III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps maybe included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction

9. Describe the existing conditions on the site and general land use in the vicinity of the project
at the time of this application: The project site is three vacant, forested parcels of land in
downtown Cary. General land use in the vicinity of the project is primarily residential and
some commercial.

10. Describe the overall project in detail, including the type of equipment to be used:.
The proposed project is for a residential townhome community with permanent impacts
resulting from the widening; of West Chatham Street. These proposed permanent impacts are
being required by the Town of Cary Heavy equipment tXpically used for road construction
will be employed for this project.
11. Explain the purpose of the proposed work: The purpose of the proposed work is to provide
additional housing for the area. Proposed impacts to jurisdictional areas are needed in order
to widen West Chatham Street to satisfy requirements by the Town of Cary.
IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,
certifications or other useful information. Describe previously approved wetland, stream and
buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project,
list and describe permits issued for prior segments of the same T.I.P. project, along with
construction schedules.
On June 27 2005 S&EC conducted a detailed wetland delineation and Neuse River Buffer
evaluation for the entire site. On August 12, 2005, Mr. Thomas Brown of the USACE conducted
a site visit to verif~iurisdictional wetlands (Action ID# 200521210). On August 11, 2005, Mr.
Eric Kulz of the NC-DWO conducted a site visit to verify Neuse River Buffers and confirm
perennial vs. intermittent streams (NBRRO OS-2121. On September 13, 2006, an office meeting
was held at the 401/Express Permitting Unit with Am~pman, Travis Crissman of BNK,
Matthew Danielson of Beazer Homes and Debbie Edwards of S&EC, this meeting was to discuss
stormwater and diffuse flow constraints associated with this ~ 9 acre site. The details of this
meeting will be elaborated on within Section XI of this application.
V. Future Project Plans
Are any future permit requests anticipated for this project? If so, describe the anticipated work,
and provide justification for the exclusion of this work from the current application.
No additional permits are anticipated at this time.
VI. Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. Each impact must be
listed separately in the tables below (e.g., culvert installation should be listed separately from
riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts,
permanent and temporary, must be listed, and must be labeled and clearly identifiable on an

accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial)
should be shown on a delineation map, whether or not impacts are proposed to these systems.
Wetland and stream evaluation and delineation forms should be included as appropriate.
Photographs may be included at the applicant's discretion. If this proposed impact is strictly for
wetland or stream mitigation, list and describe the impact in Section VIII below. If additional
space is needed for listing or description, please attach a separate sheet.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
This proposed townhome community was designed to avoid all iurisdictional waters and
should have only required exempt riparian buffer impacts ( rig and reve e~ tating in Zone 2
not compromising the health of the existin vegetation of Zone 1) However the Town of Cary
has reauired the widening of West Chatham Street, therefore permanent impact of 115 linear
feet of perennial stream is proposed (see attached October 5 20061etter from BNK) In
addition, this was determined by the NCDWO to be a buffered perennial stream so 4 169 ft2 of
impacts to Zones 1 and 2 are also proposed. Due to the location of this existing_perennial

buffered stream and the required road widening by the Town of Car proposed impact could
not be avoided. In addition there are 5 locations (all labeled on the overall site plan) that will
include ading and reve e~ tatin~ in Zone 2 ,all of which are exempt activities because the
health of the existing vegetation in Zone 1 is not being compromised.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream. restoration in DWQ's
Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmgide.html.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
Stream mitigation is typically not required for permanent impacts less than 150 linear
feet; if stream mitigation shall be required the applicant will utilize the Ecosystem
Enhancement Program.
2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement
Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at
(919) 715-0476 to determine availability, and written approval from the NCEEP indicating
that they are will to accept payment for the mitigation must be attached to this form. For
additional information regarding the application process for the NCEEP, check the NCEEP

XI. Stormwater (required by DWQ)
Describe impervious acreage (existing and proposed) versus total acreage on the site. Discuss
Stormwater controls proposed in order to protect surface waters and wetlands downstream from
the property. If percent impervious surface exceeds 20%, please provide calculations

The impervious surface percentage is greater than 30% post construction; a breakdown of the

On September 13. 2006, there was an office meeting, held at the 401/Express Permitting Unit
with Amy Chapman, Travis Crissman and Robby Bell of BNK Matthew Danielson of Beazer
Homes and Debbie Edwards of S&EC In this meeting there were three (3Lmportant topics
discussed: 11 The existing Stormwater drainage piping onsite• 2) The site constraints with regard
to treating new impervious surface area at the southern end and a portion of the eastern side of
the.~roject site• and 3) The~roposed stormwater treatment plan The outcome of this meeting is
summarized in an attached email dated 9/13/06.
XII. Sewage Disposal (required by DWQ)

wastewater generated from the proposed project, or available capacity of the subject facility.

We have reviewed the "DRAFT Internal Policy Cumulative impacts and the 401 Water Ouality
Certification and Isolated Wetland Programs" document prepared by the NC Division of Water
uality on April 10, 2004, version 2.1. The draft states that most residential subdivisions are
unlikely to cause cumulative impacts. West Chatham Townhomes does not meet any of the three
criteria of private projects that can clearly result in cumulative impacts We anticipate that you
will advise us if a qualitative or quantitative impact analysis is required

It is the applicant's responsibility to submit the application sufficiently in advance of desired
construction dates to allow processing time for these permits. However, an applicant may

BNK began by discussing the existing conditions onsite and pointing out the existing 60" and 48" pipes that go
through the site, connecting 3 buffers together. It was discussed that these pipes were constructed in
approximately 1990 (according to the Town of Cary).
Next the group discussed what treatment measures Beazer is proposing for this site, which is a constructed
wetland. The constructed wetland will treat onsite impervious areas as well as significant offsite impervious area
on West Chatham Street and approximately 1.4 acres from across West Chatham Street. The constructed
wetland would discharge directly to the stream within the buffer at the southern end of the property (near the
intersection of Chatham and High House).
BNK outlined how Beazer proposes to reroute the existing 60" and the 48" to accommodate their development
plan for this property. The rerouting would not disturb any buffer areas because it would tie in to existing pipes
outside the buffers. BNK asked DWQ if treatment would be required for the flow conveyed by these rerouted
pipes (which have a combined drainage area of approximately 50 acres) and DWQ indicated that if the rerouting
process does not increase the flow in these pipes then the activity would be "Allowable", although not "Exempt".
DWQ indicated that when completing the Pre-Construction Notification (PCN), the determinations made by DWQ
at today's meeting should be noted.
BNK also stated that the Town of Cary is requiring Beazer to widen West Chatham Street as part of this project.
The buffer at the southern end of the property is directly adjacent to the existing and proposed right of way and
limits the ability to treat a small portion of this widened pavement. BNK provided DWQ an illustration showing that
a significant portion of the proposed widened pavement will be treated in the onsite constructed wetland as well
as an additional amount of treatment of existing pavement on West Chatham Street. The illustration indicates
that the widening will add about 1500-2000 sf of pavement, while the stormdrainage proposed for the widened
section will treat a portion of the widened pavement and a significant amount of existing pavement, totaling
approximately 18,000 sf. Additionally, this project would treat approximately 1.4 acres of area that is conveyed
onto the site via a culvert under West Chatham Street. This would bring the total amount of offsite treatment in
the constructed wetland to approximately 1.8 acres.
BNK asked if this small amount of widened pavement could go untreated since so much surplus treatment is
being provided. DWQ indicated that some research would be required and it was agreed that BNK would follow
up on this tomorrow (Thursday). A subsequent email will relay the outcome of this conversation.
BNK left the grading and drainage sheet from the plans and the illustration showing the "overtreatment" of existing
pavement on West Chatham Street with DWQ.

This letter is to provide justification for the stream impact for the buffered stream adjacent to
West Chatham Street in Cary, NC. This project is to construct 80 townhome units on a parcel
bordered by High House Road, West Chatham Street, and Old Apex Road. As part of the
project, the Town of Cary is requiring the developer to widen West Chatham Street, which will
result in impacts to the stream that is near the intersection of West Chatham Street and High
House Road. The widening of this street will require additional paving, sidewalk, curbing, and
the extension of a box culvert.
Had the Town of Cary not required widening of West Chatham Street, there would have only
been exempt impacts (grading in zone 2) for this project.

Explanation for why marsh areas do not meet minimum area repuirements~
This constructed wetland required 2 forebays to accept flow from the two storm outlets
for the project. With this wetland designed to have forebays at 20% of the total volume,
there was not 70% of the permanent pool surface area left in the main pool so it would
have been impossible to achieve the required 35% area for each of the marsh areas.
This wetland provides 25% 0-9" marsh and 28% 9-18" marsh area.
The Micropool is approximately half of the flow length of the meandering center of the
wetland. It provides 322 square feet of surface area at the bottom of it. In order to
provide as much marsh area, the micropool needed to be smaller.

't'his is the proposed Qperation and Maintenance (O&M) Plan for the extended detention
storm water wetland at West Chatham Townhomes in Cary, NC.
1, Inspeetlon Frequency
The treatment device and its structural components, to include the sediment forebays,
shall be inspected after every significant runoff producing rainfall event (roughly 0.5
inches of rainfall) and at least semi-annually. Inspections shall be performed by persons
of sufficient baekgraund and understanding of tho structure and its intended purpose.
Z. General ~nspectlon
General inspectaon activities for the extended Detention. Storm Water Wetland shall
include:
a. Inspection for trash accumulation, vegetative cover including wetlaztd plant
species, and general condition. Litter and debris shall be removed from wetland,
sediment forebays, riser trash rack and the riser drawdown oriftce.
b. Check and. clear drawdown orifice of any obstructions such that the drawdown of
the temporary pool occurs as intended by the design.
c. Inspect contributing storm water collection system (ie. piping, swales, riprap, etc.)
for condition and proper function.
d. Inspect sediment forebays ands#orm water wetland for sediment accumulations at
a minimum of every six ~nontbs and after each runoff producing rainfall event.
The depth of sediment within the forebays and wetland shall be measured during
each inspection.
3. StructuralInspectian
Structural inspections of the >~xtended Detention. Storm Water Wetland shall include the
following:
a. Inspect far erosion at the forebay inlet stabilization and outflow weir, and outlet
protection apron (at flared~end sections anal natural channel inlets). Identify any
de&cienciea with the installed. method of stabilization to include displacement of
riprap or geotextile fabric.

rack, barrel, outlet flared-and section, drawdown orifice, and low-level outlet for
general condition, deterioration, and proper operation. Inspect structure for
evidertce of cracks or leakage in structure. Maintenance (low-level) outlet valve
shall be checked for complete function during each inspection. The valve shall be
moved to the full open position for a brief period during each inspection.
4. Maintenance and Repairs
Maintenance and repair activities shall include;
a. Repair eroded areas to include embankment or perimeter slopes immediately, re-
seed as necessary tamaintain good vegetative cover. Mow embankment cover to
maintain maximum height of six inches, remove unwanted woody vegetation as
needed,
b, Make repair to contributing storm water collection system to maintain proper
function.
c. Remove accumulated sediment and debris from wetlands and basin as required
described below;
Porebays - Sedirncnt within the forebay shall be removed when the depth of
sediment reaches one-half of the forebay depth at the invert. The measuring
device used to determine the sediment elevation shall be such that it will give
rcurate depth readutg, When the depth reading indicates 2.25 feet, sediment
shall be cleaned out of the forebays.
Storm Water Wetland - If the elevation of the marsh area exceeds the
permanent pool elevation by more than 12 inches (other than as designed), the
Wetland shall be regraded to design levels (~" to 12" above peaxnanent pool).
Thin shall be performed by removing the upper 6 inches of soil anal
stockpiling it. Then the marsh area shall be excavated to the permanent pool
elevation. Afterwards the stockpiled sail should be spread over the marsh
surface such that its elevation ranges between 0" and 6" above the permanent
peal, The sail should not be stockpiled for more than two weeks. Replant
wetland surface as described in construction drawings.

and shall be handled In a manner that will not adversely Impact water
quality.
d. Remove cattails and other indigenous wetland plants when they cover 25% of the
wetland surface. These plants may be encouraged to grow along the edge ofthe
wetland and the forebay berm as long as they do not interfere with hydraulic
function or out-compete desired (see planting plan) plant species.
e. Wetland plant densities and species shall be maintained and re-planted i.n bare
areas as needed. 'W'ater newly pleated species at a rate of not less than l-inch per
week (includir-g rainfall) for a period. of 9Q days at>:er planting.
f. Water entire storm. water wetland planted area as necessary during periods of
drought to ensure plant health and vegetation density,
g. IPthe wetland must be drained for an emergency or far maintenance purposes, fire
flushing of sediment through the emergency drain shall be minimized to the
maximum extant practical.
It shall be the responsibility of the Owner to schedule the repair of any deficiencies noted
during an inspection,
A permanent maintenance and inspection easement will be granted to NCl])rNR --
Division of Water Quality (D'UV'Q) and maintained by the Owner to provide access to the
storm water wetlands. It will be the respansibili.ty ofthe Owner to secure the appropriate
agreerrtcnts with future owners should the property be subdivided or sold. Inspections
and maintenance (routine or otherwise) and their scheduling will be the responsibility of
the Owner.
