The discharge pipe from the facility has been re-route to an existing manhole,thus all subsequent waste from the plant will discharge to the sewer. However,the existing holding basin for filter backwash was still holding wastewater and was still capable of discharging to surface waters as the outfall had NOT been plugged and/or grouted at the time of this inspection. I recommend that permit rescission not be granted until the subject holding basin has been pumped out and the outfall plugged therefore eliminated the capability of discharge. I will draft a letter outling my findings in subject inspection to send to permittee and copy you on it as well, but I did want to get you an answer ASAP. April 25, 2016 Mark Delehant Stokes County Stokes County PO Box 20 Danbury, NC 27016 Subject: NPDES Electronic Reporting Requirements and Sixty Day Notice of Minor Modification of the NPDES Permit Danbury WTP NPDES Permit Number: NC0043290 Dear NPDES Permittee: The U.S. Environmental Protection Agency(EPA) recently published the National Pollutant Discharge Elimination System (NPDES) Electronic Reporting Rule.The rule requires NPDES regulated facilities to report information electronically, instead of filing written paper reports.The rule does not change what information is required from facilities. It only changes the method by which information is provided (i.e., electronic rather than paper-based). EPA is phasing in the requirements of the rule over a 5-year period. The two phases of the rule, and their key milestones, are: • Phase 1—Starting on December 21,2016, regulated entities that are required to submit Discharge • Monitoring Reports (DMRs) will begin submitting these reports electronically. If you are currently reporting your DMR data electronically using eDMR,then you simply need to continue reporting in the same way as you are now. The key change is that, starting on December 21, 2016, electronic reporting of DMRs will be required, instead of voluntary. • Phase 2—Starting on December 21, 2020,regulated entities that are required to submit certain other NPDES reports will begin submitting these reports electronically. Reports covered in the second phase include Notices of Intent to discharge in compliance with an NPDES general permit, Sewer Overflow/Bypass Event Reports, and a number of other NPDES program reports. Under the new rule,the electronic reporting process supersedes the paper reporting process outlined in your existing permit. The primary purpose of the facility is to provide disinfection and remove iron and manganese from the source water. Chemicals added to the water in the treatment process include sodium hypochlorite, sodium hydroxide, and potassium permanganate. Filter backwash water is discharged to an on-site holding basin that allows some settling time and flow equalization. De-chlorination is provided by sodium sulfite erosion tablets located at the holding basin discharge. Sludge Management Stokes County does not have a sludge management plan for the Danbury WTP. The solids content of the backwash water is very low and the treatment process itself does not generate any sludge. As such, the County has not needed to remove any solids from the holding basin since taking over the facility. Well #2 is the only town well (of the two)that use a green sand filter and therefore have a backwash discharge. It's already written into the permit, I believe,that monitoring is only necessary when there is a discharge...that is the only time that it's possible to monitor...is it not? When I first read this permit, the statement that's currently in there confused me and I had to get clarification from the town on what it meant. I wasn't aware there was another well in the town that was their primary use well. Now I know that, but I don't care. Well#2 is the only one with a permit and a discharge. If it discharges, then they have to monitor. If not, then they don't and can't.That's pretty simple. Why confuse the matter with a statement that attempts to designate certain times when they have to monitor their discharge. They have to monitor at ANY and at ALL times that there is a discharge. Something that I think may be confusing some of you that haven't seen the facility—well#2 is a completely separate facility from well #1.They're not even interconnected, except thru the potable water distribution system. I don't even know where well#1 is.Well #2 is by itself with its green sand filter. So when the facility discharges, it's from well#2 and well#2 only. So the statement, "If facility discharges backwash water derived from Well#2,then monitoring and effluent limits apply. ", is misleading because it can only derive a backwash discharge from well#2.This statement infers that it may be able to derive a backwash discharge from one or more wells other than well#2, but it cannot. The statement that is currently in the permit is even worse: "Should Well Site#2 become active as a primary water source (as opposed to serving as a back-up),the Town should immediately notify the Winston-Salem Regional Office and begin monitoring the wastewater discharge as required by this permit." Now this statement basically says that as long as the permittee calls well #2 a backup, then they don't have to monitor at all. It doesn't matter how many hours per day each well is used, how many hours per day well #2 discharges backwash wastewater, or anything.They could use well#2 1 • 24 hours/day and well#1 1 hour/day, but as long as they still call well #2 the backup, they don't have to monitor any backwash discharge from the filter at well#2.The permit does not define primary/secondary in any way,shape or form. I say remove the statement from the permit entirely.The town needs to monitor at all times when there is a discharge just like any other permittee does and just like the permit would clearly say if we removed the statement in its entirety. On the other hand, if we don't want to require them to monitor their discharge, be a classified facility, or have a ORC/BORC, then why do we bother giving them a permit that says they have to do all this stuff??? Seems like the permit language could use some tweaking as well and it really should not matter if one is a primary and one a secondary if they are operating the system.....the permit/limits/monitoring should apply. Guess I'm of the opinion that if they are worth the time and effort to permit, inspect and be responsible for compliance, then they should have a WW ORC not an Water Treatment responsible for the discharge of waste products... Now on the other hand, if we feel the Certified Water Treatment program is sufficient to substitute for our WW certification for WTPs then let's just make that provision across the board for any and all WTP discharges to surface waters. Or we could just deem Green sandfilters a deminimus discharge and not fool with the permitting nor compliance nor classification unless they become a WO problem. It also tells me that the regions need to spend a little more time looking over draft permits, especially the part that list the treatment components of a facility. Well#1 operates for about 12 HPD and well #2 operates for about 6 to 8 HPD. Of course,the operators have to backwash the greensand filter at well#2, and as a result they produce approximately 3K GPD of backwash wastewater,which flows into a settling, or sludge lagoon, and is then dechlorinated using a tablet dechlorinator prior to discharge. I believe both of these processes qualify as a form of wastewater treatment. The permit for well#2 currently requires them to monitor flow,TSS,TRC, FI,total Fe,total Zn, total Mn and pH. They have a 30/45 limit for TSS, a 17 microgram limit for TRC, and of course the typical pH range limit. However,there is a note in the footnotes section that reads, "Should Well Site#2 become active as a primary water source (as opposed to serving as a back-up),the Town should immediately notify the Winston-Salem Regional Office and begin monitoring the wastewater discharge as required by this permit." The permit does NOT define primary/secondary, so whether or not well#2 is considered primary or secondary is apparently decided by the permittee.This statement caused some slight confusion during last year's inspection and I thought I'd worked it out, but I got further clarification from the PWD just this morning. So, essentially,the county/town does NOT have to do anything this permit says until the permittee says that Well#2 is their primary water source. I don't know whether Public Water has any criteria by which primary/secondary is decided. Primary or secondary should not matter. They are operating and utilizing both and have discharges from both that are permitted by us.(SWT) So, despite the newly clarified revelation that the permit simply doesn't matter until the permittee says Well#2 is their primary water source, my initial assessment about the wastewater still holds true, as far as I can see.The Danbury WTP DOES have wastewater treatment processes and units, which requires classification of the facility and a certified operator. However,they don't have to do any of the monitoring in the permit until the feel like it...which is something better addressed with Charles on another day. If we're not going to enforce this permit then I suggest we simply, rescind it (not sure EPA would agree). Heck, there a lot of WTPs out there that meet this same criteria...we could significantly reduce our workload by rescinding all of them. F �i Habitat Conservation Program DATE: April 19, 2007 SUBJECT: Wastewater Treatment Plant (WWTP) Permits—Dan/Roanoke River Basin Biologists with the North Carolina Wildlife Resources Commission (NCWRC) have reviewed NC Division of Water Quality (DWQ) notices for the proposed issuance of WWTP permits for potential impacts to fish and wildlife. Biologists with the NCWRC are familiar with habitat values in the area. The NCWRC is authorized to comment and make recommendations which relate to the impacts of this permit or project to fish and wildlife pursuant to Clean Water Act of 1977, North Carolina Environmental Policy Act, US National Environmental Policy Act, Endangered Species Act (16 U. S. C. 1531-1543; 87 Stat 884), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and/or Federal License of Water Resource Project Act(Federal Power Act-16 U.S.C. 791a et seq.) as applicable. DWQ is in the process of issuing and/or re-issuing National Pollutant Discharge Elimination System (NPDES) permits for several WWTPs that discharge into the Dan/Roanoke River basin. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) have reviewed the location of these sites and have determined that additional scrutiny is appropriate for ammonia, chlorine, and copper. The specific NPDES permits we have reviewed are: • Cains Way Homeowners Association(NC0075027) • Horizons Residential Care Center(NC0056791) • Kobe Wieland Copper Products,Inc. (NC0035173) • Stokes County Board of Education(NC0044954, NC0044962, NC0087980) • Town of Danbury(NC0043290) • Twin Lakes Mobile Home Park(NC0057720) Chlorine & Ammonia Concerns- Chlorine is acutely toxic to aquatic organisms and forms secondary compounds that are also detrimental to aquatic life,especially eggs and juveniles. We also have concerns regarding daily ammonia concentrations. Recent research by Augspurger et al. (2003) found that ammonia concentrations which may be protective of freshwater mussels range from 0.3 to 1.0 mg/L total ammonia as N at pH 8. Copper Concerns - Treated wastewater from Kobe Wieland Copper Products Inc. is discharged to an unnamed tributary that flows into the lower portion of the Dan River, a Significant Aquatic Resource as designated by the North Carolina Natural Heritage Program. The Dan River provides diverse species habitats and harbors several State and Federally listed mussel and fish species, including the James (River) Spiny Mussel, Pleurobema collina (State Endangered, Federal Endangered). There are recent records (2001) for the Green floater, Lasmigona subviridis (State Endangered, Federal Species of Concern) recorded in the NCWRC Aquatics Database. These records are directly below the confluence of the aforementioned unnamed tributary to the Dan River. Although the James (River) Spiny Mussel has not been reported in this lower section of the Dan River, the possibility strongly exists since the Green Floater is a common species associate of the James (River) Spiny Mussel in the Dan River. The discharge of copper to the unnamed tributary is an immediate concern for both mussel species. In a 28-day chronic Copper toxicity experiment, Wang et al. (in press) demonstrated that as little as 12-21 micrograms of copper per liter of water (0.012-0.021 milligrams/liter) results in an LC-50 (concentration that kills 50% of the animals in the sample; i.e., Lethal Concentration) for several species of native juvenile freshwater mussels. This research suggests that mussels are more sensitive to copper pollutants than other taxa (e.g., fish and microcrustaceans). Monitoring records indicate that on December 31st, 2006 Kobe Wieland Copper Products Inc. discharged an average of 136 micrograms of copper per liter of water (0.136 milligrams/liter) from pipe 001 and 380 micrograms of copper per liter of water (0.380 milligrams/liter) from pipe 003 (data extracted from E.P.A. Enviro facts Data Warehouse). Those discharge concentrations are well above detrimental levels for juvenile freshwater mussels according to recent research(Wang et al. in press). The following recommendations should be evaluated and incorporated into these and other NPDES permits as appropriate to avoid and reduce potential impacts to fish and wildlife resources, especially in areas known to support listed and highly sensitive species: 1. Only non-chemical disinfection like ultraviolet or ozone should be permitted and used. Chlorine should be expressly prohibited from any use (including emergency operations) at the WWTP. This should provide the additional benefit of removing hazardous materials from the environment and the workplace. 2. Ammonia limits should be reduced to the maximum extent practicable. Ammonia and pH monitoring should be required daily. Daily composite sampling may be appropriate. 3. If not already in place, we recommend provision of automatic stand-by power generation to prevent plant emergencies and upsets caused by power outages. 4. If publicly owned collection systems and treatment works (POTW) become available, these facilities should be required to connect to the POTW without delay. 5. Kobe Wieland Copper Products, Inc. and any other NPDES permits with copper issues should have reduced copper limits to avoid potential impacts to aquatic species, especially where federally listed aquatic species are known within the watershed. Although other factors may also contribute to aquatic habitat degradation, we believe the above evaluations and prevention measures are appropriate. A004 DEFIN1fIONS The following definitions shall apply throughout this Subchapter. (1)Activated Carbon Beds. A physicaVchemical method for reducing soluble organic material from wastewater effluent;The column-type beds used in this method will have a flow rate varying from two to eight gallons per minute per square foot and may be either uptlow or downflow carbon beds. Carbon may or may not be regenerated on the wastewater treatment plant site; (2)Aerated Lagoons. A basin in which all solids are maintained In suspension and by which biological oxidation or organic matter Is reduced through artificially accelerated transfer of oxygen on a flow-through basis; (3) Aeration. A process of bringing about Intimate contact between air or high purity oxygen In a liquid by spraying, agitation or difluslon;(3a) Extended Aeration. An activated sludge process utilizing a minimum hydraulic detention time of 18 hours. (4)Agriculturally managed site. Any site on which a crop Is produced, managed,and harvested (Crop includes grasses,grains,trees, etc.); (5)Air Stripping. A process by which the ammonium Ion Is first converted to dissolved ammonia (pH adjustment)with the ammonia then released to the atmosphere by physical means;or other similar processes which remove petroleum products such as benzene,toluene,and xytene; (6)Carbon Regeneration. The regeneration of exhausted carbon by the use of a furnace to provide extremely high temperatures which volatilize and oxidize the absorbed impurities; (7) Carbonaceous Stage. A stage of wastewater treatment designed to achieve 'secondary'effluent limits; (8) Centrifuge. A mechanical device In which centrifugal force Is used to separate solids from liquids or to separate liquids of different densi"as; (9) Chemical Addition Systems-The addition of chemical(s)to wastewater at an application point for purposes of improving solids removal,pH adjustment, alkalinity control,etc.;the capability to experiment with different chemicals and different application points to achieve a specific result will be considered one system;the capability to add chemical(s)to dual units will be rated as one system;capability to add a chemical at a different application points for different I purposes will result in the systems being rated as separate systems; (10) Chemical Sludge Conditioning. The addition of a chemical compound such as lime,ferric chloride,or a polymer to wet sludge to coalesce the mass prior to its application to a dewatering device; (11) Closed Cycle Systems. Use of holding ponds or holding tanks for containment of wastewater containing inorganic, non-toxic materials from sand,gravel, crushed stone or other similar operations.Such systems shall carry a maximum of two points regardless of pumping facilities or any other appurtenances; (12)Combined Removal of Carbonaceous BOD and Nitrogenous Removal by Nitrification-A single stage system required to achieve permit effluent limits on BOD and ammonia nitrogen within the same biological reactor, (13) Dechlorination.
