Dear Sir/Madame:
On behalf of Cargill Grain and Oilseed Supply Chain North America, Burns & McDonnell is pleased to
submit this Preconstruction Notification Form Application. Please Note this is an "after-the-fact" 401
authorization request submitted under direction of Mason Herndon. Cargill, Incorporated owns
approximately 40 acres of land to the north of their existing facility in Cumberland County, between
River Road and Custer Avenue. Cargill plans to expand this plant and increase access and traffic flow to
and from this expansion by building a new road at the north end of the property. The new road will be
constructed approximately 1950 feet north of Underwood Road, connecting River Road and Custer
Avenue. Once the new road is complete, it will be donated to NCDOT. At that time, the existing
Underwood Road will be given to Cargill, Incorporated for private use and maintenance. Included in this
application package please find the following items:

authorizes the NCDOT to impact an additional 13 linear feet of jurisdictional streams. In addition, you should
acquire any other federal, state or local permits before you proceed with your project including (but not limited to)
Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire
with the accompanying 404 permit. �
This approval is valid solely for the purpose and design described in your application (unless modified below). Far
this approval to remain valid, you must adhere to the conditions listed in the original Water Quality Certification
dated February 14, 2013 except where superseded by this modification. Should your project change, you must
notify the NCDWR and submit a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter, and is thereby responsible for complying with all the conditions. [f total

1. In order to compensate for impacts associated with this permit, mitigation shall be provided in
accordance with the provisions outlined on the most recent version of the attached
Compensatory Mitigation Responsibility Transfer Form. The requirements of this form,
including any special conditions listed on this form, are hereby incorporated as special conditions
of this permit authorization.
Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the
attached conditions and your plans submitted on 30 May, 2014. Any violation of the attached condirions or
deviarion from your submitted plans may subject the permittee to a stop work order, a restoration order and/or
appropriate legal action.
This verificarion will remain valid until the expiration date identified below unless thepationwide authorization
is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide permit
authorization is reissued and/or modified, this verification will remain valid until the expiration date identified
below, provided it complies with all requirements of the modified nationwide permit. If the nationwide permit
authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with
the terms and conditions of the nationwide permit, activities which have commenced {i.e., are under construction) or
are under contract to commence in reliance upon the nationwide pernut, will remain authorized provided the acti�ity
is completed within twelve months of the date of the narionwide permit's expiration, modificarion or revocation,
unless discretionary authority has been exercised on a case-by-case basis to modify, suspend: or revoke the
authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality
Cert�cation. You should contact the NC Division of Water Quality (telephone (919) 733-1786) to determine

Management Act (CAMA), prior to beginning work you must contact the N.C. Division of Coastal Management.

1. In order to compensate for impacts associated with this permit, mitigation shall be provided in
accordaace with the provisions outlined on the most recent version of the attached
Compensatory Mitigation Responsibility Transfer Form. The requiremeats of this forin,

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the

• Once this document has been signed by the Mitigation Sponsor and the USACE is in receipt of the signed form, the
Permittee is no longer responsible for providing the mitigation identified in this form, though the Permittee remains
responsible for any other mitigation requirements stated in the permit conditions.
• Construction within jurisdictional areas authorized by the permit identified on page one of this form can begin only
after the USACE is in receipt of a copy of this document signed by the Sponsor, confirming that the Sponsor has

The Stormwater Permitting Unit received a complete Stormwater Management Permit Application
for the subject project on February 27, 2015. Staff review of the plans and specifications has
determined that the project, as proposed, will comply with the Stormwater Regulations set forth in
Title 15A NCAC 2H.1000 and Session Law 2006-246. We are forwarding Permit No. SW6150203
dated March 17, 2015, for the construction, operation and maintenance of the subject project.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the
conditions and limitations as specified therein, and does not supersede any other agency permit
that may be required. Please pay special attention to the conditions listed in this permit regarding
the Operation and Maintenance of the BMP(s), recordation of deed restrictions, procedures for
changes of ownership, transferring the permit, and renewing the permit. Failure to establish an
adequate system for operation and maintenance of the stormwater management system, to record
deed restrictions, to follow the procedures for transfer of the permit, or to renew the permit, will
result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing by filing a written petition with the Office of Administrative
Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General
Statutes. Per NCGS 143-215(e) the petition must be filed with the OAH within thirty (30) days of
receipt of this permit. You should contact the OAH with all questions regarding the filing fee (if a
filing fee is required) and/or the details of the filing process at 6714 Mail Service Center, Raleigh,

FOR THE
construction, operation and maintenance of a future public road and stormwater
conveyance project, in compliance with the provisions of 15A NCAC 2H ,1000 and S.L.
2006-246 (hereafter referred to as the "stormwater ru/es'� and the approved stormwater
management plans and specifications, and other supporting data as attached and on
file with and approved by the Division of Energy, Mineral and Land Resources Land
Quality Section and considered a part of this permit. The road is to be conveyed upon
completion to the North Carolina Department of Transportation (NCDOT).
The Permit shall be effective from the date of issuance until rescinded and shall be
subject to the following specific conditions and limitations:
I. DESIGN STANDARDS
1. This permit covers the construction of a future public road and the stormwater
management conveyance system as shown on the approved site plan which is to
be conveyed to NCDOT upon completion.
2. Approved plans and specifications for projects covered by this permit are
incorporated by reference and are enforceable parts of the permit.
3. The only runoff conveyance systems allowed will be vegetated conveyances
such as swales with minimum side slopes of 3:1 (H:V) as defined in the
stormwater rules and approved by the Division.
4. No piping is allowed except that minimum amount necessary to direct runoff
beneath an impervious surface such as a road or to provide access.
5. The built-upon areas associated with this project shall be located at least 30 feet
landward of all perennial and intermittent streams.
6. Level spreaders, plunge pools and other water velocity dissipaters shall be
provided at the ends of all swales that discharge into a regulated stream buffer.
7. All swales shall that discharge into a wetland shall do so at a non-erosive velocity
for the 10 year storm.

Ii. SCHEDULE OF COMPLIANCE
1. The permittee is responsible for verifying that the proposed public road project
stormwater management system will function as designed and meet the minimum
requirements of the permit.
2. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Wi#hin the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements. The pe�mittee shall provide
copies of revised plans and certification in writing to the Director that the changes
have been made.
3. This project may not be sold or subdivided in whole or in part without first receiving a
permit modification from the Division.
4. The following deed restrictions must be recorded with the Office of the Register of
Deeds:
a. The following covenants are intended to ensure ongoing compliance with
State Stormwater Management Permit Number SW6150203, as issued by
the Division of Energy, Mineral and Land Resources Land Quality Section
under the stormwater rules.
b. The State of North Carolina is made a beneficiary of these covenants to
the extent necessary to maintain compliance with the Stormwater
Management Permit.
c. These covenants are to run with the land and be binding on all persons
and parties claiming under them.
d. The covenants pertaining to stormwater may not be altered or rescinded
without the express written consent of the State of North Carolina,
Division of Energy, Mineral and Land Resources Land Quality Section.
e. Alteration of the drainage as shown on the approved plans may not take
place without the concurrence of the Division of Energy, Mineral and Land
Resources Land Quality Section.
f. This project is permitted for a public road and/or bridge project.
Construction of additionai built-upon area within the permitted project area
will require a permit modification.
g. This project may not be sold or subdivided, in whole or in part, without first
receiving a permit modification from the Division.
h. Construction of additional impervious areas such that the stormwater
management system will no longer function as designed will require a
permit modification prior to construction. An engineered system will be
required to collect and treat the runoff from all built-upon area associated
with the project, including that area originally permitted under the public
roads and bridges stormwater permit option.
i. Filling in or piping of any vegetative conveyances (ditches, swales, etc.)
associated with this development, except for average driveway crossings,
is strictly prohibited by any persons.
j. The built-upon areas shall be located a minimum of 30 feet landward of all
perennial and intermittent surface waters.

6. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed below:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
c. Transfer of ownership.
d. Redesign or addition to the approved amount of built-upon area.
e. Further subdivision, acquisition, or sale of the project area in whole or in
part. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval was sought.
f. Filling in, altering or piping any vegetative conveyance shown on the
approved plan.
8. Swales and other vegetated conveyances shall be constructed in their entirety,
vegetated, and be operational for their intended use prior to the construction of
any built-upon surface.
9. During construction, erosion shall be kept to a minimum and any eroded areas of
the swales or other vegetated conveyances will be repaired immediately.
10. The permittee shall at all times provide the operation and maintenance
necessary to operate the permitted stormwater management systems at
optimum efficiency to include:
a. Inspections
b. Sediment removal.
c. Mowing, and re-vegetating of the side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.
11. Within 30 days of completion of the project, the permittee shall certify in writing
that the project has been constructed in accordance with the approved plans.
12. The permittee shall submit all information requested by the Director or his
representative within the time frame specified in the written information request.
III. GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and
approval by the Director. The Director may require modification or revocation and
re-issuance of the permit to change the name and incorporate such other
requirements as may be necessary. In the event of a name or ownership
change, a completed Name/Ownership Change form, signed by both parties,
must be submitted to the Division of Energy, Mineral and Land Resources Land
Quality Section accompanied by the supporting documentation as listed on page
2 of the form. The approval of this request will be considered on its merits, and
may or may not be approved.
2. The permittee is responsible for compliance with all permit conditions until the
Director approves a transfer of ownership. Neither the sale of the project nor the
transfer of common areas to a third party, such as a homeowner's association,
constitutes an approved transfer of the stormwater permit.

3. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to an enforcement action by the Division of Energy, Mineral
and Land Resources Land Quality Section, in accordance with North Carolina
General Statutes 143-215.6A to 143-215.6C.
4. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit
as allowed by the laws, rules, and regulations contained in Session Law 2006-
246, Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000;
and North Carolina General Statute 143-215.1 et. al.
5. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by the Division, such as the construction of
additional or replacement stormwater management systems.
6. The permittee grants permission to DENR Staff to enter the property during
normal business hours, for the purpose of inspecting all components of the
stormwater management facility.
7. The permit issued shall continue in force and effect until revoked or terminated.
The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and re-issuance, or
termination does not stay any permit condition.
8. Unless specified elsewhere, permanent seeding requirements for the swales
� must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
9. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
10. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state and federal), which have jurisdiction.
11. The permittee shall notify the Division in writing of any name, ownership or
mailing address changes at least 30 days prior to making such changes.

the Division of Water Quality, North Carolina Department of Environment and Natural Resources. If one acre or more of land is
to be disturbed, prior to the issuance of any building/zoning permits for this site, a copy of the State's Post-Constn�ction Permit

5. For any new development where the developer disturbs or intends to disturb more than one acre of land, the developer must
provide the Code Enforcement Section with an approved NC Department of Environment and Namral Resources (NCDENR)
sedimentation and erosion control plan (S&E) prior to any application for permits. (Note: If any retention/detention basins are
required for state approval of this plan, then Uvee copies of a revised plan must be submitted and approved by Planning &
Inspections prior to application for any building/zoning permits.) A copv of the NCDENR approval must be orovided to Code

A permit will be required for this project if construction will involve the temporary and/or permanent placement of fill in waters
of the United States including wetlands. If a permit is required, the applicant will be required to avoid and minimize impacts to
wetland/waters of the United States and may need to provide compensatory mitigation for unavoidable impacts.
9. The developer must formally notify the NC Department of Transportation once construction of the public streets are complete and
initiate the process of transferring the responsibility of road maintenance to the NCDOT. If application to the NCDOT District
Engineer has not been formally submitted by the time building permits have been issued for 80% of the lots shown on the
preliminary plan, no additional building permits can be issued until the NCDOT District Engineer notifies this department of the
receipt of the application.
Site-Related:
10. All uses, dimensions, setbacks and other related provisions of the County Subdivision and Development Ordinance and Zoning
Ordinances for the M(P) zoning district must be complied with, as applicable.
11. For any new developme�t, an adequate drainage system must be installed by the developer in accordance with the NC
DepaRment of Environment and Natural Resources' (NCDENR) Manual on Best Management Praclices and all drainage ways
must be kept clean and free of debris. (Section 2306 D, County Subdivision and Development Ordinance)
12. For new development, all utilities, except for 25kv or greater electrical lines, must be located underground. (Section 2306 C,
County Subdivision and Development Ordinance)
13. In the event a stormwater utility structure is required by the NC Department of Environment and Natural Resources (NCDENR),
the owner/developer must secure the structure with a four foot high fence with a lockable gate, and is required to maintain the
detention/retention basin, keeping it clear of debris and taking measures for the prevention of insect and rodent infestation.
14. This review does not constitute a"subdivision" approval by NC Department of Transportation (NCDOT). A separate submittal to
NCDOT will be required prior to consideration for addition to the system of any sheet within this development.
15. The developer must obtain a driveway permit from the NC Department of Transportation (NCDOT). A coov of the aovroved
drivewaypermit must be provided to Code Enforcement at the time of aoolication for building/zonin�permits.

RE: Cargill Road Project Pre-Construction Notification Application
Dear Sir/Madame:
On behalf of Cargill Grain and Oilseed Supply Chain North America, Burns & McDonnell is pleased to
submit this Preconstruction Notification Form Application. Please Note this is an "after-the-fact" 401
authorization request submitted under direction of Mason Herndon. Cargill, Incorporated owns
approximately 40 acres of land to the north of their existing facility in Cumberland County, between
River Road and Custer Avenue. Cargill plans to expand this plant and increase access and traffic flow to
and from this expansion by building a new road at the north end of the property. The new road will be
constructed approximately 1950 feet north of Underwood Road, connecting River Road and Custer
Avenue. Once the new road is complete, it will be donated to NCDOT. At that time, the existing
Underwood Road will be given to Cargill, Incorporated for private use and maintenance. Included in this
application package please find the following items:
� The PCN application form
• The permit fee in the amount of $240 submitted under a separate cover
• A copy of existing approvals including
o Corps permit
o County Road permit
o Floodplain Development permit
o Erosion and Sediment Control permit
o Stonnwater permit
• Ecosystem Enhancement Program In-Lieu fee letter
