On July 13, 2015, the Division of Water Resources (Division) received your application dated
July 7, 2015 requesting a 401 Water Quality Certification and Riparian Buffer Authorization
from the Division for your project. The Division has determined that your application is
incomplete and cannot be processed. The application is on -hold until the following
information is received:
1. Provide the project boundary on a USGS 1:24,000 topographic map. [15A NCAC 02H
0502(b)]
2. The extent of protected riparian buffers within the property must be verified by the
Division of Water Resources (DWR). In this case, the origin point of the stream needs to
be verified by the DWR. [15A NCAC 02B .0233(8)(b)(iv)]
3. The impervious surface of the project should include houses, driveways, and sidewalks
in addition to the road network. The application states that the percent imperviousness
is 0.118 %, and that does not appear to reflect all impervious surfaces. Water Quality
Certification #3886 requires a stormwater management plan if the overall

imperviousness of the project is greater than 24% (high density). [15A NCAC 02H
.0506(b)(5) and (c)(5)]
4. If the overall percent imperviousness of the project is less than 24% (low density), then
a diffuse flow plan is necessary. The plans submitted with the application depict level
spreaders to meet this objective. If this project meets the definition of low density, then
please provide a signed BMP Supplemental Form and Operations and Maintenance
Form for each proposed BMP. The Supplemental Forms can be found on NCDENR's
BMP Manual Webpage. The Supplemental Form and proposed design of the level
spreaders should use the correct impervious surface of the future build out of the site
including houses, driveways, etc. Also, please provide details of the level spreaders and
ditches. In addition, per the requirements of Attachment A in Water Quality
Certification #3886, please submit two copies of the DWR Low Density Supplement
Form with all required items found at http: / /portal.ncdenr.orR /web /Ir /state-
stormwater -forms docs. [15A NCAC 02H .0506(b)(5) and (c)(5)]
Pursuant to Title 15A NCAC 02H .0502(c) and Title 15A NCAC 02B.0233 (8), the applicant shall
furnish all of the above requested information for the proper consideration of the application.
If all of the requested information is not received in writing within 30 calendar days of receipt
of this letter, the Division will be unable to approve the application and it will be returned. The
return of this project will necessitate reapplication to the Division for approval, including a
complete application package and the appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending four copies
of all of the above requested information to the 401 & Buffer Permitting Unit, 1617 Mail Service
Center, Raleigh, NC 27699 - 1617.
Please be aware that you have no authorization under the Water Quality Certification Rules for
this activity.
