DEMLR file review and site inspection revealed that the site is in compliance with the terms and conditions of this permit but needs some attention on maintenance. Please fmd a copy of the completed form entitled "Compliance Inspection Report" attached to this letter,which summarizes the findings of the recent inspection. As indicated in the attached inspection report,the following maintenance issues were found: 1. Slight erosion on the southside of pond,halfway up the bank. 2. Vegetation and trash were found on the grate of inlet box, creating a mat and obstructing flow. Please be reminded that it is your responsibility as the permittee of record to submit a completed and signed Permit Transfer Application Form to the Division of Energy,Mineral and Land Resources 30-60 calendar days prior to making any of the below listed changes. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association,subject to the requirements of Session Law 2011-256; c. Foreclosure proceedings; d. Per NCGS 57D-6-07,a dissolved LLC shall wind up, which may include continuing the business of the LLC for a period of time. Trask 1202 Eastwood Road Wilmington,NC 28403 Subject: Notice of Inspection—Not Compliant Westfall Office Park State Stormwater Management Permit No. SW8 990306 New Hanover County Dear Mr. Trask: On September 13,2017, staff from the Wilmington Regional Office of the Division of Energy,Mineral and Land Resources (DEMLR)inspected Westfall Office Park, located at Sir Tyler Drive and Military Cutoff Road in New Hanover County to determine the status of compliance with the State Stormwater Management Permit Number SW8 990306 last renewed and re-issued on June 17,2015 with a plan revision on March 3, 2017. DEMLR file review and site inspection revealed that the site is NOT in compliance with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter,which summarizes the findings of the recent inspection. As indicated in the attached inspection report,the following deficiencies must be resolved: 1. This permit covers Sections 1 and 2 of Westfall Office Park. The BUA was accounted for in the various ponds under the 85%maximum BUA limit, however the original recorded deed restrictions, from January 30, 2000,only referenced Section 1. Therefore,please revise your plans for Section 2 and amend the deed restrictions as necessary. For clarification, according to the County website, ownership is as follows: a. Common area for Pond#4(located behind Westfall Park) is owned by Westfall Park Owners Association, Inc. b. Common area for Pond#1 (located behind Goodwill) is owned by Westfall Research Park 36 Acre, LLC. c. Common area for Pond#2 is owned by Westfall Park Homeowners Association, Inc. 2. To date, only a deed of conveyance for the common areas of Pond#2 and#4 have been provided. Additional deeds of conveyance for the common areas of Pond#1 and#3 must be submitted. 3. Only Westfall Park Homeowners Association,Inc. is registered with the NC Secretary of State (NCSOS). Westfall Park Owners Association,Inc. needs to be registered with NCSOS. Please reference the attached inspection report for further details on the above. Maintenance is complete on Pond#2 and the HOA is registered with the Secretary of State, so that part of the permit is compliant. Therefore,the offsite permit for Ashes Drive Office Building can be issued. The recorded deed restrictions from January 30,2000 only reference Section 1 of Westfall. The permit covers Section 2, however, no recorded documentation has ever been provided which annexes Section 2 and makes those lots subject to the January 30, 2000 recorded covenants,which have an 85%maximum BUA limit. A portion of the permitted property was conveyed to Westfall Research Park 36 Acre, LLC.That property comprises Section 2 of Westfall,which is covered by the permit and was accounted for in the various ponds under the 85%maximum BUA limit. However,as previously stated,the original recorded deed restrictions for Westfall only reference Section 1. 2. The Division received a copy of the common area conveyance deeds for Ponds#2 and#4. However,the Division has not received the common area conveyance deeds for Ponds#1 and#3. 3. There appear to be two different HOA names-Westfall Park Homeowners Association, Inc.and Westfall Park Owners Association, Inc. Westfall Park Homeowners Association, Inc.appears on the common area deed for Pond#2 and Westfall Park Owners Association; Inc.appears as the record owner of the common area for Pond#4. The original November 13, 2014, inspection revealed a few areas of concern that needed to be addressed before the state stormwater permit can be transferred to the HOA. State Stormwater Management Permit Number SW8 990306 was issued on April 10, 2001. As indicated in the attached inspection report, the following deficiencies must be resolved: 1 The continued lack of routine maintenance for Ponds 1, 3 and 4. Other man new trash racks on the outlet structures, and clearer access to the BMP's, little else appears to have been done in the way of maintaining the ponds. The following specific maintenance issues still need to be addressed: a. The side slopes must be regraded to 3:1 or flatter, b. The trees and woody vegetation on the side slopes of the ponds must be removed; c. The side slopes must be stabilized with grassed vegetation. Currently, bare soil is overlaid with accumulated pine straw and tree litter; d. The temporary pool weir cuts in the outlet structures need to be covered by a trash rack. Accumulated debris such as tree limbs and branches are getting stuck in the weir openings which will lead to clogging and potential increase for flooding. 2. The slope blowout behind Pond#2 is still present. The previous repair has failed and this area will need to be repaired again. It appears to be the low spot, so perhaps a grated basin and pipe should be installed at that location to facilitate runoff into the ditch rather than accumulating and eroding the slope. 3. The large tree on the forebay berm of Pond#2 needs to be removed. 4. There is a large amount of accumulated silt in the forebay of Pond#4 which needs to be removed. 5. Pond #1 exhibited a high water level on the day of the inspection, which was 5 days after the last rainfall. The water level should have returned to permanent pool by that time, but it was still several inches above the orifice invert. Of greater concern is that there did not appear to be any water movement through the outlet pipe. The cause of the high water level needs to be investigated and resolved. The county's flood pool elevation is 16.3 and the state's temporary pool elevation is 15.5. 7. The original deed restrictions for this project were recorded on January 30, 2000, but they only reference Section I as shown in MB 39 PG 238. Since Section II contains development tracts which are covered by the permit, there should have been a subsequent annexation of Section II and an amendment recorded, to subject the Section II property, now owned by Westfall Research Park 36 Acre, LLC, to the January 30, 2000 covenants and to the requirements of the SW8 990306 permit. Please provide a copy of the recorded amendment which annexed Section II and subjected it to the January 30, 2000 restrictive covenants. If Section I I has not been annexed and/or not made subject to the January 30, 2000 restrictive covenants, please make arrangements to get the necessary documents signed and recorded. 8. The conveyance of the tract for Pond #4 was made to the Westfall Park Owners Association, Inc. The conveyance of the tract for Pond #2 was made to the Westfall Park HOA, Inc. Neither of these entities is listed with the NCSOS. The NCSOS has a listing for Westfall Park Homeowners' Association, Inc.
