormwater management permit], and distribute the assets as
provided in NCGS 57D-6-08(2). OR Per NCGS 55-14-05,a dissolved corporation
continues its corporate existence but may not carry on any business except that
appropriate to wind up and liquidate its business and affairs,which includes the
stormwater management permit.
f. A name change of the owner/permittee;
g. A name change of the project;
h. A mailing address change of the permittee;

Dear Mr. Trask:
On September 13,2017, staff from the Wilmington Regional Office of the Division of Energy,Mineral
and Land Resources (DEMLR)inspected Westfall Office Park, located at Sir Tyler Drive and Military
Cutoff Road in New Hanover County to determine the status of compliance with the State Stormwater
Management Permit Number SW8 990306 last renewed and re-issued on June 17,2015 with a plan
revision on March 3, 2017. DEMLR file review and site inspection revealed that the site is NOT in
compliance with the terms and conditions of this permit. Please find a copy of the completed form
entitled "Compliance Inspection Report" attached to this letter,which summarizes the findings of the
recent inspection.
As indicated in the attached inspection report,the following deficiencies must be resolved:
1. This permit covers Sections 1 and 2 of Westfall Office Park. The BUA was accounted for in the
various ponds under the 85%maximum BUA limit, however the original recorded deed
restrictions, from January 30, 2000,only referenced Section 1. Therefore,please revise your
plans for Section 2 and amend the deed restrictions as necessary.
For clarification, according to the County website, ownership is as follows:
a. Common area for Pond#4(located behind Westfall Park) is owned by Westfall Park Owners
Association, Inc.
b. Common area for Pond#1 (located behind Goodwill) is owned by Westfall Research Park 36
Acre, LLC.
c. Common area for Pond#2 is owned by Westfall Park Homeowners Association, Inc.
2. To date, only a deed of conveyance for the common areas of Pond#2 and#4 have been provided.
Additional deeds of conveyance for the common areas of Pond#1 and#3 must be submitted.
3. Only Westfall Park Homeowners Association,Inc. is registered with the NC Secretary of State
(NCSOS). Westfall Park Owners Association,Inc. needs to be registered with NCSOS.
Please reference the attached inspection report for further details on the above.
Maintenance is complete on Pond#2 and the HOA is registered with the Secretary of State, so that part of
the permit is compliant. Therefore,the offsite permit for Ashes Drive Office Building can be issued.

permit. If the requested information is not submitted to this office by the due date,then DEMLR staff
will re-inspect the site and may issue a Notice of Violation. Please also note that any individual or entity
found to be in noncompliance with the provisions of a stormwater management permit or the stormwater
rules is subject to enforcement action as set forth in NCGS 143 Article 21, including the assessment of
civil penalties of up to $25,000 per day.

Inspection Summary:
1. The recorded deed restrictions from January 30,2000 only reference Section 1 of Westfall. The permit covers Section
2, however, no recorded documentation has ever been provided which annexes Section 2 and makes those lots subject
to the January 30, 2000 recorded covenants,which have an 85%maximum BUA limit. A portion of the permitted
property was conveyed to Westfall Research Park 36 Acre, LLC.That property comprises Section 2 of Westfall,which is
covered by the permit and was accounted for in the various ponds under the 85%maximum BUA limit. However,as
previously stated,the original recorded deed restrictions for Westfall only reference Section 1.
2. The Division received a copy of the common area conveyance deeds for Ponds#2 and#4. However,the Division has
not received the common area conveyance deeds for Ponds#1 and#3.
3. There appear to be two different HOA names-Westfall Park Homeowners Association, Inc.and Westfall Park Owners
Association, Inc. Westfall Park Homeowners Association, Inc.appears on the common area deed for Pond#2 and
Westfall Park Owners Association; Inc.appears as the record owner of the common area for Pond#4. Only the Westfall
Park Homeowners Association, Inc is registered with the NCSOS.

On January 26,2017,the Wilmington Regional Office of the Division of Energy,Mineral and Land
Resources(DEMLR)inspected Westfall Office Park, located at Sir Tyler Drive and Military Cutoff Road
in New Hanover County to determine the status of compliance with the State Stormwater Management
Permit Number SW8 990306 last renewed and reissued on June 17,2015. DEMLR file review and site
inspection revealed that the site is not in compliance with the terms and conditions of this permit. Please
find a copy of the completed form entitled"Compliance Inspection Report" attached to this letter,which
summarizes the findings of the recent inspection.
As indicated in the attached inspection report,the following deficiencies must be resolved:
1. The portion of the permitted property that was conveyed to Westfall Research Park 36 Acre,LLC
has not been subjected to the recorded deed restrictions.
2. If the permittee wishes to transfer the permit,a copy of the deeds of conveyance for the common
areas of Ponds#1 and#3 must be provided.
3. If the permittee wishes to transfer the permit,please submit a completed and signed
Name/Ownership Change form.The previous request was returned on September 25,2015.
4. There appear to be two different HOA names. The common area for Pond#4 is currently owned
by an entity called the Westfall Park Owners Association,Inc.,but the conveyance for the Pond
#2 common area was made tq the Westfall Park Homeowners Association,Inc. Only Westfall
Park Homeowners Association,Inc. is registered with the NCSOS.
It has come to my attention that a pin revision is currently being reviewed to add additional project area.
Please note that there can only be one action open for a permit at one time, so the transfer of the permit to
the HOA will occur after the revised plan is approved.Thereafter,please note that all permit actions must
be initiated by the permit holder.
Please be advised that until you submit the completed and signed Name/Ownership Change Form to the
Division and receive approval from the Division to transfer the permit,you are required to comply with
the terms, conditions and limitations of the Stormwater Management Permit under Title 15A North
Carolina Administrative Code 2H .1003 and North Carolina General Statute 143-214.7, including the
operation and maintenance of the permitted stormwater system.
Failure to provide the requested information, or to respond to this letter with a plan of action, including a
timeline to resolve the identified deficiencies, by April 14, 2017,are considered violations of the permit.
If the requested information is not submitted to this office by the due date,then DEMLR staff will re-
inspect the site and may issue a Notice of Violation. Please also note that any individual or entity found
to be in noncompliance with the provisions of a stormwater management permit or the stormwater rules is
subject to enforcement action as set forth in NCGS 143 Article 21,including the assessment of civil
penalties of up to$25,000 per day.

The project was inspected as a followup to the September 25, 2015 compliance inspection. The following compliance

Section 2 of Westfall,which is covered by the permit and was accounted for in the various ponds under the 85%
maximum BUA limit. However,the original recorded deed restrictions for Westfall only reference Section 1. The

2. The Division received a copy of the common area conveyance deeds for Ponds#2 and#4. However, the Division has

Dear Mr. Trask:
On September 17, 2015, the Wilmington Regional Office of the Division of Energy, Mineral and
Land Resources (DEMLR) conducted a follow-up inspection of Westfall Office Park off Military
Cutoff Road at Sir Tyler Drive, in Wilmington, New Hanover County. The original November 13,
2014, inspection revealed a few areas of concern that needed to be addressed before the state
stormwater permit can be transferred to the HOA. State Stormwater Management Permit Number
SW8 990306 was issued on April 10, 2001. DEMLR file review and site inspection revealed that
the site is not in compliance with the terms and conditions of this permit. Please find a copy of the
completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes
the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1 The continued lack of routine maintenance for Ponds 1, 3 and 4. Other man new trash
racks on the outlet structures, and clearer access to the BMP's, little else appears to have
been done in the way of maintaining the ponds. The following specific maintenance issues
still need to be addressed:
a. The side slopes must be regraded to 3:1 or flatter,
b. The trees and woody vegetation on the side slopes of the ponds must be removed;
c. The side slopes must be stabilized with grassed vegetation. Currently, bare soil is
overlaid with accumulated pine straw and tree litter;
d. The temporary pool weir cuts in the outlet structures need to be covered by a trash
rack. Accumulated debris such as tree limbs and branches are getting stuck in the
weir openings which will lead to clogging and potential increase for flooding.
2. The slope blowout behind Pond#2 is still present. The previous repair has failed and this
area will need to be repaired again. It appears to be the low spot, so perhaps a grated
basin and pipe should be installed at that location to facilitate runoff into the ditch rather
than accumulating and eroding the slope.
3. The large tree on the forebay berm of Pond#2 needs to be removed.
4. There is a large amount of accumulated silt in the forebay of Pond#4 which needs to be
removed.
5. Pond #1 exhibited a high water level on the day of the inspection, which was 5 days after
the last rainfall. The water level should have returned to permanent pool by that time, but it
was still several inches above the orifice invert. Of greater concern is that there did not
appear to be any water movement through the outlet pipe. The cause of the high water
level needs to be investigated and resolved.

6. The emergency spillway invert for Pond #1 appears to be lower than the top of the box
and the temporary pool weir cuts. The permitted invert elevation of the spillway is 16.5.
The county's flood pool elevation is 16.3 and the state's temporary pool elevation is
15.5.
7. The original deed restrictions for this project were recorded on January 30, 2000, but
they only reference Section I as shown in MB 39 PG 238. Since Section II contains
development tracts which are covered by the permit, there should have been a
subsequent annexation of Section II and an amendment recorded, to subject the Section
II property, now owned by Westfall Research Park 36 Acre, LLC, to the January 30,
2000 covenants and to the requirements of the SW8 990306 permit. Please provide a
copy of the recorded amendment which annexed Section II and subjected it to the
January 30, 2000 restrictive covenants. If Section I I has not been annexed and/or not
made subject to the January 30, 2000 restrictive covenants, please make arrangements
to get the necessary documents signed and recorded.
8. The conveyance of the tract for Pond #4 was made to the Westfall Park Owners
Association, Inc. The conveyance of the tract for Pond #2 was made to the Westfall Park
HOA, Inc. Neither of these entities is listed with the NCSOS. The NCSOS has a listing
for Westfall Park Homeowners' Association, Inc. You may need to consider correcting
the names on those deeds to accurately reflect the corporate name as listed with the
NCSOS.
9. Your request to transfer the permit to the HOA cannot be processed at this time and is
herewith returned. The permit should be transferred to Westfall Research Park 36 Acre,
LLC as soon as possible. Once the ponds are fully restored, Westfall Research Park 36
Acre, LLC may resubmit a request to transfer the permit to the HOA.
Please inform this Office in writing before October 25, 2015, of the specific actions that will be
undertaken and the time frame that will be required to correct these deficiencies. Failure to
provide the requested information, or to respond to this letter by the due date, may initiate
enforcement action including the assessment of civil penalties of up to $25,000 per day. If a
written plan of action is not submitted to this office by October 25, 2015 then DEMLR staff will
re-inspect the site and issue a Notice of Violation if the listed deficiencies have not been
addressed.
You remain responsible for compliance with the provisions of the permit until such time as the
Division approves your formal request to transfer the permit. At the point in time when the ponds
are restored, it will be your responsibility to submit a completed and signed Name/Ownership
change form to DEMLR. This form is available on our website at:

public to safeguard these records and to carry out our day-to-day program obligations. Please read

On November 13, 2014, the Wilmington Regional Office of the Division of Energy, Mineral and
Land Resources (DEMLR) inspected Westfall Office Park off Military Cutoff Road at Sir Tyler
Drive, in Wilmington, New Hanover County to determine the status of compliance with the
State Stormwater Management Permit Number SW8 990306 issued on April 10, 2001.
DEMLR file review and site inspection revealed that the site is not in compliance with the terms
and conditions of this permit. Please find a copy of the completed form entitled "Compliance
Inspection Report" attached to this letter, which summarizes the findings of the recent
inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. The lack of routine maintenance for Ponds 1, 3 and 4.
2. The lack of access to Ponds 3 and 4 for inspection and maintenance.
3. The conveyance of the common area for Pond #2 to the Westfall Park Homeowners
Association, Inc. The Division was concerned about this conveyance as it only
represents one of the four ponds covered by the permit.
4. The potential transfer of the permit to the current owner of the remaining development
tracts, Westfall Research Park 36 Acre, LLC. Please ensure that each of the lots
subdivided from the remaining tracts is made subject to the permit requirements prior to
sale.
Please inform this Office in writing before December 14, 2014, of the specific actions that will
be undertaken and the time frame that will be required to correct the deficiencies. Failure to
provide the requested information, or to respond to this letter by the due date, may initiate
enforcement action including the assessment of civil penalties of up to $25,000 per day. If a
written plan of action is not submitted to this office by December 14, 2014 then DEMLR staff
will re-inspect the site and issue a Notice of Violation if the listed deficiencies have not been
addressed.

You remain responsible for compliance with the provisions of the permit, until such time
as you formally request transfer of the permit by submitting a completed and signed
name/ownership change form and the Division approves of the request. If the
development property associated with this project has been/will be sold or legally
conveyed to another entity or if the common areas of the project have been conveyed to
the HOA or POA, or if the permit holder has changed its name and/or mailing address, it
is your responsibility as the permittee to submit a completed and signed
Name/Ownership change form to DEMLR at least 30 calendar days prior to making the
changes.
Please be reminded that in a letter dated October 24, 2014, you were notified of the
extended effective period of the permit under SL 2009-406 and SL 2010-177. As
indicated in that letter, the permit will now expire on April 10, 2015. Please make the
necessary arrangements to download, complete, sign and submit the renewal
application as soon as possible. You can submit for both the Renewal and the
Name/Ownership Change if you check the box in Section I.0 of the Renewal application
entitled "Renewal and either: 1) a Name/Ownership Change or 2) a project name
change". Both the Name/Ownership Change form and the Renewal Application form are

Inspection Summary:
The Division conducted this routine inspection as part of the transfer of an offsite permit for Atlantic Animal Hospital.As
part of the transfer process for an offsite lot,the lot and the permitted BMP serving that lots runoff are inspected for
compliance.
As noted in the inspection report,the main compliance issues with the Westfall Office Park are:
1.The lack of access for insepction and maintenance;
2.The lack of maintenance for the 3 ponds which are still currently owned by the permittee;
3.A potential ownership change to the LLC that actually owns the property,or to the HOA,if the transfer requirements
are met.
4.Once the ponds are maintained to design condition,they will need to be recertified.

near the outlet structure on the backside of the pond that threatens to undermine the mulched footpath.
4. Ponds 1,3 and 4 are clearly not being maintained on a regular basis.
5.Access to the outlet structures of Ponds 1,3 and 4 for inspection or maintenance is difficult at best.
6.The side slopes are steeper than 3:1 in most areas and are completely overgrown with brush and
small trees.The slopes that could be observed were sparsely vegetated and exhibited Mons of erosion.

LLC..You should consider transferring the permit to that LLC.
8.The common area of Pond#2 was conveyed to the Westfall Park Homeowners Association. Inc.in
February 2009. Please be reminded that until the permittee officially requests that the permit be
transferred to the HOA and the Division approves of that transfer,maintenance of Pond#2 falls to the
permittee of record.Since all four ponds are covered under one Permit.it will not be possible to transfer
the permit to the HOA until the 3 remaining ponds are brought into compliance and all of the common
areas are conveyed to the HOA.Alternatively.the Westfall HOA could apply for their own permit for
Pond#2,but having separate permits for each pond might cause a lot of confusion down the line when it
is time to transfer the"master"permit to the HOA..

Guidelines for Access: The staff of Wilmington Regional Office is dedicated to making public records in
our custody readily available to the public for review and copying. We also have the responsibility to the
public to safeguard these records and to carry out our day-to-day program obligations. Please read
carefully the following guidelines signing the form:
1. Due to the large public demand for file access,we request that you call at least a day in
advance to schedule an appointment to review the files. Appointments will be scheduled
between 9:00am and 3:00pm. Viewing time ends at 4:45pm: ,Anyone arriving without an
appointment may view the files to the extent that time and staff supervision is available.
2. You must specify files you want to review by facility name. The number of files that you
may review at one time will be limited to five.
3. You may make,copies of a file when the copier is not in use by the staff and if time permits.
Cost per ropy is$.05 cents.Payment may be made by check,money order,or cash at the
reception desk. Copies totaling$5.00 or more can be invoiced for your convenience.
4. FILES MUST BE KEPT IN ORDER YOU FOUND 1.111LM..Files may not be taken from
the office. To remove,alter,deface,mutilate,or destroy material in one of these hies is a
misdemeanor for which you can be fined up to$500.00. No briefcases,kge totes,etc.are
pemutted in the file review area.
5. In accordance with General Statue 25-3-5I2,a$25.00 processing fee will be charged
