Dear Mr. Denton,
May this letter and attached documents serve our formal response to the Notice of Violation
stemming from Lauren Garcia's visit to the Wolfspeed mega-site on June 16, 2023.
Action Items
1. The spilled slurry should be cleaned up immediately.
a. Whiting-Turner's cleanup response letter with photographic evidence dated June
19, 2023
b. Subsequent cleaned up area photos also included dated June 27 and July 7, 2023.
2. Submit an official plan detailing how contact water and/or wash water will be
managed onsite at the temporary batch plant.
a. As described in the original NO[, the eco-pan washout system is back in use.

Chandler Concrete Co., Inc. has partnered with Wayne Brothers and Whiting-Turner on
this site to build Wolfspeed's new microchip production facility, which includes our portable on-
site ready-mix concrete plant. Wayne Brothers has contractually agreed to maintain the
washdown system which included the servicing of the eco-pans used for washout. The pit
system adhered to the intentions of maximally minimizing process water on site as much as
possible.This methodology provided a cost-effective process water management solution to
meet ongoing demands.
The events that prompted the Notice of Violation were made by non-Chandler
employees who received inadequate instructions or acted on their own accord. The individuals
pumping process water from the pit into a ditch area not covered by our permit was an isolated
incident.
Chandler, Wayne Brothers and Whiting-Turner are committed to working together to
prevent a similar recurrence and to maintain full environmental compliance throughout the site.
The washdown pits are filled and the eco-pans are currently being utilized as intended in the
original NOI.
