Accordingly,we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S.Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
This final permit includes no major changes from the draft permit sent to you on May 9,2007.
If any parts,measurement frequencies or sampling requirements contained in this permit are
unacceptable to you,you have the right to an adjudicatory hearing upon written request within thirty(30) days
following receipt of this letter. This request must be in the form of a written petition,conforming to Chapter
150B of the North Carolina General Statutes,and filed with the Office of Administrative Hearings (6714 Mail
Service Center,Raleigh,North Carolina 27699-6714). Unless such demand is made,this decision shall be final
and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits
required by the Division of Land Resources,the Coastal Area Management Act or any other Federal or Local

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or
discharge are hereby revoked. As of this permit issuance, any previously issued
permit bearing this number is no longer effective. Therefore, the exclusive authority
to operate and discharge from this facility arises under the permit conditions,
requirements, terms, and provisions included herein.
Vulcan Construction Materials, LP is hereby authorized to:
1. Continue to operate three settling cells with recycling pumps (for wash water)
and filtering ponds (for wash water and pit water flow). This facility is located
north of Stoneville on NCSR 1518 at the Stoneville Quarry in Rockingham
County.
2. Discharge from said treatment works at the location specified on the attached
map into an unnamed tributary to Buffalo Creek, classified WS-IV waters in the
Roanoke River Basin.

A. (1.) EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS — EVA FT
During the period beginning on the effective date of this permit and lasting until expiration, the Permittee is
authorized to discharge from outfall 001. Such discharges shall be limited and monitored by the Permittee as
specified below:

1. Effluent samples shall be collected upstream of NCSR 1518, directly after the settling basin. Samples must
be collected after rain events.
2. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units.
Best Management Practice Conditions shall be as follows:
• The permittee shall operate the facilities in a manner that minimizes the impact of
any discharge on the receiving stream.
• The permittee shall utilize the necessary management practices to prevent
contaminants from entering the surface waters as a result of blasting at this site.
• All settling basins shall be cleaned when the only remaining alternate (operating)
basin approaches 80% capacity.
There shall be no discharge of floating solids or visible foam in other than trace amounts.
A. (2.) ENGINEERING REPORT
Within two months of notification from the Division, an engineering report evaluating the
dredging of the first settling basin from the pit area (or the construction of a new settling
basin) will be required. Continued build-up of the berm surrounding this basin could
increase the turbidity and settleable solids within the discharge. This report should
include documentation of the soil disposal procedures from any dredging.

Dear Ms. Bryant,
Vulcan Materials Company requests renewal of NPDES Permit NC0027987. Enclosed please
find one original and two copies of the Cover Letter, Application Form and Sludge Management
Plan.
The facility has been inactive during the current permit cycle, with no wastewater discharges
occurring. There are no plans to activate the facility in the near future. The permit is maintained
for possible future activities.
Vulcan also requests the continued waiver of monitoring requirements for the renewed permit.
This request is allowed by 15A NCAC 2B .506(E) which states (In situations where no discharge
has occurred from the facility during the report period, the permittee is required to submit a
monthly monitoring report giving all required information and indicating "NO FLOW'unless the
Director agrees to waive the reporting requirement during extended conditions of no discharge.)
The current waiver was granted in May of this year, a copy is enclosed.

North Carolina General Statute 143-215.6 (b)(2) provides that: Any person who knowingly makes any false
statement representation, or certification in any application, record, report, plan, or other document files or
required to be maintained under Article 21 or regulations of the Environmental Management Commission
implementing that Article, or who falsifies, tampers with, or knowingly renders inaccurate any recording or
monitoring device or method required to be operated or maintained under Article 21 or regulations of the
Environmental Management Commission implementing that Article, shall be guilty of a misdemeanor
punishable by a fine not to exceed $25,000, or by imprisonment not to exceed six months, or by both. (18
U.S.C. Section 1001 provides a punishment by a fine of not more than $25,000 or imprisonment not more than

SLUDGE MANAGEMENT PLAN
STONEVILLE QUARRY
As a normal course solids (stone fines) from wastewater settling ponds are excavated and
spread out to dry. Once dry the sludge (stone fines) is taken to the onsite overburden
(excavated soil that overlays stone reserves) storage area and layered into the fill.
The drying and overburden storage areas are protected by erosion and sediment control
measures that are approved by the Division of Land Quality as required by our Mine
Permit Number 70-09. Collected solids in all erosion control measures are treated in like
matter.
This facility is inactive at this time and therefore no wastewater sludge management is
expected in the foreseeable future.

The Division has reviewed your correspondence dated April 18, 2006, which states the subject facility is not
being operated and therefore is not producing a wastewater discharge. You indicated the facility will
remain inoperablewhile future options for the facilityare evaluated.

After reviewing your letter and considering the recommendations of the staff in the Winston-Salem
Regional Office, I have agreed to waive the requirement to submit monthly DMRs for the subject facility,
effective May 1, 2006. The DMRs up through (and including)April 2006 should be submitted as usual.
Please be advised if and when a discharge resumes, the discharge must be monitored as per the terms of
the NPDES permit and other applicable rules or statutes. Please keep the Winston-Salem Regional Office
apprised of any pertinent developments that arise regarding this facility, especially if the facility is re-
activated.
Be advised that while requirements for operator visitation, monitoring and reporting are being waived
during the period of no discharge,the permittee is still required to pay the Annual Administering and
Compliance Monitoring Fee that is associated with this and all NPDES permits.

the abovementioned permit. This request is allowed by 15A NCAC 2B .506(E) which states (In
situations where no discharge has occurred from the facility during the report period, the
permittee is required to submit a monthly monitoring report giving all required information and
indicating "NO FLOW'unless the Director agrees to waive the reporting requirement during
extended conditions of no discharge.)
The facility has been inactive during the current permit cycle, with no wastewater discharges
occurring. There are no plans to activate the facility in the near future. The permit is maintained
for possible future activities.

STONEVILLE QUARRY
As a normal course solids (stone fines) from wastewater settling ponds are excavated and
spread out to dry. Once dry the sludge (stone fines) is taken to the onsite overburden
(excavated soil that overlays stone reserves) storage area and layered into the fill.

measures that are approved by the Division of Land Quality as required by our mining
permit. Collected solids in al
l erosion control measures are treated in like matter.
This facility is inactive at this time and therefore no wastewater sludge management is

Recommend renewal of NPDES permit with existing limits and with changes noted above. Facility
consists of settling cells and filtering ponds for wash water and pit flow. Facility is a granite crushing for
gravel operation.
Presently facility is inactive and no discharge is expected in the near future. Regional office will be
notified when the facility is reactivated. DMRs show no discharge from 1993 untii present.
Water classification change in 1992. Thgis reclassification does not affect existing limits, thus no changes
required. Language requiring an engineering analysis was put in effluent page of last permit with no dates
specified for submittal. To date no report has been submitted. Therefore,this requirement is being moved
to a special condition and a submission date of two months after DWQ notification is being given. If the
plant reactivates and their discharge causes turbidity or settleable solids problems, they can be made to
evaluate dredging of the first settling basin or constructing a new settling basin. Either of these options
should improve the effluent charged.

In accordance with the application for a discharge permit received on September 4, 1996, the
Division is forwarding herewith the subject NPDES permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
North Carolina and the U.S.Environmental Protection Agency dated December 6, 1983.
The Division received your comment letter dated December 31, 1996,pertaining to the elimination of
the Engineering Report,the addition of a footnote for Monitoring Requirements, and the requirement of a
stormwater permit.
Due to concerns with poor solids settling within the settling ponds and the potential to significantly
increase the turbidity of the discharge from the ponds the Winston-Salem Regional Office recommended
inclusion of the requirement for the engineering report upon DWQ's notification. Since there is potential
for this discharge to cause turbidity problems in the receiving water(classified as Water Supply IV waters)
the Division reserves the right to require the permittee to evaluate alternatives to improve settling of solids
in the discharge. While the Division does not see a need for the report at this time, the requirement to
complete an engineering report after notification by DWQ must remain in the permit.
As with facilities with similar discharges, the DWQ requires that an ORC certify that no discharge
has taken place monthly. Therefore, the footnote you recommended for inclusion(to only submit DMRs
for those months when discharges take place)can not be added. Incidentally, the monitoring frequencies
in the general permit for mine dewatering are also monthly.
A stormwater permit is required if there is any point source discharge from the areas associated with
industrial activities due to precipitation or mine dewatering. If stormwater is discharged from your site
from outfalls other than the outfall now permitted by this NPDES permit then you are required to obtain a
stormwater permit.

unacceptable to you,you have the right to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this letter. This request must be in the form of a written petition,conforming to

II, III and IV hereof.
The permit shall become effective June 1, 1997

BMP Conditions shall be maintained as follows:
1. The permittee shall operate the facilities in a manner which will minimize the impact on the receiving waters.
2. The permittee shall utilize sound management practices to ensure that contaminants do not enter the surface waters as a result of blasting at this site.
3. All settling basins shall be cleaned out whenever the only remaining alternate (operating) basin is approaching 80%full.
An Engineering Report shall be required as specified in Part I, Special Condition A. (2).
There shall be no discharge of floating solids or visible foam in other than trace amounts.

A. (2). ENGINEERING REPORT
Within two months of DWQ notification, an engineering report evaluating the dredging of the first settling
basin from the pit area or the construction of a new settling basin will be required. Continued building up
of the berm surrounding this basin carries a strong potential for increasing the turbidity and settleable
solids contained within the discharge and therefore alternatives must be evaluated. Along with this report
documentation of the spoil disposal from the dredging should accompany the results.

History
File
Facility has history of turbidity and potential nutrient problems. WLA from early '80's attempted full-range nitrogen
and total phosphorus monitoring due to fish kills downstream. Unfortunately, documentation and site evaluation
techniques were not very rigorously pursued, (e.g. no fish tissue analysis, no evaluation of surrounding pond happenings,
dramatic climate variations not accounted for, etc.) and the facility was able to skirt any attempt at permit modification.
Staff Report and conversation with Ron Linville [W-S ROl
Facility is a granite crushing operation for gravel production. All three settling ponds have a grey, cloudy look;
obviously no settling is taking place. Much of this may be due to their construction. When the initial pond gets filled, the
facility increases the height of the bern, (earthen dam) encasing the pond. This causes a "stair-stepping" effect on the
ponds that follow and does not allow for any settling to take place. Turbidity levels as high as 70 NTU have been taken at
the sampling point, (refer attached map to Staff Report). The sampling site is after three (3) settling pond, a "wetland-like"
filtering dam area, and another settling basin; the effluent should be very clean and clear after this many impoundments...
Unfortunately, exacerbating this situation is the fact that the permit has a 50 NTU Turbidity limit as a daily average
not a maximum; W-S RO request this to be changed. Linville also would like language to require sampling be taken after
a rainfall event as this is what is really causing the problems. If we can, W-S RO would like the Fact Sheet to suggest that
the Engineer for Vulcan Materials look into the design of the settling ponds and make whatever changes are necessary to
stop the "stair-stepping" situation of discharge from one pond to the next. This may need to be required in the permit as
the #1 settling pond is at 80-90% of capacity. Language should require either a dredging of this pond, with a permitted
carrier and dump site location for the spoil, or the requirement to build a new lagoon; continued building up of the berm
should not be allowed...
The Fact Sheet will contain language recommending possible nutrient monitoring if continued problems are
documented in this area. Linville feels facility will comply with changes to rectify the NTU problems they have been
having, but if we push them too hard, (especially w/ regards to nutrients which proved to be such a problem enforcing in
the past) then the facility will fight any possible upgrades. Due to documentation of possible nutrient problems in the past,
I would like to have a paper-trail present for any possible need of such limits in the future. As pointed out by Linville,
explosives involve various nitrogen compounds.

SUBJECT: Allocation for Vulcan Materials, Stoneville
Rockingham County
In the past, this quarry dewatering discharge has been discussed in
connection with water quality in the two Watkins Ponds below the discharge.
In February 1981, an investigation of a fish kill in the ponds was made
by DEM. The report issued as a result of this investigation showed
excessive nutrients, particularly nitrogen, in the pond and upstream.
Since the date of the report, there has been a significant decrease in
the nutrient content in the ponds and feeding stream. It is likely
that operating procedures at the facility changed. Therefore, we do not
believe it is necessary to include nutrient limitations in the Vulcan
Materials permit at this time. However, we do feel that nutrient
monitoring should be required in order to remain aware of any further
changes in the water quality of the effluent.
